Singh\n\nHon'ble Ram Autar Singh,J.\n<\/pre>\n<p>This revision has been taken up in revised list but none for the<br \/>\nrevisionists appeared.\n<\/p>\n<p>Heard the learned A.G.A. for the respondent no.1 on this revision<br \/>\nand perused the record.\n<\/p>\n<p>This revision has been filed against the judgment and order<br \/>\ndated 23.4.1998 passed by IV Additional Sessions Judge, Etah in<br \/>\nS.T. No.1070 of 1997 (State Vs. Abdul Majid), whereunder the<br \/>\napplication 15B moved under section 319 Cr.P.C. on behalf of<br \/>\nthe prosecution was allowed and Abdul Hasib and Abdul Muqid<br \/>\nwere summoned to face trial in the said case.<br \/>\nA perusal of the record goes to show that both the revisionists<br \/>\nalongwith Abdul Mujib were named in the F.I.R., who was facing<br \/>\ntrial in the said case, however, the investigating officer did not<br \/>\nsubmit the chargesheet against the revisionists. The prosecution<br \/>\nexamined Saddan Miyan as P.W.1, who was an eye witness to<br \/>\nthe occurrence and his statement supported the F.I.R. version<br \/>\nand stated that Abdul Hasib and Abdul Muqid also inflicted<br \/>\ninjuries to the victim Bashir Alam alongwith Abdul Mujib.<br \/>\nConsequently the revisionists should be tried alongwith co-<br \/>\naccused and thus the trial court summoned these revisionists in<br \/>\nexercise of powers under section 319 Cr.P.C.<br \/>\nThe order under revision is well discussed and reasoned and the<br \/>\nsame does not require any interference.\n<\/p>\n<p>Consequently, this revision lacks merit and is dismissed.
