No.14 of 2007\n                  ------------------------------\n\n             Dated this, the 23rd day of October, 2009\n\n\n                          JUDGMENT\n<\/pre>\n<p>Balakrishnan Nair, J.\n<\/p>\n<p>            The first respondent University invited applications<\/p>\n<p>for appointment to the post of Class IV employees.          The<\/p>\n<p>appellant was one of the candidates. She was not included in<\/p>\n<p>the rank list published pursuant to the said selection.<\/p>\n<p>Therefore, she was not appointed.            Being a physically<\/p>\n<p>challenged person with more than 40% disability, claiming<\/p>\n<p>appointment in the 3% quota ear marked for such candidates,<\/p>\n<p>the Writ Petition was filed.    The University filed a counter<\/p>\n<p>affidavit stating that a physically challenged person, who was<\/p>\n<p>included in the rank list was appointed, while they made<\/p>\n<p>appointments to 30 vacancies. Since the appellant was not<\/p>\n<p>included in the rank list, she could not be considered for<\/p>\n<p>appointment.     Accepting the said contention, the learned<\/p>\n<p>Single Judge dismissed the Writ Petition.      Feeling aggrieved<\/p>\n<p>W.A. No.14 of 2007\n<\/p>\n<p>                              &#8211; 2 &#8211;\n<\/p>\n<p>by the same, the writ appeal is preferred.<\/p>\n<p>            2. Going by the facts of the case, it would appear<\/p>\n<p>that the notification was made for selection of general<\/p>\n<p>candidates. There was no reservation provided in the said<\/p>\n<p>notification for physically challenged persons.       But, the<\/p>\n<p>University has chosen to appoint one physically challenged<\/p>\n<p>person, who found a place in the rank list. From the said<\/p>\n<p>submission, it would appear that, though his turn as per merit<\/p>\n<p>has not arisen, a candidate included in the rank list was<\/p>\n<p>appointed in the quota earmarked for physically challenged<\/p>\n<p>persons.\n<\/p>\n<\/p>\n<p>            3.    Normally, for filling up the 3% quota for<\/p>\n<p>physically challenged persons, separate notification and<\/p>\n<p>selection are made.       In this case, as evident from he<\/p>\n<p>pleadings and materials, there was no reservation for<\/p>\n<p>physically challenged persons in the notification.        The<\/p>\n<p>appellant has not chosen to challenge the notification or the<\/p>\n<p>W.A. No.14 of 2007\n<\/p>\n<p>                              &#8211; 3 &#8211;\n<\/p>\n<p>action of the University in not providing any reservation for<\/p>\n<p>physically challenged persons.     In the absence of such a<\/p>\n<p>challenge, no relief could be granted to the appellant, who did<\/p>\n<p>not find a place in the rank list.    Therefore, though for a<\/p>\n<p>different reason, we dismiss the Writ Appeal.<\/p>\n<p>                                              Sd\/-\n<\/p>\n<p>                                    K.
