Justice S.S.SATHEESACHANDRAN\n\n Dated :16\/12\/2009\n\n O R D E R\n                     S.S.SATHEESACHANDRAN, J.\n                    -----------------------------------\n                    W.P.(C).No.35655 of 2009 - O\n                     ---------------------------------\n           Dated this the 16th day of December, 2009\n\n                            J U D G M E N T\n<\/pre>\n<p>     Writ petition is filed seeking the following reliefs:<\/p>\n<p>        &#8220;i)  To call for the records relating to Ext.P1.<\/p>\n<p>        ii)  To issue a writ of mandamus or appropriate writ<\/p>\n<p>        order or direction to stay all proceedings under Ext.P6<\/p>\n<p>        notice till the disposal of Ext.P1 appeal.&#8221;\n<\/p>\n<p>     2.    Petitioner is the appellant in C.M.A.No.82 of 2009 on<\/p>\n<p>the file of the 2nd Additional District Court, Ernakulam.       The<\/p>\n<p>appeal is preferred under Section 61D of the Kerala Forest Act,<\/p>\n<p>against an order passed by the Divisional Forest Officer,<\/p>\n<p>Malayattoor Division, Kodanad, confiscating a motor vehicle<\/p>\n<p>owned by the appellant alleging that it was involved in a forest<\/p>\n<p>offence.   Previously, petitioner, after registration of the forest<\/p>\n<p>offence involving the vehicle, had got interim custody of that<\/p>\n<p>vehicle, after seizure by the forest officials, by orders of the<\/p>\n<p>Magistrate before whom the criminal case was pending.           The<\/p>\n<p>release of the vehicle on interim custody was challenged by the<\/p>\n<p>respondent by filing a writ petition, W.P.(C).No.22748 of 2008<\/p>\n<p>W.P.(C).No.35655 of 2009 &#8211; O<\/p>\n<p><span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>before this Court.     Order passed by the learned Magistrate<\/p>\n<p>allowing interim custody of the vehicle was quashed by judgment<\/p>\n<p>dated 28.7.2009 rendered in the above writ petition.    A petition<\/p>\n<p>filed by the petitioner seeking review of that judgment was also<\/p>\n<p>later dismissed. Meanwhile, pursuant to proceedings taken the<\/p>\n<p>Divisional Forest Officer, after hearing the petitioner\/appellant,<\/p>\n<p>passed an order confiscating the vehicle. That order is now being<\/p>\n<p>challenged in C.M.A.No.82 of 2009 before the 2nd Additional<\/p>\n<p>District   Court,     Ernakulam.        In     that   C.M.Appeal,<\/p>\n<p>petitioner\/appellant had moved an application for staying the<\/p>\n<p>operation of the confiscation order. Learned District Judge has<\/p>\n<p>ordered notice on that application.      Petitioner has therefore<\/p>\n<p>approached this Court seeking the aforementioned relief invoking<\/p>\n<p>the supervisory jurisdiction vested with this Court under Article<\/p>\n<p>227 of the Constitution of India.\n<\/p>\n<p>      3.   Notice given, learned Special Government Pleader<\/p>\n<p>(Forests) has appeared on behalf of the respondents. I heard the<\/p>\n<p>counsel for the petitioner and the learned Special Government<\/p>\n<p>Pleader (Forests).\n<\/p>\n<p>W.P.(C).No.35655 of 2009 &#8211; O<\/p>\n<p><span class=\"hidden_text\">                                 3<\/span><\/p>\n<p>      4.   Petitioner is enjoying possession of the vehicle on the<\/p>\n<p>basis of the interim custody granted by the Magistrate which had<\/p>\n<p>been quashed by orders by judgment rendered by this Court,<\/p>\n<p>submits the learned Special Government Pleader. Further more<\/p>\n<p>as no orders have been passed by the learned District Judge on<\/p>\n<p>the petition filed for staying the operation of the confiscation<\/p>\n<p>order impugned in the appeal and so much so, the visitorial<\/p>\n<p>jurisdiction of this Court may not be invoked for granting the<\/p>\n<p>relief canvassed in the writ petition, is the submission of the<\/p>\n<p>learned Special Government Pleader (Forests).<\/p>\n<p>      5.   Having regard to the submissions made and the facts<\/p>\n<p>and circumstances presented, I find at this stage, the relief<\/p>\n<p>canvassed for staying the operation of Ext.P6 notice given by the<\/p>\n<p>authorized officer, pending appeal preferred by the petitioner,<\/p>\n<p>cannot be granted by this Court in exercise of writ jurisdiction.<\/p>\n<p>Petitioner has to approach the District Court for an expeditious<\/p>\n<p>disposal of the application filed by him for staying the operation<\/p>\n<p>of the confiscation order. It is submitted that the petition stands<\/p>\n<p>posted for return of notice on 23.12.2009.         Respondent is<\/p>\n<p>W.P.(C).No.35655 of 2009 &#8211; O<\/p>\n<p><span class=\"hidden_text\">                                 4<\/span><\/p>\n<p>directed to enter appearance in the appeal and file counter, if<\/p>\n<p>any, to that application before 22.12.2009. The learned District<\/p>\n<p>Judge is directed to hear and dispose of Ext.P2 application<\/p>\n<p>expeditiously, preferably on 23.12.2009 itself.
