Justice P.BHAVADASAN\n\n Dated :05\/01\/2011\n\n O R D E R\n<\/pre>\n<p>                       P.BHAVADASAN, J.\n<\/p>\n<p>                 &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-\n<\/p>\n<p>                       SA No.16 of 1999-B\n<\/p>\n<p>                 &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-<br \/>\n            Dated this the 5th day of January 2011<\/p>\n<p>                            Judgment<\/p>\n<p>           This appeal arises out of an assessment<\/p>\n<p>proceedings initiated by the defendant Corporation in<\/p>\n<p>respect of a hotel building said to belong to the plaintiff.<\/p>\n<p>According to the plaintiff, the building was let out to a<\/p>\n<p>single tenant and therefore, it should be assessed only in<\/p>\n<p>that manner. Initially, the Corporation did so. But, later,<\/p>\n<p>they found that the rooms of the building were given to<\/p>\n<p>different persons on separate rental arrangement and the<\/p>\n<p>claim of the plaintiff that the building was outstanding on a<\/p>\n<p>single tenancy, was incorrect. Therefore, assessment was<\/p>\n<p>made in respect of each room.\n<\/p>\n<p>           2. Aggrieved by the assessments so made, the<\/p>\n<p>plaintiff seems to have filed an appeal before the<\/p>\n<p>Commissioner. That was rejected. The plaintiff would say<\/p>\n<p>that thereafter, the plaintiff filed an appeal before the<\/p>\n<p><span class=\"hidden_text\">SA No.16\/99                      2<\/span><\/p>\n<p>standing committee, which had not been disposed of as on<\/p>\n<p>the date of filing of the suit. The main grievance of the<\/p>\n<p>plaintiff was that it was without following the legal<\/p>\n<p>formalities and procedures that the assessment was done<\/p>\n<p>and that is in violation of the principles of natural justice<\/p>\n<p>and relevant statutory provisions.\n<\/p>\n<p>            2. The defendant responded by pointing out that<\/p>\n<p>the plaintiff was unable to show that the building was<\/p>\n<p>outstanding on a single tenancy. In pursuance of the<\/p>\n<p>inspection made by the officials of the Corporation and the<\/p>\n<p>report made available, the rooms in the building were<\/p>\n<p>outstanding on independent lease with different persons.<\/p>\n<p>They pointed out that no appeal has been filed before the<\/p>\n<p>standing committee and only a complaint has been<\/p>\n<p>preferred, which cannot be considered.<\/p>\n<p>            3. When demand notice was served on the<\/p>\n<p>plaintiff, she approached the trial court. The trial court was<\/p>\n<p>unimpressed by the case put forward by the plaintiff and<\/p>\n<p>dismissed the suit. The plaintiff went up in appeal as AS<\/p>\n<p><span class=\"hidden_text\">SA No.16\/99                           3<\/span><\/p>\n<p>No.71\/96 before the Sub Court, Kozhikode. The lower<\/p>\n<p>appellate court, on a consideration of the materials, found<\/p>\n<p>that there has been gross violation of the procedural<\/p>\n<p>formalities in making the assessment of tax due from the<\/p>\n<p>plaintiff and on that sole ground, set aside the judgment<\/p>\n<p>and decree of the trial court. However, the lower appellate<\/p>\n<p>court was careful enough to ensure that the Corporation<\/p>\n<p>was at liberty to make the assessments in accordance with<\/p>\n<p>law. The said judgment and decree are assailed in this<\/p>\n<p>second appeal.\n<\/p>\n<p>           4. The following questions of law are seen raised<\/p>\n<p>in this second appeal :\n<\/p>\n<blockquote><p>            &#8220;(A)  Having regard to the fact that the suit is one for a<\/p>\n<p>            declaration that the proceedings taken by the defendant-<\/p>\n<p>            Corporation under the Kerala Municipal Corporations<\/p>\n<p>            Act for assessing the property owned by the plaintiff to<\/p>\n<p>            property tax is void, illegal and inoperative as against<\/p>\n<p>            the plaintiff and since the provisions of the said Act had<\/p>\n<p>            been complied with by the defendant-Corporation for<\/p>\n<p>            making the assessment, is not the suit barred and not<\/p>\n<p><span class=\"hidden_text\">SA No.16\/99                         4<\/span><\/p>\n<p>           maintainable in view of the provisions contained in<\/p>\n<p>           Section 429 of the Kerala Municipal Corporations Act,<\/p>\n<p>           1961 ?\n<\/p><\/blockquote>\n<blockquote><p>           (B)   Having regard to the fact that the Kerala Municipal<\/p>\n<p>           Corporations Act, 1961 provides for the procedure to be<\/p>\n<p>           followed by the assessing authority in the matter of<\/p>\n<p>           assessing the property to property tax and has also<\/p>\n<p>           provided for a remedy available to the aggrieved<\/p>\n<p>           assessee     to  file appeal    against  the   concerned<\/p>\n<p>           authorities prescribed by the Taxation Rules and since<\/p>\n<p>           the plaintiff has not availed of such alternative remedy,<\/p>\n<p>           is not the suit liable to be dismissed on this ground<\/p>\n<p>           alone ?