Justice J.M.JAMES\n\n Dated :05\/07\/2006\n\n O R D E R\n                        J.M.JAMES, J.\n                          --------------\n                      CRL.A.203\/1999\n                        ------------------\n      DATED THIS THE 5TH DAY OF JULY, 2006\n\n\n                        JUDGMENT\n<\/pre>\n<p>           The   complainant,     in   C.C.No.   46\/1996,   on  the<\/p>\n<p>file of the Judicial Magistrate of First Class-II, Kochi, is the<\/p>\n<p>appellant.  He preferred a complaint, under Section 138 of<\/p>\n<p>the Negotiable Instruments Act, in short &#8216;the Act&#8217;,  against<\/p>\n<p>the first respondent, accused,  as Ext.P2 cheque issued by<\/p>\n<p>him, for an amount of Rs.35,000\/-,   was dishonoured and<\/p>\n<p>the accused did not settle the account,  despite receipt of<\/p>\n<p>Ext.P5 notice, informing the dishonouring of the cheque.<\/p>\n<p>Hence the complaint was preferred.\n<\/p>\n<p>     2.    The   appellant   examined   two   witnesses   and<\/p>\n<p>marked eight documents.  DW1 was examined and Ext.D1<\/p>\n<p>was marked by the accused, respondent.   The trial Court<\/p>\n<p>had dismissed the complaint  on the grounds that Ext.P2<\/p>\n<p>cheque  was  issued as a  security,   that  the    writings  and<\/p>\n<p>signature of Ext.P2 cheque are on different hands and also<\/p>\n<p>that the details of the transaction had not been proved by<\/p>\n<p>Crl.A.203\/1999<br \/>\n<span class=\"hidden_text\">                                   2<\/span><\/p>\n<p>the appellant,  complainant.\n<\/p>\n<p>      3.     On going through the records, the dishonour<\/p>\n<p>of  Ext.P2 cheque, issuing of Ext.P5 notice and receipt of<\/p>\n<p>the   same,   as   could   be   seen   from   Ext.P6   postal<\/p>\n<p>acknowledgment   card,   and  Ext.P7   reply   notice   are   not<\/p>\n<p>disputed.   Therefore, the points   enumerated above,   as<\/p>\n<p>grounds of dismissal by the trial Court have, alone to be<\/p>\n<p>discussed in this appeal.\n<\/p>\n<p>      4.     The   findings   of   the   Court   below   that   Ext.P2<\/p>\n<p>cheque was issued as a security and therefore, dishonour<\/p>\n<p>of  Ext.P2 does  not attract Section 138 of the Act  is not<\/p>\n<p>sustainable  in view of the decision of the Supreme Court<\/p>\n<p>in <a href=\"\/doc\/1623811\/\">I.C.D.S Limited  v.  Beena Shabeer<\/a>(2002  (3)  KLT  218<\/p>\n<p>(SC)  ),    where the  Court held  that the issuance of the<\/p>\n<p>cheque is not only for the discharge in whole or  part of<\/p>\n<p>any debt, but the same includes &#8220;other liability&#8221; as well.<\/p>\n<p>The &#8216;other liability&#8217; mentioned covers the issuance of the<\/p>\n<p>cheque as security.  Therefore, the findings of the Court<\/p>\n<p>below on that point, is set aside.  The above authority had<\/p>\n<p>been followed by this Court in   <a href=\"\/doc\/677713\/\">Mohana Pai   v.   Jabbar<\/p>\n<p>Crl.A.203\/1999<\/a><br \/>\n<span class=\"hidden_text\">                                   3<\/span><\/p>\n<p>(2005  (1)  KLT  118).\n<\/p>\n<p>      5.     The  Apex Court    held that once a cheque  is<\/p>\n<p>issued and dishonoured on presentation, because of the<\/p>\n<p>presumption,   available   in   favour   of   the   holder   of   the<\/p>\n<p>cheque   in   due   course,     under   Section   118   as   well   as<\/p>\n<p>under   Section   139   of   the   Act,   unless   the   same   is<\/p>\n<p>rebutted,     the   cheque   has   to   be   accepted   as   having<\/p>\n<p>validly  issued in discharge of a debt, due to the holder of<\/p>\n<p>the cheque.  <a href=\"\/doc\/1486400\/\">(See K.N.Beena  v.  Muniyappan  (AIR<\/a> 2001<\/p>\n<p>SC  2895).   It is not necessary for the Court go through<\/p>\n<p>the   passing   of   the   consideration   covering   the   cheque<\/p>\n<p>amount,   unless   presumption  is   rebutted.    In   this   case,<\/p>\n<p>there   is   no   evidence   adduced   to   show   that   the<\/p>\n<p>presumption available under Sections 118 and 139 of the<\/p>\n<p>Act   are   rebutted.     Hence   I   hold   that   the   learned<\/p>\n<p>Magistrate went wrong in finding that the appellant had<\/p>\n<p>not established regarding the transaction and passing of<\/p>\n<p>the   consideration   in   respect   of   Ext.P2   cheque   amount.<\/p>\n<p>Therefore, the said finding is also not sustainable.<\/p>\n<p>      6.     Yet another finding of the Court below is that<\/p>\n<p>Crl.A.203\/1999<br \/>\n<span class=\"hidden_text\">                                   4<\/span><\/p>\n<p>the     writings   in   Ext.P2   cheque   are   of   different   hands.<\/p>\n<p>The apex Court held that even if a blank cheque is issued<\/p>\n<p>and the   details therein, other than the signature of the<\/p>\n<p>executant,   were filled up by the complainant or anyone<\/p>\n<p>else, unless the contends therein are rebutted,  the same<\/p>\n<p>had   to   be   accepted.     The   different   hand   writing   or<\/p>\n<p>different colour of the ink is not a material alteration at<\/p>\n<p>all.   <a href=\"\/doc\/1836893\/\">(See  Lillykutty  v.  Lawrance<\/a>  (2003  (3)  KLT  721).<\/p>\n<p>Therefore,   the   findings   of   the   learned   Magistrate   is<\/p>\n<p>unacceptable on the above principle as well.<\/p>\n<p>      7.     When the entire evidence is thus appreciated,<\/p>\n<p>I   hold  that  the   appellant,   complainant,   had  established<\/p>\n<p>the   offence   alleged   against   the   accused,   the   first<\/p>\n<p>respondent,   under   Section   138   of   the   Act.     Hence,   I<\/p>\n<p>further hold that the first respondent, accused, as guilty<\/p>\n<p>and convict him, thereunder.   Therefore, I set aside the<\/p>\n<p>impugned   judgment   of   the   trial   Court   as   well   as   the<\/p>\n<p>acquittal of the accused therein.\n<\/p>\n<p>      8.     Though the advocate is appearing on behalf of<\/p>\n<p>the first respondent, accused, he has to be heard on the<\/p>\n<p>Crl.A.203\/1999<br \/>\n<span class=\"hidden_text\">                                   5<\/span><\/p>\n<p>sentence,   before   imposing   the   same.     For   that   limited<\/p>\n<p>purpose of hearing the first respondent, accused, on the<\/p>\n<p>question   of   sentence   and   for   passing   the   sentence<\/p>\n<p>according to the law,   I remand the case to the Judicial<\/p>\n<p>Magistrate of First Class-II, Kochi.<\/p>\n<p>        9.    The   parties   shall   appear   before   the   Court<\/p>\n<p>below   on   3.8.2006.         The   learned   Magistrate,   after<\/p>\n<p>hearing the accused, on the question of sentence, shall<\/p>\n<p>impose such sentence,  as per  the law.\n<\/p>\n<p>        10.
