RAMKUMAR, J.\n             ========================\n                     B.A. No. 8214 of 2010\n             ========================\n         Dated this the 17th day of December, 2010.\n\n                             ORDER\n<\/pre>\n<p>      Petitioners who are the accused in Crime No.1064 of 2010<\/p>\n<p>of Alappuzha North Police Station for offences punishable under<\/p>\n<p>Sections 143, 147, 148, 149, 452, 341, 323 and 506(1) I.P.C.,<\/p>\n<p>seek anticipatory bail.\n<\/p>\n<p>      2.    The learned Public Prosecutor submitted that the 3rd<\/p>\n<p>petitioner is not an accused in the above crime.        If so, his<\/p>\n<p>apprehension of arrest and harassment is unfounded and his<\/p>\n<p>application for anticipatory bail is rejected.<\/p>\n<p>      3.   After evaluating the factors and parameters which<\/p>\n<p>are to be taken into consideration in the light of paragraph 122<\/p>\n<p>of the verdict    dated    2-12-2010      of the Apex Court    in<\/p>\n<p><a href=\"\/doc\/1108032\/\">Siddharam Satlingappa Mhetre v. State of Maharashtra<\/p>\n<p>and Others (Crl.Appeal No.<\/a> 2271 of 2010),        I am of the view<\/p>\n<p>that anticipatory bail cannot be granted in a case of this nature,<\/p>\n<p>since the investigating officer has not had the advantage of<\/p>\n<p>interrogating the petitioners.       But at the same time, I am<\/p>\n<p>inclined to permit petitioners 1 and 2 to surrender before the<\/p>\n<p><span class=\"hidden_text\">B.A. No. 8214\/2010              -:2:-<\/span><\/p>\n<p>Investigating Officer for the purpose of interrogation and then to<\/p>\n<p>have their application for bail allowed by the Magistrate or the<\/p>\n<p>Court     having jurisdiction.  Accordingly, petitioners 1 and 2<\/p>\n<p>shall surrender before the investigating officer on 27.12.2010<\/p>\n<p>or on        28.12.2010    for the purpose of interrogation and<\/p>\n<p>recovery of incriminating material,        if any.   In case the<\/p>\n<p>investigating officer is of the view that having regard to the<\/p>\n<p>facts of the case arrest of the petitioners is imperative he shall<\/p>\n<p>record his reasons for the arrest in the case diary as insisted<\/p>\n<p>in paragraph 129 of Siddharam Satlingappa Mhetre&#8217;s case<\/p>\n<p>(supra). The petitioners shall thereafter be produced before the<\/p>\n<p>Magistrate or the Court concerned and permitted to file an<\/p>\n<p>application for regular bail.        In case the interrogation of<\/p>\n<p>petitioners 1 and 2      is without   arresting them,   the  said<\/p>\n<p>petitioners shall thereafter appear before the Magistrate or the<\/p>\n<p>Court concerned and apply for regular bail. The Magistrate or<\/p>\n<p>the Court on being satisfied that petitioners 1 and 2 have been<\/p>\n<p>interrogated by the police shall, after hearing the prosecution as<\/p>\n<p>well, release the said petitioners on bail.\n<\/p>\n<p>      4. In case petitioners 1 and 2 while surrendering before<\/p>\n<p>the Investigating Officer have       deprived   the investigating<\/p>\n<p><span class=\"hidden_text\">B.A. No. 8214\/2010                 -:3:-<\/span><\/p>\n<p>officer     sufficient time for interrogation, the officer shall<\/p>\n<p>complete the interrogation       even if it is beyond the time limit<\/p>\n<p>fixed as above and submit a report to that effect              to the<\/p>\n<p>Magistrate or the Court concerned. Likewise, the Magistrate or<\/p>\n<p>the Court also will not be bound by the time limit fixed as<\/p>\n<p>above if sufficient time was not available after the production<\/p>\n<p>or appearance of the petitioners .\n<\/p>\n<p>      5.     The release of petitioners 1 and 2 shall be on each<\/p>\n<p>the petitioners executing a bond for Rs. 15,000\/- (Rupees fifteen<\/p>\n<p>thousand only) with two solvent sureties each for the like amount<\/p>\n<p>to the satisfaction of the Court concerned and subject to the<\/p>\n<p>following conditions:-\n<\/p>\n<blockquote><p>             1.    Petitioners   1 and 2 shall report before the<\/p>\n<p>             Investigating Officer between 9 a.m. and 11 a.m. on all<\/p>\n<p>             Wednesdays.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>             2. Petitioners 1 and 2 shall make themselves available<\/p>\n<p>             for interrogation including custodial interrogation as<\/p>\n<p>             and when required by the Investigating Officer.<\/p>\n<\/blockquote>\n<blockquote><p>             3.    Petitioners 1 and 2 shall not influence or<\/p>\n<p>             intimidate the prosecution witnesses nor shall they<\/p>\n<p><span class=\"hidden_text\">B.A. No. 8214\/2010                  -:4:-<\/span><\/p>\n<p>             attempt to tamper with the evidence for the prosecution.<\/p>\n<\/blockquote>\n<blockquote><p>             4.    Petitioners 1 and 2 shall not commit any offence<\/p>\n<p>             while on bail.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>              5.
