No. 721 OF 2005\n           = = = = = = = = = = = = = = =\n      Dated this the 20th day of October, 2010.\n\n                     O R D E R\n<\/pre>\n<p>Krishnan, J.\n<\/p>\n<p>    This review petition is preferred to review<\/p>\n<p>the judgment in L.A.A.721\/05.      The said appeal<\/p>\n<p>was   preferred    against    the   award   of  the<\/p>\n<p>Subordinate Judge, Kozhikode in L.A.R.245\/00.<\/p>\n<p>The   Division   Bench   of   this   Court   jointly<\/p>\n<p>disposed     of    the    matters     taking   into<\/p>\n<p>consideration the award passed in L.A.R.479\/97<\/p>\n<p>which was the subject matter of appeal in<\/p>\n<p>L.A.A.774\/06. Now it is contended that the said<\/p>\n<p>judgment has been recalled and therefore the<\/p>\n<p>matter requires review.\n<\/p>\n<p>    2.   A perusal of the award appealed against<\/p>\n<p>would show that 0.0180 hectares of garden land<\/p>\n<p>R.P. No. 217 OF 2010 IN<br \/>\nL.A.A. No. 721 OF 2005<br \/>\n<span class=\"hidden_text\">                         -:2:-<\/span><\/p>\n<p>and 0.022 hectares of wet land in Sy.No.76\/9 of<\/p>\n<p>Nellikode village had been acquired and the<\/p>\n<p>Court had fixed the land value at Rs.63,500\/-<\/p>\n<p>for garden land and Rs.59,850\/- for the wet<\/p>\n<p>land. A perusal of the award passed by the Land<\/p>\n<p>Acquisition Court would reveal that it not only<\/p>\n<p>relied upon the judgment in L.A.R.491\/77 but<\/p>\n<p>also relied upon the judgment in L.A.R.168\/00.<\/p>\n<p>It can be stated that the land value of the<\/p>\n<p>property    was    fixed    after  taking  into<\/p>\n<p>consideration   the   various  materials. Ext.A3<\/p>\n<p>therein is a certified copy of the judgment in<\/p>\n<p>L.A.R.168\/00.   Ext.A3 is relied upon and it is<\/p>\n<p>stated in that case that the property covered is<\/p>\n<p>situated about one km. away from the acquired<\/p>\n<p>property and it is a water logged area lying in<\/p>\n<p>a lower level. The notification with respect to<\/p>\n<p>R.P. No. 217 OF 2010 IN<br \/>\nL.A.A. No. 721 OF 2005<br \/>\n<span class=\"hidden_text\">                         -:3:-<\/span><\/p>\n<p>the land acquired in the above said reference is<\/p>\n<p>in the year 1998. It is true that the Court has<\/p>\n<p>also   mentioned     about    the   judgment   in<\/p>\n<p>L.A.R.479\/97. So after taking into consideration<\/p>\n<p>the materials the Court felt hat 5% enhancement<\/p>\n<p>has to be given as acquisition in L.A.R.479\/97<\/p>\n<p>was as early as in the year 1993 and accordingly<\/p>\n<p>the land value has been fixed. A perusal of the<\/p>\n<p>entire award would reveal the nature of the<\/p>\n<p>land, fertility of the land etc.      It is very<\/p>\n<p>clearly   stated   the   entire   properties  are<\/p>\n<p>adjacent lands situated within a distance of 200<\/p>\n<p>mtrs. from Thondayad Bazar.     It is also stated<\/p>\n<p>that  number   of   business  establishments  and<\/p>\n<p>governmental    educational    institutions   and<\/p>\n<p>residential   complexes  are   situated  in  that<\/p>\n<p>property. So only taking into consideration the<\/p>\n<p>R.P. No. 217 OF 2010 IN<br \/>\nL.A.A. No. 721 OF 2005<br \/>\n<span class=\"hidden_text\">                         -:4:-<\/span><\/p>\n<p>totality of the materials the Land Acquisition<\/p>\n<p>Court has fixed the land value.    Therefore just<\/p>\n<p>because there is a reduction by this Court in<\/p>\n<p>L.A.A.774\/06 it will not militate against the<\/p>\n<p>award passed by the Land Acquisition Court.<\/p>\n<p>Therefore this review petition is dismissed.<\/p>\n<p>                          M.N.
