  on thewpremise that the petitioner herein is a<\/p>\n

inupaymenft of rents. She also urged that the premises was<\/p>\n
 glet oiutito the respondent on the monthly rent of Rs.300\/–,<\/p>\n

4. The petitioner has resisted the proceedings firstiy,<\/p>\n

\ndenying the jural reiationship of iandiord and tenant, and<\/p>\n
secondly, disputing the iocus of the respondent to  his<\/p>\n
eviction. In this regard, the petitioner averr’ed4′..’,t~1ii’_;f:1iiI’ _.the<\/p>\n
premises in question was owned by <\/p>\n
he was a tenant. During his iife ‘t_ime_ha;d’exiecutedVtthe\ufb02yviiii<\/p>\n
i.e., Ex.R.5 bequeathing the.4__prop’e_rty in  <\/p>\n
daughter Smt B.N.Shantha ar”id’\u00ab_”:auth’o\u00a7riaing the
\nrespondent herein  irhus, Smt
\nB.N.Shantha Kumari  the premises
\nbeing iegapteeiiihuindper\u00e9 itfie  the respondent
\n  to collect or even seek<\/p>\n
eviction. _A it ”\n<\/p>\n
5.2T-h%e,.ieatfned” Court considered the materiai<\/p>\n
prio5pos_iAtioVns in”-teheypvieadings and the evidence led by the<\/p>\n
‘ V:partie~s,V’~viz,,\u00a7,”the respondent\/landiord had produced twelve<\/p>\n
“documents Vwvhich includes notice and reply notice sent to<\/p>\n
the ..p”etitioner. Apart from the above documents, the<\/p>\n
it ipet.itioner~tenant had produced repiy notice in which there<\/p>\n
dis’ a ciear averment that after the demise of Nagaraj,<\/p>\n
petitioner herein accepted the respondent as iandiord and<\/p>\n

7. Section 43 of the Act is a provision which deals with
\njurai relationship of landlord and tenant. The saidvprovricsion<\/p>\n
reads thus:\n<\/p>\n

evidence of rel’atio_nshfi-p_ andzproceed to hear the<\/p>\n

 cThus”,v.i_t*is ciear that if there a document like a lease deed or<\/p>\n
 receipt, that has to be taken into consideration as<\/p>\n
 ____5prima facie evidence establishing the relationship of landlord<\/p>\n
air<\/p>\n

\nand tenant. The very fact that in subsection (1) of Section<\/p>\n
43 there is no reference to any title or the molderpand<\/p>\n
manner of acquisition of title, a lease or rer’i’t”\u00ab’re.\u00e9l\u00e9\\\\’pt”is<\/p>\n
enough to determine relationship. The..pr_esent.::’c’ase’is”~__<\/p>\n
much worse. The petitioner\u00e9tienant <\/p>\n
tenancy and he had not denied hvaying paid-3 <\/p>\n
respondent-landlord. On thleilovther  is clear

\npaying rents to the   demise of the
\noriginal lan_d?l’o4rd1=stu’_,!’-lazgyarajllg  demanded by the
\nres\ufb02onderitiw ‘.:en’h’an’ced. Hence, there is
\nestogpel  _Besides, it must be noticed that
\nhe is tr’y.in”gto’  Shanthakumari in terms of the<\/p>\n
willwiide  Eyenvhin Ex.R5, the testator has, in his<\/p>\n
  authorisvedllhis wife–respondent herein to collect<\/p>\n
I o.t’fth’elVSch~’edule premises while ultimately bequeathing<\/p>\n
hi-3, es_tate\u00a7?*to his daughter, Shanthakumari. Hence, the<\/p>\n
 ., authorisation to receive rent is conferred through Ex.R5.<\/p>\n
8. The next question is, whether a rent collector could<\/p>\n
maintain eviction proceedings with limited right, as<\/p>\n
\u00a7Q1\u00bb<\/p>\n
7<\/span><\/p>\n
contended by the learned counsel. The answer lies in the
\ndefinition of the word ‘landlord’ as incorporated iVn’i’,:S:eiction
\n3(e) of the Act which reads thus:\n<\/p>\n
‘ “landlord” means a person who..f0’f”‘~tl1’eA_f.:” <\/p>\n

above.\n<\/p>\n
. E9; ‘fhe_ nextvualuestion is, whether the landlord can seek<\/p>\n
 .VVevictio:n\u00ab~..oi’iftheitenant under the provisions invoked by her.<\/p>\n
 mu’st.h~oltice that in the repealed provision of the Act of<\/p>\n
 x1;96.’t,’v..–for seeking eviction under Section 21 (1)(h), there<\/p>\n
i’  a rider attached. While a bill collector\/landlord could<\/p>\n
ylseek eviction of the tenant on any other ground, it is only<\/p>\n
at\ufb01v<\/p>\n

\nthe land|ord~<:um–owner who was entitled to seek eviction<\/p>\n
under Section 21 (1)(h). But that enactment vhasrsbeen<\/p>\n
repeaEed by the Act of 1999 which contains no"'sL:ich'__:ri'd_ers<\/p>\n
or fetters to the right exercisabie by the Ea_nd.lV_ojrd_  <:.iefiin'edV  <\/p>\n
under Section 3 (e) of the Act.\n<\/p>\n
10. For the reasons diiscigssed a’boye,__I: doVV’:n’ot~find any’<\/p>\n
infirmitvi legal or otherwise,i-i~nV:..t_h.e”0rder “of-theiitrial court
\nin rejecting of the appiic’a_ti’o’ne..f\u00a7’i\u00bbe:dtenant. However,
\non merit, tenant’  to contest the
\nproceedings    revision petition is
