4.   22.09.2011.              Counsel for the Magadh University has filed<\/p>\n
                     counter affidavit, which is taken on record.<\/p>\n
                              2. Heard learned counsel for the petitioner,<\/p>\n
                     State and the Magadh University.\n<\/p>\n
                              3. This writ petition has been filed for a<\/p>\n
                     direction to the authorities of the Magadh University<\/p>\n
                     to grant the petitioner B.Ed. degree pursuant to the<\/p>\n
                     mark-sheet dated 17th June, 1995 issued to the<\/p>\n
                     petitioner after she became successful in the 1987<\/p>\n
                     Annual B.Ed. Examination, held in the month of<\/p>\n
                     September, 1994. Prior to the appearance of the
\n                  2<\/span><\/p>\n
petitioner in the said examination, petitioner was<\/p>\n
admitted in the Rammohun Roy College of Education,<\/p>\n
Khazanchi Road, Patna after verification of her B.A.<\/p>\n
mark-sheet, College Leaving Certificate and other<\/p>\n
certificates pursuant to notice dated 03.09.1987,<\/p>\n
Annexure-2\/1. After the admission of the petitioner<\/p>\n
in the College, she was registered with Magadh<\/p>\n
University, Bodh Gaya to pursue B.Ed. Course 1987-<\/p>\n
88 Session in Rammohan Roy College of Education.<\/p>\n
The registration-receipt even indicates her Roll No. in<\/p>\n
the College. From the said receipt it also appears that<\/p>\n
her Registration Number is 65415 of the year 1987.<\/p>\n
In the light of her admission for pursuing B.Ed.<\/p>\n
course in the Rammohun Roy College of Education<\/p>\n
and her registration with the Magadh University she<\/p>\n
pursued her B.Ed. studies in the session 1987-88.<\/p>\n
Having completed the course she was allowed<\/p>\n
Admission Card indicating the registration number,<\/p>\n
Annexure-4 on the basis of which she appeared in<\/p>\n
the 1987 B.Ed. examination conducted by the<\/p>\n
Magadh University in September, 1994. After she<\/p>\n
became successful in the said examination, mark-<\/p>\n
sheet dated 17th June, 1995, Annexure-5 was also<\/p>\n
issued to the petitioner indicating her registration<\/p>\n
number of the University. In the light of the aforesaid
\n                    3<\/span><\/p>\n
documents when the request of the petitioner to<\/p>\n
provide her with the B.Ed. degree was not considered<\/p>\n
and granted by the authorities of the University, she<\/p>\n
filed the present writ petition.\n<\/p>\n
         4. By filing counter affidavit the authorities<\/p>\n
of the University have opposed the prayer made in<\/p>\n
the writ petition on the ground that the College<\/p>\n
Admission Register of Rammohun Roy College of<\/p>\n
Education was called and from the Admission<\/p>\n
Register it did not appear that petitioner was ever<\/p>\n
admitted in the College to pursue B.Ed Course in<\/p>\n
1987-88 Session.\n<\/p>\n
         5. While filing the aforesaid counter affidavit<\/p>\n
the authorities of the University have not whispered<\/p>\n
even a word about the genuineness of the Post Card,<\/p>\n
Annexure-2\/1 asking the petitioner to appear for<\/p>\n
verification of College Leaving Certificate, B.A. mark-<\/p>\n
sheet etc. for admission into B.Ed. Course, Session<\/p>\n
1987-88, Registration Receipt, Admission Card and<\/p>\n
the mark-sheet dated 17th June, 1995, Annexures-<\/p>\n
2\/1,   3,4,5.   They   have   also   not   disputed   the<\/p>\n
genuineness of the College Leaving Certificate dated<\/p>\n
30.6.1995, Annexure-6 issued by the authorities of<\/p>\n
the Rammohun Roy College of Education to the<\/p>\n
petitioner.\n<\/p>\n
                                 4<\/span><\/p>\n
                   6.   There       being        no    dispute     about   the<\/p>\n
         admission of the petitioner in the Rammohun Roy<\/p>\n
         College of Education in the B.Ed. Course Session<\/p>\n
         1987-88 and that she was registered for the said<\/p>\n
         course with the Magadh University and that she<\/p>\n
         appeared in the examination pursuant to Admission<\/p>\n
         Card, Annexure-4 and mark-sheet was given to her<\/p>\n
         dated 17th June, 1995, Annexure-5 and the College<\/p>\n
         Leaving Certificate dated 30.6.1995, Annexure-6, I<\/p>\n
         have     no    option      but     to    direct     the   University<\/p>\n
         authorities to issue B.Ed. degree to the petitioner in<\/p>\n
         the light of her mark-sheet dated 17th June, 1995,<\/p>\n
         Annexure-5, as early as possible, in any case within a<\/p>\n
         period    of     two       months            from   the    date    of<\/p>\n
         receipt\/production of a copy of this order before the<\/p>\n
         Registrar of the University.\n<\/p>\n
                   7. The writ petition is, accordingly, allowed.<\/p>\n
