The Branch Manager, Bank of Baroda, Kankarbagh Branch, Patna.\n                                                                ..........Opposite Parties.\n                                          -----------\n<\/pre>\n<p>2.   20.07.2011                     Heard learned counsel for the petitioner and<\/p>\n<p>                        learned counsel appearing for the State.<\/p>\n<p>                                    The     petitioners       apprehend        arrest         in<\/p>\n<p>                        connection with a case registered for the offence under<\/p>\n<p>                        sections 406 and 420 of the Indian Penal Code.<\/p>\n<p>                                    The     prosecution      has     alleged     that    the<\/p>\n<p>                        petitioners took loan of Rs. 5,00,000\/- from the Bank of<\/p>\n<p>                        Baroda but the documents submitted by them for<\/p>\n<p>                        mortgage were subsequently found to be fake.<\/p>\n<p>                                    Learned counsel for the petitioners submits<\/p>\n<p>                        that the Bank after proper verification of the document<\/p>\n<p>                        as well as inspection of the spot sanctioned the loan to<\/p>\n<p>                        the petitioner No. 2. Petitioner No. 1 is guarantor of the<\/p>\n<p>                        said loan.\n<\/p>\n<p>                                    Learned counsel for the petitioners further<\/p>\n<p>                        submits that out of Rs. 5,00,000\/- the petitioner has<\/p>\n<p>                        already repaid Rs. 1,50,000\/-.\n<\/p>\n<p>                                    It is further submitted that the petitioners are<\/p>\n<p>                        ready to make payment of remaining principal amount<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>of the loan within a period of four months.<\/p>\n<p>              Taking    into   consideration   the   aforesaid<\/p>\n<p>submissions, let the petitioners, namely Sushila Devi<\/p>\n<p>and Girish Prasad in the event of their arrest or<\/p>\n<p>surrender before the Court below within a period of four<\/p>\n<p>weeks from the date of communication of this order, be<\/p>\n<p>enlarged on provisional anticipatory bail for a period of<\/p>\n<p>four months, on furnishing bail bonds of Rs. 5,000\/-<\/p>\n<p>(Five thousand) with two sureties of the like amount<\/p>\n<p>each to the satisfaction of Chief Judicial Magistrate,<\/p>\n<p>Patna in connection with Patrakar Nagar P.S. Case No.<\/p>\n<p>2 of 2011.\n<\/p>\n<p>             In the meantime, the petitioner would make<\/p>\n<p>payment of the entire principal amount of loan to the<\/p>\n<p>concerned bank and file a receipt in token of such<\/p>\n<p>payment before the concerned court in that regard. In<\/p>\n<p>case the petitioner is able to satisfy the court that they<\/p>\n<p>have repaid the entire remaining principal amount in<\/p>\n<p>question, the provisional bail, so granted to the<\/p>\n<p>petitioners, shall be confirmed.\n<\/p>\n<p>             It is made clear that in case within the time<\/p>\n<p>aforesaid, the petitioners fail to comply with the<\/p>\n<p>undertaking given to the court with regard to the<\/p>\n<p>payment the provisional bail so granted shall stands<\/p>\n<p>cancelled and the petitioners may pray thereafter for<br \/>\n<span class=\"hidden_text\">                             3<\/span><\/p>\n<p>           regular bail, which shall be considered in accordance<\/p>\n<p>           with law on its own merit.\n<\/p>\n<\/p>\n<pre>Sanjeet\/                                (Ashwani Kumar Singh, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Sushila Devi &amp; Anr. vs The State Of Bihar &amp; Anr. on 20 July, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
