Babita Kumari, wife of Rajiv Ranjan Sinha @ Bhola and\n                 daughter of Subhash Prasad, Resident of Village-Karoo\n                 Bigha, Police Station-Nimchak Bathani, District-Gaya at\n                 present residing at Mohalla-Kamruddinganj, Biharsharif,\n                 P.S.-Laheri, District-Nalanda at Biharsharif.\n                                                         ....Opp. Parties\n                                 -----------\n<\/pre>\n<p>5\/   30.03.2011             Heard the parties.\n<\/p>\n<p>                            In compliance of order dated 09.02.2011,<\/p>\n<p>                  the petitioner as also opposite party no. 2 are<\/p>\n<p>                  physically present in the Court and have been<\/p>\n<p>                  duly identified by their respective counsels. A joint<\/p>\n<p>                  affidavit, duly sworn by the petitioner, as also<\/p>\n<p>                  opposite party no. 2, has also been filed today in<\/p>\n<p>                  the Court, wherein terms and conditions of the<\/p>\n<p>                  compromise      for   restoration    of   matrimonial<\/p>\n<p>                  relationship between the petitioner and opposite<\/p>\n<p>                  party no. 2 have been laid down.\n<\/p>\n<p>                            The petitioner had earlier moved before<\/p>\n<p>                  this Court for grant of anticipatory bail in a criminal<br \/>\n<span class=\"hidden_text\">                  2<\/span><\/p>\n<p>prosecution for offences under Sections 498A and<\/p>\n<p>323 of the Indian Penal Code, as also under<\/p>\n<p>Section 4 of the Dowry Prohibition Act and that<\/p>\n<p>was disposed of by an order dated 30.04.2010<\/p>\n<p>passed    in   Cr.   Misc.   No.   11575    of   2010<\/p>\n<p>(Annexure1), whereby the petitioner was granted<\/p>\n<p>provisional bail for a period of two months and<\/p>\n<p>during that period, the petitioner was required to<\/p>\n<p>enter into a compromise with his wife (O.P. No. 2),<\/p>\n<p>whereafter provisional bail was required to be<\/p>\n<p>confirmed. However, it was also stipulated in that<\/p>\n<p>order that If the petitioner does not enter into a<\/p>\n<p>compromise in that case, then the petitioner will<\/p>\n<p>be obliged to surrender in the court below and<\/p>\n<p>seek regular bail.\n<\/p>\n<p>         From the pleadings in the petition, it<\/p>\n<p>appears that despite endeavour made by the<\/p>\n<p>petitioner, compromise       could not be arrived at<\/p>\n<p>with opposite party no.2. Hence the present<\/p>\n<p>petition for grant of anticipatory bail has been filed<\/p>\n<p>afresh. In response to the notice, opposite party<\/p>\n<p>no. 2 has entered appearance and she is<br \/>\n<span class=\"hidden_text\">                   3<\/span><\/p>\n<p>physically present in the Court today, as recorded<\/p>\n<p>above. Fortunately, now both sides have entered<\/p>\n<p>into a compromise. A joint compromise petition<\/p>\n<p>has been filed today in the Court stating therein<\/p>\n<p>that they have decided to restore their matrimonial<\/p>\n<p>relationship and the petitioner is prepared to keep<\/p>\n<p>the opposite party no. 2 as his duly wedded wife.<\/p>\n<p>Fortunately, opposite party no.2 has also agreed<\/p>\n<p>to live with the petitioner as his wife.<\/p>\n<p>          In the facts and circumstances set forth<\/p>\n<p>above and in view of the fact that the parties have<\/p>\n<p>entered into a compromise, the present petition is<\/p>\n<p>disposed of with following directions:<\/p>\n<p>   (a) In the event of his arrest or surrender, the<\/p>\n<p>      petitioner shall be enlarged on provisional<\/p>\n<p>      bail for a period of six months in connection<\/p>\n<p>      with Complaint Case No. 1487 (C) of 2008<\/p>\n<p>      to the satisfaction of learned Chief Judicial<\/p>\n<p>      Magistrate,     Nalanda    at   Biharsharif   on<\/p>\n<p>      furnishing bail bond of Rs.10,000\/- (ten<\/p>\n<p>      thousand) with two sureties of like amount<\/p>\n<p>      each, subject to conditions laid down under<br \/>\n<span class=\"hidden_text\">                            4<\/span><\/p>\n<p>             section 438 (2) Cr.P.C.\n<\/p>\n<p>          (b) The petitioner shall go to the paternal<\/p>\n<p>             house of the opposite party no. 2 on 2nd April<\/p>\n<p>             2011 and they shall come back together at<\/p>\n<p>             the house of the petitioner on the same day.<\/p>\n<p>             Thereafter, they shall live together as wife<\/p>\n<p>             and husband.\n<\/p>\n<p>          (c) If during the period of provisional bail, good<\/p>\n<p>             relationship continues between petitioner<\/p>\n<p>             and opposite party no. 2, then in that case<\/p>\n<p>             learned Magistrate shall be obliged to<\/p>\n<p>             confirm the provisional bail granted to the<\/p>\n<p>             petitioner.\n<\/p>\n<p>          (d) If during the aforesaid period of provisional<\/p>\n<p>             bail, there is break down of the relationship<\/p>\n<p>             between the parties, then in that case<\/p>\n<p>             learned Magistrate shall take all possible<\/p>\n<p>             measures to get the petitioner arrested, after<\/p>\n<p>             cancelling his bail.\n<\/p>\n<\/p>\n<p>                               ( Birendra Prasad Verma, J.)<\/p>\n<p>Anjani\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Rajiv Ranjan Sinha @ Bhola vs The State Of Bihar &amp;Amp; Anr on 30 March, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
