WADHWA\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     We have heard learned counsel on both sides.<br \/>\n     This Court by order dated December 12, 1995 in <a href=\"\/doc\/756679\/\">Union of<br \/>\nIndia &amp;\t Ors. vs.  Ghanshyam Dass Kedia &amp; Ors.<\/a> [(1996) 2 SCC<br \/>\n285] had  given direction  to the DDA and the Union of India<br \/>\nthat 19\t persons, the  appellants therein,  be given 330 sq.<br \/>\nyard each uniformly for construction of their houses, as per<br \/>\nplans  sanctioned   by\tthe   authorities,  with  all  other<br \/>\namenities. It would appear that there was some problem which<br \/>\nwas not\t brought to the notice of the Court at the time when<br \/>\nthe matter  was disposed  of. I.As.  were filed,  one by the<br \/>\nUnion of  India and one by DDA. As per the application filed<br \/>\nby the\tUnion of  India, they  proposed four alternative for<br \/>\nallotment of  the plots\t to them.  After going\tthrough\t the<br \/>\nrecord, we  have put  them to  the learned  counsel for\t the<br \/>\nparties. Shri Harish Salve, learned senior counsel appearing<br \/>\nfor some of them, has also discussed with the parties. After<br \/>\nthe  discussion,  it  now  emerges  that  alternative  No.IV<br \/>\nproposed  by  the  Union  of  India  is\t acceptable  and  is<br \/>\naccordingly accepted by them. As per that, residential flats<br \/>\nare required to be constructed for the said 19 petitioner in<br \/>\nan extent of one acre of the land. The area required for the<br \/>\nsaid flat to be constructed by them will be &#8220;A.B.C.D. &#8211; 1.00<br \/>\nacre&#8221; and  P &amp;\tSP to  be with\tDDA, the area is of 2 acres.<br \/>\nHence, there is no need to cut the existing trees growth. It<br \/>\nis suggested  that the\tpetitioner themselves would make the<br \/>\nconstruction under the direction and supervision of the DDA.<br \/>\nThat also  is agreed.  The Government  of India would change<br \/>\nland use  zone.\t The  DDA  is  directed\t to  give  necessary<br \/>\nsanction to  the plans\tand supervise  the construction; the<br \/>\npetitioners would  construct  the  flats  according  to\t the<br \/>\nspecifications and  as per  the sanction  given by  the DDA.<br \/>\nUnion of  India is  directed to\t change the user of the land<br \/>\nwithin two  months from the date of the receipt of the order<br \/>\nand DDA is directed to give necessary sanction and allot the<br \/>\nland within four weeks thereafter.\n<\/p>\n<p>     The Contempt  Petition and I.As. are disposed of in the<br \/>\nabove terms.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Ghanshyam Dass Kedia &amp; Ors vs Shri N.P.