\n<\/p><\/blockquote>\n<blockquote><p>           &#8216;(C)  Having regard to the fact that the Kerala Municipal<\/p>\n<p>           Corporations Act has provided for an elaborate<\/p>\n<p>           procedure to be followed by the assessing authority in<\/p>\n<p>           the matter of assessing of property to property tax under<\/p>\n<p>           the Act, has not the lower appellate court committed an<\/p>\n<p>           error in assuming that the principles of natural justice<\/p>\n<p>           have been violated in making the assessment in<\/p>\n<p>           question ?\n<\/p><\/blockquote>\n<blockquote><p>           (D)   Having regard to the fact that the plaintiff has not<\/p>\n<p><span class=\"hidden_text\">SA No.16\/99                         5<\/span><\/p>\n<p>            produced any oral and documentary evidence          in<\/p>\n<p>            support of her case    that property tax has not been<\/p>\n<p>            assessed properly and opposed to facts and thereby the<\/p>\n<p>            assessee-plaintiff has failed to discharge the onus of<\/p>\n<p>            proof cast on her, should not the lower appellate court<\/p>\n<p>            have dismissed the suit on this ground ?&#8221;<\/p><\/blockquote>\n<p>            5. The learned counsel for the appellant pointed<\/p>\n<p>out that in view of Section 429 of the Kerala Municipal<\/p>\n<p>Corporations Act, 1961, the suit was not maintainable.<\/p>\n<p>Further, statutory remedies being available to the plaintiff,<\/p>\n<p>the plaintiff should have taken recourse to those remedies<\/p>\n<p>and by-passing the statutory remedies, she cannot<\/p>\n<p>approach the civil court for redressal of her grievance. It is<\/p>\n<p>also pointed out that the plaintiff had not produced any<\/p>\n<p>document to show that the building was outstanding on<\/p>\n<p>single tenancy. It is also significant to notice that no oral<\/p>\n<p>evidence whatsoever was adduced by the plaintiff in<\/p>\n<p>respect of the allegations in the plaint. Therefore, it is<\/p>\n<p>contended that the judgment and decree of the lower<\/p>\n<p><span class=\"hidden_text\">SA No.16\/99                    6<\/span><\/p>\n<p>appellate court are unsustainable in law.<\/p>\n<p>           6. The learned counsel for the respondent, on<\/p>\n<p>the other hand, pointed out relying on     the decision in<\/p>\n<p>&#8220;<a href=\"\/doc\/1073163\/\">Corporation of Thiruvananthapuram v. Bhaskaran<\/p>\n<p>Nair<\/a>&#8221; (1985 KLT 213) that it is true that normally the<\/p>\n<p>aggrieved party cannot approach the civil court directly for<\/p>\n<p>redressal of his grievance, but, there may be exceptional<\/p>\n<p>circumstances, when recourse to civil court for redressal of<\/p>\n<p>grievance can be had. One such instance is when there is<\/p>\n<p>gross violation of natural justice and total violation of<\/p>\n<p>procedural formalities while making the assessment. This is<\/p>\n<p>a typical case of the said nature and therefore, the lower<\/p>\n<p>appellate court was justified in granting a decree, it is<\/p>\n<p>contended.\n<\/p>\n<p>           7. The point of law raised is only of academic<\/p>\n<p>interest. The lower appellate court has not precluded the<\/p>\n<p>Corporation from making fresh assessment. In the light of<\/p>\n<p>the plea they have taken in the written statement, all that<\/p>\n<p><span class=\"hidden_text\">SA No.16\/99                         7<\/span><\/p>\n<p>the lower appellate court has stated is that they shall follow<\/p>\n<p>the proper procedure and comply with the formalities under<\/p>\n<p>the statute. The lower appellate court has not interdicted<\/p>\n<p>the Corporation from taking such courses are as available<\/p>\n<p>to them to make the assessment. In the light of the said<\/p>\n<p>fact, it is unnecessary to go into the question as to whether<\/p>\n<p>it was proper on the part of the plaintiff to have approached<\/p>\n<p>the civil court instead of availing the statutory remedies.<\/p>\n<p>Since no rights of the Corporation, as such, are affected<\/p>\n<p>and liberty is given to them to proceed in accordance with<\/p>\n<p>law, it is felt that at this distance of time, interference is not<\/p>\n<p>called for.\n<\/p>\n<p>             The result is that since no prejudice is, as such,<\/p>\n<p>caused to the Corporation, this appeal is only to be<\/p>\n<p>dismissed. It is accordingly dismissed.
