\tThe plaintiff through its
\n\tconstituted attorney, Mohit Advani, has filed this Admiralty Suit
\n\tmaking following prayers :-\n<\/p>\n
(a)
\n\t\t  that it be declared that there is presently due, owing and
\n\t\tpayable by the defendant to the plaintiff the sum of US$ 245,769.04
\n\t\twith interest of US$ 35,071.53 thereon and further at the rate of
\n\t\t2% per cent per month from date till payment and\/or realization
\n\t\tand\/or costs of US$ 20,000;\n<\/p>\n
(b)
\n\t\t that the defendant be ordered and decree to pay to the plaintiff
\n\t\tthe sum of US$ 245,769.04 main debt and US$ 35,071.53 accrued
\n\t\tinterest together with interest thereon at the rate of 2% per month
\n\t\tthe date of the suit till payment and\/or realization;\n<\/p>\n
(c)
\n\t\t  that the defendant vessel together with her hull, tackle,
\n\t\tapparel, plant and machinery be arrested and detained by a warrant
\n\t\tof arrest of this Hon’ble Court;\n<\/p>\n
(d)
\n\t\t that the defendant vessel together with her hull, tackle, apparel,
\n\t\tplant and machinery be condemned in the sum of US$3,00,840.57
\n\t\ttogether with interest thereon at the rate of 2% fr the date of
\n\t\tthis suit till payment and\/or realization, costs and poundage;\n<\/p>\n
(e)
\n\t\t that the defendant vessel together with her hull, tackle, apparel,
\n\t\tplant and machinery be sold and the sale proceeds thereof be
\n\t\tappropriated towards the claim in suit and poundage;\n<\/p>\n
\tThe plaintiff has also
\n\tprayed for an interim relief seeking an order that the defendant
\n\tvessel alongwith  engines, machinery, articles and things on board
\n\tbe arrested for satisfaction of the plaintiff’s claim in suit.\n<\/p>\n
\tHeard Mr.Mihir Joshi,
\n\tlearned Senior Advocate appearing with Mr.Nitin Mehta, learned
\n\tadvocate for the plaintiff and perused the memo of plaint alongwith
\n\tdocuments attached therewith. Before filing present suit the
\n\tplaintiff has also filed proceedings before Second Maritime Court of
\n\tPanama as well as before the Bombay High Court. It is stated at bar
\n\tby Mr.Joshi on instructions that the proceedings before the Second
\n\tMaritime Court of Panama have already been withdrawn. He has further
\n\tsubmitted that Admiralty Suit No.2180 of 2010 was filed before the
\n\tBombay High Court and arrest order was obtained. However, the said
\n\torder could not be served and hence on 23.7.2010 arrest warrant was
\n\tlifted and, thereafter, on 5.8.2010 the said Admiralty Suit was
\n\twithdrawn. Both these orders of arrest of vessel as well as
\n\twithdrawal of the suit are placed on record.\n<\/p>\n
\tHaving considered the
\n\tsubmissions made by the learned counsel and having perused the
\n\tdocuments and plaint the Court is of the prima facie view that the
\n\tdefendant has failed and\/or neglected to pay the plaintiff’s dues
\n\tfor the necessaries supplied. The
\n\tCourt has also taken into consideration the submissions made on
\n\tbehalf of the plaintiff that unless the vessel, namely,
\n\tM.V.ANTIGONI, together with her hull, tackle, machinery, engines,
\n\tbunkers and appurtenance is arrested, the Plaintiff will suffer
\n\tirreparable loss in the event vessel – M.V.ANTIGONI  is permitted to
\n\tleave Bedi Port at Jamnagar without furnishing the security. The
\n\tplaintiff will have no scope to realise the outstanding dues and
\n\thence considering the prima faice case established by the Plaintiff,
\n\tI am of the view that the Plaintiff will be put to irreparable loss
\n\tand injury and therefore, it is necessary to arrest the vessel –
\n\tM.V.ANTIGONI presently lying in the waters of Port\/Harbour, Bedi at
\n\tJamnagar.\n<\/p>\n
\tI,
\n\ttherefore, do hereby make an order that the Registrar of this Court
\n\tdo issue an order for arrest of vessel – M.V.ANTIGONI together with
\n\ther hull, tackle, machinery, engines, bunkers and appurtenance at
\n\tpreset lying in the waters of Port\/Harbour of Bedi at Jamnagar and
\n\tthat the warrant of arrest be executed at any time of the day or
\n\tnight or on Sundays or Holidays and I do further order that the Port
\n\tofficer and Harbour Master at Bedi, Jamnagar and the Assistant
\n\tCommissioner of Customs at Bedi, Jamnagar do effect the arrest of
\n\tvessel – M.V.ANTIGONI at Bedi, Jamnagar and\/or such other place
\n\twhere ever she may be within territorial waters of Gujarat and I do
\n\tfurther order that if defendant and\/or those interested in her,
\n\tdeposits in this Court a sum of Rs.1,42,47,809.39 together with
\n\tinterest @ 2% per month till payment\/realisation to the satisfaction
\n\tof this Court as security towards the satisfaction of the
\n\tplaintiff’s claim in the suit, the said warrant of arrest shall not
\n\tbe executed against the defendant.\n<\/p>\n
\tThe
\n\tPort Officer\/Harbour Master at Bedi, Jamnagar and Assistant
\n\tCommissioner of Customs at Bedi, Jamnagar are directed to arrest the
\n\tvessel – M.V.ANTIGONI at present lying at Port and Harbour at Bedi,
\n\tJamnagar and to keep the vessel under arrest until further order of
\n\tthis Court. It is further ordered that Port\/Harbour Authorities and
\n\tCustoms Authorities shall not grant beaching permission to beach
\n\tvessel – M.V.ANTIGONI. It is further ordered that the Port
\n\tOfficer\/Harbour Master and the Customs Officer at Bedi, Jamnagar,
\n\tGujarat shall render all assistance to the plaintiff in effecting
\n\tthe arrest of warrant on the vessel   M.V.ANTIGONI.\n<\/p>\n
\t It is open for the
\n\tPlaintiff’s advocate to communicate the above order by fax message
\n\tat their own cost and the authorities are directed to act on fax
\n\tmessage.\n<\/p>\n
\tNotice
\n\tto the defendant returnable on 13th
\n\tAugust, 2010. It is made clear that it will be open for the
\n\tdefendant to approach this Court even prior to the returnable date,
\n\tby giving 48 hours advance notice to the plaintiff and\/or its
\n\tadvocates for necessary modification of this order.\n<\/p>\n
\t Office is directed to
\n\tserve the warrant of arrest on the Master of the vessel –
\n\tM.V.ANTIGONI through her agent and send a copy thereof to the Port
\n\tand Customs Officers\/ Harbour Master at Bedi, Jamnagar.\n<\/p>\n
\tAn
\n\taffidavit of undertaking is already furnished by the constituted
\n\tattorney of the plaintiff. The same is taken on record.\n<\/p>\n
\t Direct service is
\n\tpermitted today.\n<\/p>\n
