NO. 11593 OF 2010 Y\n             ------------------------------------------------------\n             Dated this the 7th day of October, 2010\n\n\n                                JUDGMENT\n<\/pre>\n<p>      The petitioner, who is working as Unskilled Clerical Assistant<\/p>\n<p>in the University of Kerala, was placed under suspension pending<\/p>\n<p>further action, as per Ext.P15 order dated 17.3.2010. The main relief<\/p>\n<p>prayed for in the Writ Petition is to quash Ext.P15 order.<\/p>\n<p>      2.    When the Writ Petition came up for consideration on<\/p>\n<p>18.8.2010, a learned single Judge of this Court passed the following<\/p>\n<p>order:\n<\/p>\n<blockquote><p>             &#8220;When this matter came up for admission on<\/p>\n<p>      5.4.2010 and thereafter on 27.5.2010 this court directed<\/p>\n<p>      the learned standing counsel for the University to make<\/p>\n<p>      available the records pertaining to this case. When this<\/p>\n<p>      matter was taken up today, the learned standing counsel<\/p>\n<p>      appearing for the University made available the entire<\/p>\n<p>      records. Having gone through the records I am of the<\/p>\n<p>      view that this is a fit case wherein this Court should<\/p>\n<p>      admit the writ petition.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>             Admit. Issue notice.\n<\/p><\/blockquote>\n<p>W.P.(C) NO.11593 OF 2010<\/p>\n<p>                                     :: 2 ::\n<\/p>\n<p>              After going through the complaint made by the<\/p>\n<p>       fourth respondent, I am of the view that the proceedings<\/p>\n<p>       initiated against the petitioner based on the said<\/p>\n<p>       complaint is liable to be stayed. This will not stand in the<\/p>\n<p>       way of the official respondents to take action against the<\/p>\n<p>       petitioner in case the alleged action on the part of the<\/p>\n<p>       petitioner amounts to any misconduct.          In the said<\/p>\n<p>       circumstances, it will be open to the petitioner to submit<\/p>\n<p>       a representation to the second respondent to revoke the<\/p>\n<p>       order of suspension within two weeks from today. In<\/p>\n<p>       case such a representation is received from the<\/p>\n<p>       petitioner, the second respondent shall look into the<\/p>\n<p>       same and pass appropriate orders thereon.&#8221;<\/p>\n<p>       3. The learned counsel appearing for the fourth respondent<\/p>\n<p>submitted that subsequently, as per the order dated 14.9.2010, the<\/p>\n<p>petitioner was directed to be reinstated pending finalisation of the<\/p>\n<p>disciplinary proceedings. A copy of the order was made available to<\/p>\n<p>me by the counsel for the fourth respondent and it is taken on record.<\/p>\n<p>The order dated 14.9.2010 reads as follows:<\/p>\n<blockquote><p>              &#8220;Shri K.Sasikumar, Unskilled Clerical Assistant<\/p>\n<p>       was placed under suspension vide the U.O. read as<\/p>\n<p>       paper 1, on the basis of a report of enquiry submitted by<\/p>\n<p>W.P.(C) NO.11593 OF 2010<\/p>\n<p>                                   :: 3 ::\n<\/p><\/blockquote>\n<blockquote><p>      the Sexual harasment Enquiry Committee. The Hon&#8217;ble<\/p>\n<p>      High Court in its Interim Order read as paper 2, in W.P.<\/p>\n<p>      (C) No.11593 of 2010 filed by Shri K.Sasikumar,<\/p>\n<p>      observed that the proceedings initiated against him<\/p>\n<p>      based on the complaint is liable to be stayed and this<\/p>\n<p>      will not stand in the way of the University to take action<\/p>\n<p>      against him in case the alleged action on the part of the<\/p>\n<p>      petitioner amounts to any misconduct.        The Hon&#8217;ble<\/p>\n<p>      High Court also observed that it will be open to the<\/p>\n<p>      petitioner to submit a representation to the Vice-<\/p>\n<p>      Chancellor to revoke the order of suspension within two<\/p>\n<p>      weeks from the date of the Order and the Vice-<\/p>\n<p>      Chancellor shall look into the same and pass<\/p>\n<p>      appropriate orders thereon.     Shri K.Sasikumar in his<\/p>\n<p>      representation read as paper 3 requested to revoke his<\/p>\n<p>      suspension at the earliest.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>             After having considered the representation read<\/p>\n<p>      as paper 3 and in compliance of the directions of the<\/p>\n<p>      Hon&#8217;ble High Court, the Vice-Chancellor has ordered to<\/p>\n<p>      reinstate Shri K.Sasikumar, Unskilled Clerical Assistant<\/p>\n<p>      into service with immediate effect pending finalisation of<\/p>\n<p>      the disciplinary proceedings.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>             Shri K.Sasikumar, Unskilled Clerical Assistant is<\/p>\n<p>      posted in the Institute of Management in Kerala,<\/p>\n<p>      Thiruvananthapuram.&#8221;\n<\/p><\/blockquote>\n<p>W.P.(C) NO.11593 OF 2010<\/p>\n<p>                                    :: 4 ::\n<\/p>\n<p>      In the light of the order dated 14.9.2010 and also in the light of<\/p>\n<p>the interim order passed by this Court on 18.8.2010, I do not think<\/p>\n<p>anything survives in this Writ Petition.        The Writ Petition is<\/p>\n<p>accordingly closed.
