SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 17\/08\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 226 of the Constitution of India<br \/>\nthe petitioners have prayed for the following reliefs;\n<\/p>\n<p>(b)\tThe<br \/>\nHon&#8217;ble Court be pleased to issue an appropriate writ, order or<br \/>\ndirection interalia declaring the action of the respondents in<br \/>\ndemanding premium for transfer of ownership of land bearing Survey<br \/>\nNo. 984 paiki admeasuring Hec. 4 Acres and 27 Gunthas situate at<br \/>\nAnjar District Kutch is ex-facie illegal, unlawful, without<br \/>\njurisdiction and authority of law and violative of Articles 14 &amp;<br \/>\n300A of the Constitution of India;\n<\/p>\n<p>(c)\tThis<br \/>\nHon&#8217;ble Court be pleased to issue an appropriate writ, order or<br \/>\ndirection interalia, permanently restraining the respondents from<br \/>\ndemanding any amount of premium for grant of permission to transfer<br \/>\nthe land bearing Survey No. 984 paiki;\n<\/p>\n<p>(d)\tThis<br \/>\nHon&#8217;ble Court be pleased to issue a writ of mandamus and\/or any other<br \/>\nappropriate writ, order or direction in the nature of mandamus<br \/>\ncommanding the respondents and more particularly respondents nos. 2<br \/>\nand 4 to forthwith grant the permission envisaged under Section 73B<br \/>\nof the Bombay Land Revenue Code read with condition stipulated in the<br \/>\norder dated 07\/01\/1987 within such time as may be deemed just, fit<br \/>\nand expedient and fixed by this Hon&#8217;ble Court.\n<\/p>\n<p>In<br \/>\nthe alternative, this Hon&#8217;ble Court be pleased to issue a writ of<br \/>\nmandamus and\/or any other appropriate writ, order or direction in the<br \/>\nnature of mandamus directing the respondents herein and more<br \/>\nparticularly the respondents no. 2-Collector from fixing the amount<br \/>\nof premium as on the date of making of the application dated<br \/>\n03\/04\/2006 and to further grant necessary permission as envisaged<br \/>\nunder Section 73B of the Bombay Land Revenue Code read with the<br \/>\ncondition contained in the order dated 07\/01\/1987 within such time as<br \/>\nmay be deemed just, fit and expedient and fixed by this Hon&#8217;ble<br \/>\nCourt.\n<\/p>\n<p>(e)\tThis<br \/>\nHon&#8217;ble Court be pleased to issue an appropriate writ, order or<br \/>\ndirection declaring the action on the part of the respondents in<br \/>\ndemanding the premium on the basis of the current market price on the<br \/>\ndate of decision of the application to be without jurisdiction and<br \/>\nauthority of law, arbitrary, discriminatory and violative of Article<br \/>\n14 of the Constitution of India.\n<\/p>\n<p>(f)\tPending<br \/>\nadmission, hearing and\/or final disposal of this petition, this<br \/>\nHon&#8217;ble Court be pleased to issue interim directions to the<br \/>\nrespondents more particularly the respondents nos. 2 and 4 to grant<br \/>\nnecessary permission for transfer of the land by the petitioner no. 1<br \/>\nto petitioners nos. 2 to 4 on payment of premium on the basis of<br \/>\nmarket value of the land existing on the date of the application i.e.<br \/>\n30\/04\/2006 subject to such terms and conditions as may be deemed<br \/>\njust, fit and expedient and imposed by this Hon&#8217;ble Court.\n<\/p>\n<p>2.\tThough<br \/>\nnumber of reliefs have been prayed, Shri A.V Nair, learned advocate<br \/>\nappearing on behalf of the petitioners has restricted the prayer of<br \/>\nthe petitioners with respect to the action of the respondents in<br \/>\ndemanding premium  while considering  the  application   of   the<br \/>\npetitioners to convert the 4 Acres 27 Gunthas  of land situated at<br \/>\nAnjar from agricultural use  to non agricultural use, and, therefore,<br \/>\nthis Court is at present required to consider only the question<br \/>\nwhether while considering the application of the petitioners for<br \/>\nconverting the land in question from agricultural use to non<br \/>\nagricultural use, respondents are justified in demanding the premium<br \/>\nor not.\n<\/p>\n<p>3.