He, therefore, submitted that as now<br \/>\n\tthe charge sheet has been filed and other co-accused has been<br \/>\n\treleased on bail, present application may be allowed.\n<\/p>\n<p>\tLearned<br \/>\n\tA.P.P., Mr.Mengdey resisted the application. He referred to the<br \/>\n\tDying Declaration and submitted that there is prima facie case.\n<\/p>\n<p>\tHaving<br \/>\n\theard learned advocate Mr.Harshit Tolia for the applicant and<br \/>\n\tMr.Mengdey, learned APP and having considered the nature of offence,<br \/>\n\trole attributed and considering the Dying Declaration and the fact<br \/>\n\tthat now as charge sheet has been filed and other co-accused has<br \/>\n\tbeen released on bail, present application deserves to be allowed.\n<\/p>\n<p>\tAccordingly,<br \/>\n\tpresent application stands allowed. The applicant is ordered to be<br \/>\n\treleased on regular bail in connection with II-C.R.No.58\/2010<br \/>\n\tregistered at Rajkot Mahila Police Station on his executing a bond<br \/>\n\tof Rs.5,000\/- (Rupees Five Thousand Only) with one solvent surety of<br \/>\n\tthe like amount to the satisfaction of the lower Court and subject<br \/>\n\tto the conditions that he shall:\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot<br \/>\nto try to tamper or pressurize the prosecution witnesses or<br \/>\ncomplainant in any manner.\n<\/p>\n<p>(c)\tnot<br \/>\nact in any manner injurious to the interest of the prosecution.\n<\/p>\n<p>(d)\tmaintain<br \/>\nlaw and order and should cooperate the investigating officers.\n<\/p>\n<p>(e)\tmark<br \/>\nhis presence on every 1st Monday of every month of English<br \/>\ncalender month before concerned Police Station between 11:00 AM to<br \/>\n2:00 PM.\n<\/p>\n<p>(f)\tfurnish<br \/>\nthe address of his residence to the Investigating Officer and also to<br \/>\nthe Court at the time of execution of the bond and shall not change<br \/>\nhis residence without prior permission of the Court.\n<\/p>\n<p>(g)\tsurrender<br \/>\nhis passport, if any, to the lower Court, within a week.\n<\/p>\n<p>\tIf<br \/>\n\tbreach of any of the above conditions is committed, the concerned<br \/>\n\tSessions Judge will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>\tBail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.\n<\/p>\n<p>\tRule<br \/>\n\tis made absolute to the aforesaid extent.
