        Notice to respondent No.1 is dispensed with in view of the order I am<\/p>\n
proposing to make in this revision which is not prejudicial to him. Public<\/p>\n
Prosecutor takes notice for respondent No.2.\n<\/p>\n<\/p>\n
       2.     These revisions are in challenge of separate judgments passed by<\/p>\n
the learned Sessions Judge, Kottayam in Crl.Appeal Nos.249 of 2008 and 251<\/p>\n
of 2008 confirming conviction of the petitioner for offence punishable under<\/p>\n
Section 138 of the Negotiable Instruments Act (for short, “the Act”) but modifying<\/p>\n
the sentence. Since the parties in these revisions are same and the facts<\/p>\n
involved are also similar, revisions are being disposed of by a common order.<\/p>\n
       3.     In Crl.R.P.No.1867 of 2009 arising from S.T.No.939 of 2006 of the<\/p>\n
court of learned Judicial Magistrate of First Class-I, Kottayam case of respondent<\/p>\n
No.1 is that petitioner borrowed Rs.78,500\/- from him and for repayment of that<\/p>\n
amount, issued Ext.P1,         cheque dated 15.11.2005.              That cheque on<\/p>\n
presentation was returned for insufficiency of funds as proved by Exts.P2 and<\/p>\n
P3. On getting dishonour intimation respondent No.1 issued notice to the<\/p>\n
petitioner on 31.1.2006 (Ext.P4 is the copy of notice) intimating dishonour and<\/p>\n
demanding payment of the amount.               Ext.P5 is produced to show that notice<\/p>\n

was sent by registered post. Ext.P6 shows that petitioner was served with the<\/p>\n
notice on 4.2.2006. Respondent No.1 gave evidence as PW1 and stated that<\/p>\n
petitioner borrowed Rs.78,500\/- from him and for the discharge of that liability<\/p>\n
issued the cheque. When questioned under under Section 313 of the Code of<\/p>\n
Criminal Procedure, petitioner claimed that respondent No.1 is his relative and a<\/p>\n
trusted person, respondent No.1 used to visit his house often. The cheque in<\/p>\n
question is one of the cheques he lost from his house five years before filing<\/p>\n
of the complaint.\n<\/p>\n<\/p>\n
       4.     In Crl.R.P.No.1868 of 2009 arising from S.T.No.938 of 2006 of the<\/p>\n
court of learned Judicial Magistrate of First Class-I, Kottayam case of respondent<\/p>\n
No.1 is that petitioner borrowed Rupees one lakh from him and for repayment of<\/p>\n
that amount, issued Ext.P1,      cheque dated 7.10.2005.         That cheque on<\/p>\n
presentation was returned for insufficiency of funds as proved by Exts.P2 and<\/p>\n
P3. On getting dishonour intimation respondent No.1 issued notice to the<\/p>\n
petitioner on 31.1.2006 intimating dishonour and demanding payment of the<\/p>\n
amount.     Issue and service of notice on petitioner are proved by Exts.P4 and<\/p>\n
P6.   Respondent No.1 gave evidence as PW1 and testified to his case.       In this<\/p>\n
case also, petitioner raised the same defence as in S.T.No.939 of 2006. On the<\/p>\n

question as to the cause of dishonour of the cheques and issue and service of<\/p>\n
statutory notice, there is no dispute and the same are proved by evidence.<\/p>\n
Challenge is to the execution of the cheques.\n<\/p>\n<\/p>\n
       5.     Courts below were not impressed by the contention raised by the<\/p>\n
petitioner in both the cases. As regards the due execution of the cheques,<\/p>\n
respondent No.1 has given evidence as PW1 in both the cases. It is admitted<\/p>\n
that the cheques are signed by the petitioner and drawn on the account<\/p>\n
maintained by him. His contention is that he lost the cheques five years before<\/p>\n
filing of the complaint.    If that be so, in the normal course he would have<\/p>\n
informed his bank about loss of cheques and issued         direction for stopping<\/p>\n
payment of any amount as per those cheques.            That has not happened.<\/p>\n
Moreover inspite of being served with statutory notice in both the cases,<\/p>\n
petitioner did not reply to that. The suggestion put to respondent No.1 while he<\/p>\n
was in the box that he stealthily got possession of cheques has been denied by<\/p>\n
him. Nothing was brought out to disbelieve the evidence of PW1.          In these<\/p>\n
circumstances I do not find reason to interfere with the concurrent finding of the<\/p>\n
courts below as to the due execution of cheque.\n<\/p>\n<\/p>\n
       6.     In S.T.No.939 of 2006, learned magistrate sentenced the petitioner<\/p>\n
to undergo simple imprisonment for four months.      Appellate court modified the<\/p>\n

sentence as one till rising of the court and fine of Rs.78,500\/- with default<\/p>\n
sentence of simple imprisonment for three months.            In S.T.No.938 of 2006,<\/p>\n
learned magistrate sentenced the petitioner to undergo simple imprisonment for<\/p>\n
six months. Appellate court modified the sentence as one till rising of the court<\/p>\n
and fine of Rupees one lakh with default sentence of simple imprisonment for<\/p>\n
three months.     I do not find reason to interfere with the sentence as modified by<\/p>\n
the appellate court.\n<\/p>\n
        7.     Learned counsel for petitioner requested that petitioner may be<\/p>\n
granted six months’ time to deposit the fine in the trial court as ordered by the<\/p>\n
appellate court. It is seen from the judgment of the appellate court that petitioner<\/p>\n
has already been given three months’ time to deposit the fine.              However<\/p>\n
considering the circumstances stated by the learned counsel as to the difficulty<\/p>\n
of the petitioner to raise the amount immediately and considering the amount<\/p>\n
involved, I am inclined to grant three months’ further time to deposit the fine in<\/p>\n
the trial court. It is made clear that the substantive sentence awarded by the<\/p>\n
appellate court or the default sentence for non-payment of fine are not interfered<\/p>\n
with.\n<\/p>\n<\/p>\n
        Resultantly, these revisions fail and are accordingly dismissed. Petitioner<\/p>\n
is granted three months’ time from today to deposit fine in both the cases in the<\/p>\n
trial court as ordered by the appellate court.     In case of default Petitioner shall<\/p>\n

undergo the default sentence as ordered by the appellate court. Petitioner shall<\/p>\n
appear in the trial court on 22.9.2009 to receive the sentence.<\/p>\n
       Crl.M.A.Nos. 5653 of 2009 in Crl.R.P.No.1867 of 2009 and 5654 of 2009<\/p>\n
in Crl.R.P.No.1868 of 2009 will stand dismissed.\n<\/p>\n<\/p>\n
