DAVE\n\t\t\n\t\n\n \n\nDate\n: 01\/03\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>This<br \/>\n\tapplication is filed under Section 439 of the Code of Criminal<br \/>\n\tProcedure in connection with First Information Report registered as<br \/>\n\tI-C.R. No.25\/2010 with GIDC Vatva Police Station, Ahmedabad for the<br \/>\n\toffences punishable under Sections 395, 397 of Indian Penal Code and<br \/>\n\tu\/s. 135(1) of the Bombay Police Act.\n<\/p>\n<p>Heard<br \/>\n\tlearned Advocate Mr. V.D. Mewada for the applicant and learned APP<br \/>\n\tMr. AJ Desai for the respondent-State.\n<\/p>\n<p>Having<br \/>\n\theard learned Counsel for the parties and that the charge-sheet is<br \/>\n\tfiled and perusing the record of the case and taking into<br \/>\n\tconsideration the facts of the case, nature of allegations, role<br \/>\n\tattributed to the applicant, by imposing suitable conditions, I deem<br \/>\n\tit just and proper to enlarge the applicant on bail.\n<\/p>\n<p>Learned<br \/>\n\tCounsels for the parties do not press for further reasoned order.\n<\/p>\n<p>In<br \/>\n\tthe facts and circumstances of the case, the application is allowed<br \/>\n\tand the applicant is ordered to be released on bail in connection<br \/>\n\twith First Information Report registered as I-C.R. No.25\/2010 with<br \/>\n\tGIDC Vatva Police Station, Ahmedabad, on executing a bond of<br \/>\n\tRs.5,000\/- (Rupees Five Thousand Only) with one surety of the like<br \/>\n\tamount to the satisfaction of the Trial Court and subject to the<br \/>\n\tconditions that he shall;\n<\/p>\n<p>a)<br \/>\n\tnot take undue advantage of liberty or misuse liberty;\n<\/p>\n<p>b)<br \/>\n\tnot act in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>c)<br \/>\n\tsurrender passport, if any, to the lower court within a week;\n<\/p>\n<p>d)<br \/>\n\tnot leave the State of Gujarat without prior permission of the<br \/>\n\tSessions Judge concerned;\n<\/p>\n<p>e)<br \/>\n\tmark presence at the concerned Police Station on the first Sunday of<br \/>\n\tevery month between 10.00 a.m. and 3.00 p.m. for three months only;\n<\/p>\n<p>f)<br \/>\n\tfurnish the present address of his residence to the Investigating<br \/>\n\tOfficer and also to the Court at the time of execution of the bond<br \/>\n\tand shall not change the residence without prior permission of this<br \/>\n\tCourt;\n<\/p>\n<p>g)<br \/>\n\tnot enter within the City limits of Ahmedabad for six months,<br \/>\n\texcept, for the purpose of attending the trial or marking presence.\n<\/p>\n<p>The<br \/>\n\tauthorities will release the applicant only if not required in<br \/>\n\tconnection with any other offence for the time being.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbond to be executed before the lower court having jurisdiction to<br \/>\n\ttry the case.\n<\/p>\n<p>At<br \/>\n\tthe trial, the Trial Court shall not be influenced by the<br \/>\n\tobservations of preliminary nature, qua the evidence at this stage,<br \/>\n\tmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute to the aforesaid extent.
