PATTANAIK, S.P.\tKURDUKAR.\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>J U D G M E N T<br \/>\nC.B.Pattanaik, J.\n<\/p>\n<p>The  appellant\thas been convicted under Section 302<br \/>\nI.P.C.\tand sentenced to imprisonment for life\tand  a\tfine<br \/>\nRs.200\/-,  in  default,\t to further undergo imprisonment for<br \/>\nfour months by the learned Additional Session Judge,  Sirohi<br \/>\nand  the said conviction and sentence has been upheld by the<br \/>\nDivision  Bench\t of  Rajasthan\tHigh  Court  at\t Jodhpur  in<br \/>\nCriminal Appeal No.    141  of\t1979.  It was alleged by the<br \/>\nprosecution that on 16.10.78 during the\t morning  hours\t the<br \/>\ncattle of the deceased entered into the field of the accused<br \/>\nDeva and  damaged  the\tcrop.  Accused, therefore, put those<br \/>\ncattle in the cattle pond.  Deceased however agreed to\tgive<br \/>\nsix  Maund  of maize as compensation, after which the cattle<br \/>\nwere released.\tThe further case of prosecution is that Deva<br \/>\nhad gone out and on his return in  the\tevening,  there\t was<br \/>\nsome altercation  between  him\tand  the  deceased.    PW 14<br \/>\nhowever intervened and got them separated.   In\t the  night,<br \/>\nwhile  accused was sitting at a hotel belonging to PW 7, the<br \/>\ndeceased came out of his house and seeing him coming out the<br \/>\naccused left the hotel and inflicted injuries upon him by  a<br \/>\ndagger (Chhuri)\t on  the  stomach  of  the  deceased.\t The<br \/>\ndeceased then went to his house and informed  his  wife\t PW6<br \/>\nthat  the accused has inflicted the injuries to him by means<br \/>\nof a knife.  On this score,  there  was\t an  uproar  in\t the<br \/>\nvillage\t and  several  villagers  went\tto  the house of the<br \/>\ndeceased and found injured Samti.  Natha PW2, then  went  to<br \/>\nthe Police  Station  and  lodged  a report.  On the basis of<br \/>\nthat report, Exhibit P3, when was  treated  as\tF.I.R.,\t the<br \/>\nPolice\tstarted\t investigation\tand ultimately submitted the<br \/>\ncharge sheet.  On being committed, the accused was tried  by<br \/>\nthe learned Additional Session Judge.\n<\/p>\n<p>The prosecution examined 14 witnesses, including the<br \/>\nDoctor PW 1 who had conducted the autopsy over the dead body<br \/>\nof the deceased and the three eye witnesses PWs 4, 5 and  7.<br \/>\nThe  doctor  PW\t 1 found as many as seven incised wounds and<br \/>\nthe cause of the death according to him was shock due to the<br \/>\ninjuries,  more\t particularly  injury  No.2  which  led\t  to<br \/>\ninternal haemorrhage.\tOn the basis of the medical evidence<br \/>\nas well as the oral testimony of PWs 2\tto  7,\tthe  learned<br \/>\nAdditional Sessions Judge came to hold that the death of the<br \/>\ndeceased was  homicidal\t in nature.  The said conclusion was<br \/>\nnot assailed in appeal nor  has\t been  assailed\t before\t us.<br \/>\nFrom  the  medical  evidence  it  is  established  that\t the<br \/>\ninjuries of the\t deceased  were\t caused\t by  a\tsharp  edged<br \/>\nweapon.\t The three eye witnesses viz.  PWs 4, 5 and 7 though<br \/>\nstated that there was a struggle between the accused and the<br \/>\ndeceased did not state that the accused had a knife with him<br \/>\nwith which   he\t  assaulted   the  deceased.\tThe  learned<br \/>\nAdditional Sessions Judge however  came\t to  the  conclusion<br \/>\nthat as the occurrence took place at a place where there was<br \/>\nnot  much  of  light and underneath a tree the eye witnesses<br \/>\nmight not have been able to see the knife which the  accused<br \/>\nwas having.    Relying\tupon  the recovery of a knife at the<br \/>\ninstance of the accused, while in custody and the  statement<br \/>\nof  PW\t6,  the\t wife of the deceased that deceased told her<br \/>\nthat Deva had inflicted the knife blow to him,\tthe  learned<br \/>\nAdditional  Sessions Judge came to the conclusion that it is<br \/>\nthe  accused  who  has\tinflicted  the\tknife  blow  at\t the<br \/>\ndeceased.   