Ms. CM Shah, Ld.\n<\/p>\n<p>APP waives service of rule on behalf of the opponents.\n<\/p>\n<p>2.\t\tThe applicant &#8211;\n<\/p>\n<p>convict, who vide judgment and order dated 13\/9\/2010 rendered by the<br \/>\nLd. Addl. Sessions Judge, Fast Track Court,  Vadodara, in Sessions<br \/>\nCase No. 133\/2008 has been convicted for the offences punishable<br \/>\nunder sections 302, etc., of the Indian Penal Code and sentenced to<br \/>\nundergo rigorous imprisonment for life, has forwarded this<br \/>\napplication through jail authority seeking temporary bail of 12 days<br \/>\nfor obtaining certificates for pursuing further his study.\n<\/p>\n<p>3.\t\tThe jail remark sheet<br \/>\nforwarded by the jail authority reveals that the applicant convict<br \/>\nhas undergone more than 3 years&#8217; imprisonment in the jail and during<br \/>\nthis period, he was once released on temporary bail and on one<br \/>\noccasion he was released on furlough leave and on one occasion  he<br \/>\nwas released on parole and at every occasion he surrendered in jail<br \/>\nwithin time. The jail remark sheet further reveals that the applicant<br \/>\nconvict was released on temporary bail for 30 days in the month of<br \/>\nApril 2011 and lastly he was released on furlough leave in the month<br \/>\nof May 2011 for 14 days.\n<\/p>\n<p>4.\t\tPerusing the application<br \/>\nforwarded by the applicant convict through jail, it transpires that<br \/>\nbefore he was confined to jail, he had studied upto M.Com. 1st<br \/>\nyear and now he desires to pursue further his study. It further<br \/>\ntranspires  that his personal presence is required to obtain<br \/>\nnecessary copies of his certificates and for the said purpose he has<br \/>\nto swear in an affidavit before Mamlatdar.  Considering the facts and<br \/>\ncircumstances of the case, so also the jail remark sheet, we deem it<br \/>\nexpedient to partly allow this application.\n<\/p>\n<p>5.\t\tThe application succeeds<br \/>\nin part and accordingly it is partly allowed. The applicant convict<br \/>\nis ordered to be released on temporary bail for the period of one<br \/>\nweek from the date of his actual release upon his furnishing personal<br \/>\nbond in the sum of Rs.5,000\/- before the jail authority. The<br \/>\napplicant convict shall not take disadvantage of his liberty and<br \/>\nshall maintain law and order.\n<\/p>\n<p>\t\tRule is made absolute<br \/>\naccordingly.\n<\/p>\n<p>[ D.H.
