SIRI JAGAN, J.\n               - - - - - - - - - - - - - - - - - - - - - - -\n                   W.P.(C)No. 1113 of 2011\n               - - - - - - - - - - - - - - - - - - - - - - -\n          Dated this the 20th day of January, 2011\n\n                         J U D G M E N T\n<\/pre>\n<p>     The petitioners are physically handicapped persons<\/p>\n<p>who were appointed as Villagemen on provisional basis for<\/p>\n<p>179 days.    They apprehend termination from service on<\/p>\n<p>completion of 179 days. They are aggrieved by the same.<\/p>\n<p>According to them, as per Section 23 of the Persons with<\/p>\n<p>Disabilities (Equal Opportunities, Protection of Rights and<\/p>\n<p>Full Participation) Act, 1995, 3% of Class III and IV posts<\/p>\n<p>are to be reserved for physically handicapped candidates.<\/p>\n<p>But the Government has identified posts for such<\/p>\n<p>reservation only from 2004 onwards and the 3% are<\/p>\n<p>calculated for backlog appointments only from 2004<\/p>\n<p>onwards which according to the petitioners are against the<\/p>\n<p>provisions of Section 23 of the said Act. They would contend<\/p>\n<p>that the Government was bound to identify these posts with<\/p>\n<p>effect from 1995 and not with effect from 2004 and<\/p>\n<p>W.P.(C)No. 1113 of 2011<br \/>\n<span class=\"hidden_text\">                              -2-<\/span><\/p>\n<p>therefore the backlog vacancies should be calculated with<\/p>\n<p>effect from 1995. They would also seek a direction to the<\/p>\n<p>respondents to regularise the services of the petitioners in<\/p>\n<p>those backlog vacancies.\n<\/p>\n<p>      2.    I have heard the learned Government Pleader<\/p>\n<p>also.\n<\/p>\n<p>      3.    The petitioners have not been able to satisfy me<\/p>\n<p>that they have a right to be regularised in service. In the<\/p>\n<p>matter of regularisation, the physically handicapped<\/p>\n<p>persons cannot be treated differently from other persons.<\/p>\n<p>In the matter of appointment of physically handicapped<\/p>\n<p>persons also Articles 14 &amp; 16 of the Constitution of India<\/p>\n<p>are squarely applicable. Apart from the petitioners there<\/p>\n<p>are other physically handicapped persons who are eligible<\/p>\n<p>to be considered in the 3% reservation quota applicable to<\/p>\n<p>physically handicapped persons.      If the petitioners are<\/p>\n<p>regularised in the posts in which they have been appointed<\/p>\n<p>temporarily, that would affect the fundamental right of<\/p>\n<p>other physically handicapped persons who are also eligible<\/p>\n<p>W.P.(C)No. 1113 of 2011<br \/>\n<span class=\"hidden_text\">                               -3-<\/span><\/p>\n<p>to be considered for appointment to those posts under<\/p>\n<p>Articles 14 &amp; 16 of the Constitution of India. As of now the<\/p>\n<p>petitioners are only provisional hands and they have no<\/p>\n<p>right to continue in service beyond the period for which<\/p>\n<p>they have been engaged, which is the settled law on the<\/p>\n<p>subject.\n<\/p>\n<p>      4.    Apart from that the Government has already<\/p>\n<p>declared its policy on the question of regularisation of<\/p>\n<p>physically handicapped persons. Government orders issued<\/p>\n<p>in this regard specifically stipulated that only persons<\/p>\n<p>appointed in the temporary vacancies up to a specific date<\/p>\n<p>are entitled to the benefit of regularisation. The petitioners<\/p>\n<p>have admittedly been engaged provisionally subsequent to<\/p>\n<p>that date fixed by the Government. As such going by the<\/p>\n<p>policy of the Government also the petitioners are not<\/p>\n<p>entitled to regularisation in service.<\/p>\n<p>      5.    As regards the question as to whether the backlog<\/p>\n<p>vacancies for physically handicapped persons in the 3%<\/p>\n<p>quota have to be calculated from 1995 or 2004 is not<\/p>\n<p>W.P.(C)No. 1113 of 2011<br \/>\n<span class=\"hidden_text\">                              -4-<\/span><\/p>\n<p>necessary to be considered in this writ petition insofar as<\/p>\n<p>the petitioners are not entitled to regularisation as claimed<\/p>\n<p>by them.        Therefore that question is left open to be<\/p>\n<p>considered in an appropriate case, where the vacancies<\/p>\n<p>have to be computed for advice by the Kerala Public Service<\/p>\n<p>Commission.