On\tthe aforesaid finding the learned Additional<br \/>\nSessions Judge having convicted the appellant under  Section<br \/>\n302, the  appeal  was  carried\tto the High Court.  The High<br \/>\nCourt confirmed the conviction and sentence  passed  by\t the<br \/>\nlearned Additional Sessions Judge relying upon the testimony<br \/>\nof  PWs 4, 5 and 7 who were supposed to be the eye witnesses<br \/>\nto the occurrence and the evidence of PW 6 who\tstated\tthat<br \/>\nher  husband  Samti  told  her\tthat  the  accused  Deva had<br \/>\ninflicted knife blows on him.  The conviction  and  sentence<br \/>\npassed\tby  the\t High  Court  against the appellant is being<br \/>\nassailed in this appeal.\n<\/p>\n<p>The  learned  counsel  for  the\t appellant contended<br \/>\nbefore us that none of the eye witnesses having stated\tthat<br \/>\naccused inflicted injury to the deceased by means of a knife<br \/>\nand  on the other hand they having categorically stated that<br \/>\nwhen the accused and the deceased grappled and both of\tthem<br \/>\nfell  down on the ground, it was the deceased who was having<br \/>\na stick in his hand, both the  learned\tAdditional  Sessions<br \/>\nJudge  as  well as the High Court in appeal erroneously came<br \/>\nto the conclusion that the injuries  on\t the  deceased\twere<br \/>\ncaused by the accused.\tIt may be stated here that PWs 5 and<br \/>\n7  were\t declared  hostile  and\t were  cross examined by the<br \/>\nPublic Prosecutor as they did not  support  the\t prosecution<br \/>\ncase.\tWe  have  scrutinised  the  evidence  of these three<br \/>\nwitnesses and fail to appreciate that  on  the\tevidence  of<br \/>\nthese  witnesses how the courts below came to the conclusion<br \/>\nthat the  injuries  on\tthe  deceased  were  caused  by\t the<br \/>\naccused-appellant.   PW 6, the wife of the deceased no doubt<br \/>\nin her evidence stated that her husband told her  that\tDeva<br \/>\nhad  inflicted\tknife injury but in the cross examination it<br \/>\nwas elicited that her husband never told that  there  was  a<br \/>\ngrappling between him and Deva.\t All the three eye witnesses<br \/>\nhaving\tcategorically  stated that the accused-appellant had<br \/>\nnot given any knife blow on the deceased and  on  the  other<br \/>\nhand,  having  stated that the accused and the deceased were<br \/>\ngrappling with\teach  other  when  the\tdeceased  alone\t was<br \/>\nholding\t stick\tin  his\t hand, it is difficult to accept the<br \/>\nstatement of the wife PW 6 that the deceased hand  told\t her<br \/>\nthat Deva  had\tinflicted  knife injury on him.\t That apart,<br \/>\nthe nature of the injuries are such that  on  getting  those<br \/>\ninjuries,  blood  must\thave  oozed and in that case the eye<br \/>\nwitnesses could have easily noticed the\t same  but  in\tfact<br \/>\nnone  of  them\thave  noticed  any  such blood injury on the<br \/>\ndeceased.  In this  state  of  affairs\tmerely\tbecause\t the<br \/>\naccused\t is  alleged to have given recovery of a knife while<br \/>\nin custody, it is difficult to\thold  that  prosecution\t has<br \/>\nbeen  able  to establish charges beyond reasonable doubt and<br \/>\nit is the accused who is the perpetrator of the crime.\t  In<br \/>\nour  considered\t opinion,  the\tconclusion  of\tthe  learned<br \/>\nAdditional Sessions Judge as well as the of the\t High  Court<br \/>\nin  the\t impugned judgment that accused-appellant caused the<br \/>\ninjury on  the\tdeceased  is  wholly  unsustainable.\t We,<br \/>\ntherefore,  set\t aside\tthe  conviction\t and sentence passed<br \/>\nagainst the appellant and acquit him of the charges levelled<br \/>\nagainst him.  The appellant  be\t set  at  liberty  forthwith<br \/>\nunless he  is  required\t in  any  other case.
