In pursuance of the said impugned order, the<br \/>\npetitioner is detained in Rajpipla Sub-Jail, who has been later on<br \/>\nshifted to Sub-Jail, Palanpur.\n<\/p>\n<p>3.\tFrom<br \/>\nthe grounds of detention, it appears that four offences being<br \/>\nProhibition CR Nos.5178 of 2007, 5117 of 2007, 5319 of 2007 and 5034<br \/>\nof 2007 have been registered against the detenu. Except the first<br \/>\noffence registered at Sardarnagar Police Station, the rest of the<br \/>\noffences are registered at Meghaninagar Police Station, under the<br \/>\nprovisions of Sections 66B, 65E and  81  under the Bombay Prohibition<br \/>\nAct, wherein a quantity of total 111  ltrs. of country made liquor<br \/>\nwere found from the possession of the detenue. On the basis of<br \/>\nregistration of these cases, the detaining authority held that the<br \/>\npresent detenue was carrying on activities of selling country made<br \/>\nliquor which is harmful to the health of the public. It is held by<br \/>\nthe detaining authority that as the detenue is indulged in illegal<br \/>\nactivities, it is required to restrain the detenu from carrying out<br \/>\nfurther illegal activities, i.e. selling of liquor. The detaining<br \/>\nauthority has placed reliance on the above registered offences and<br \/>\nstatements of unnamed witnesses.  In the opinion of this Court, the<br \/>\nactivities of the detenue can, by no stretch of imagination, be said<br \/>\nto be disturbing the ?Spublic order.?? It is seen from the grounds<br \/>\nthat a general statement that has been made by the detaining<br \/>\nauthority that consuming liquor is injurious to health.  In fact, a<br \/>\nperusal of the order passed by the detaining authority shows that the<br \/>\ngrounds which  are mentioned in the order are in reference to the<br \/>\nsituation of ?Slaw and order?? and not ?Spublic order??.<br \/>\nTherefore, on this ground, the subjective satisfaction arrived at by<br \/>\nthe detaining authority is vitiated on account of non-application of<br \/>\nmind and the impugned order, therefore, deserves to be quashed and<br \/>\nset aside.\n<\/p>\n<p>4.\tExcept<br \/>\nthe statements of some anonymous witnesses, there is no material on<br \/>\nrecord which shows that the petitioner-detenue is carrying on<br \/>\nactivities of selling country made liquor which is harmful to the<br \/>\nhealth of the public. In the case of Ashokbhai Jivraj @ <a href=\"\/doc\/687998\/\">Jivabhai<br \/>\nSolanki v. Police Commissioner, Surat<\/a> [(2001)(1)GLH 393)], having<br \/>\nconsidered the decision of the Hon&#8217;ble Apex Court in the case of Ram<br \/>\nManohar Lohia v. State of Bihar (AIR 1966 SC 740), this Court<br \/>\nheld that the cases wherein the detention order passed on the basis<br \/>\nof the statements of the witnesses falls under the maintenance of<br \/>\n?Slaw and order?? and not ?Spublic order??.\n<\/p>\n<p>5.\tApplying<br \/>\nthe ratio of the above decisions, it is clear that before passing an<br \/>\norder of detention  of a detenue, the detaining authority must come<br \/>\nto a definite finding that there is threat to the ?Spublic  order??<br \/>\nand it is very clear that the present would not fall within the<br \/>\ncategory of threat to ?Spublic order??. In that view of the matter,<br \/>\nwhen the order of detention has been passed by the detaining<br \/>\nauthority without having adequate grounds for passing the said order,<br \/>\ncannot be sustained and, therefore, it deserves to be quashed and set<br \/>\naside.\n<\/p>\n<p>6.\tIn<br \/>\nthe result, this Special Civil<br \/>\nApplication is allowed. The impugned order of detention dated<br \/>\n13.2.2008 passed by the detaining authority is hereby quashed and set<br \/>\naside. The detenue is ordered to be set at liberty forthwith, if not<br \/>\nrequired in any other case. Rule is made absolute accordingly.