\tShri<br \/>\nA.V. Nair, learned advocate appearing on behalf of the petitioners<br \/>\nhas vehemently submitted that earlier vide order dated 07\/01\/1987<br \/>\nwhile converting the entire land in question from new tenure to old<br \/>\ntenure the amount in question was paid by the original owner and<br \/>\nthereafter the petitioners had purchased the said land and,<br \/>\ntherefore, for converting the very land in question from agricultural<br \/>\n to non agricultural,  the amount of premium is not required to be<br \/>\npaid.  It is further submitted that as such the petitioners were not<br \/>\nrequired to submit an appropriate application for determination of<br \/>\npremium under Section 73A of the Bombay Land Revenue Code and<br \/>\nwhatever amount is required to be paid under Section 65 of the Bombay<br \/>\nLand Revenue Code is required to be paid  and no other amount of<br \/>\npremium is required to be paid.  In the alternative it is submitted<br \/>\nthat if this Court comes to the conclusion that the petitioners are<br \/>\nrequired to pay the amount of premium for converting the land into<br \/>\nnon agricultural use, it is requested to issue appropriate direction<br \/>\ndirecting the concerned respondents to decide and dispose of the<br \/>\napplication submitted by the petitioners for converting the land in<br \/>\nquestion from agricultural use to non agricultural use and to<br \/>\ndetermine the premium at the earliest within the stipulated time.\n<\/p>\n<p>4.\tThe<br \/>\npetition is opposed by Shri Neeraj Soni, learned AGP appearing on<br \/>\nbehalf of the respondents.  It is submitted that the contention on<br \/>\nbehalf of the petitioners that as earlier the original owner paid the<br \/>\npremium while converting the land in question from new tenure to old<br \/>\ntenure and\/or transferring the occupancy rights vide order dated<br \/>\n07\/01\/1987, while converting the land from agricultural use  to non<br \/>\nagricultural use, no amount of premium is required to be paid, cannot<br \/>\nbe accepted.  It is submitted that even while permitting the transfer<br \/>\nof occupancy rights vide order dated 07\/01\/1987, on payment of<br \/>\npremium, permission was granted to transfer the occupancy rights as<br \/>\nnew tenure land and for agricultural purpose only and, therefore,<br \/>\nwhen the land in question continued to be new tenure  land for<br \/>\nagricultural purpose, as and when the land is to be converted from<br \/>\nagricultural use to non agricultural use, petitioners are required to<br \/>\npay the amount of premium, and, therefore,  no illegality has been<br \/>\ncommitted by the concerned respondents in demanding the amount of<br \/>\npremium and, therefore, it is requested to dismiss the present<br \/>\npetition.\n<\/p>\n<p>5.\tHeard<br \/>\nthe learned advocates appearing on behalf of the respective parties<br \/>\nat length.  At the outset it is required to be noted that the<br \/>\npetitioners have challenged the action of the respondents in<br \/>\ndemanding premium while converting the land in question from<br \/>\nagricultural use to non agricultural use.  The contention on behalf<br \/>\nof the petitioners that as earlier vide order dated 07\/01\/1987 when<br \/>\nthe application was submitted to convert the land from new tenure to<br \/>\nold tenure and to transfer the occupancy rights, the original owner<br \/>\nhad paid the amount of premium, and, therefore, the petitioners are<br \/>\nnot required to pay the premium while converting the land from<br \/>\nagricultural use to non agricultural use, the aforesaid cannot be<br \/>\naccepted.  It is to be noted that when earlier the permission was<br \/>\ngranted to transfer the occupancy rights vide order dated 07\/01\/1987<br \/>\nand premium was charged it was only for the purpose of  transferring<br \/>\nthe occupancy right for agricultural purpose and the tenure of the<br \/>\nland i.e. new tenure came to be continued and, therefore, when the<br \/>\ntenure of the land came to be continued as new tenure land and when<br \/>\nsubsequently the petitioner applied for permission to covert the land<br \/>\nfrom agricultural use to non agricultural use  by removing the<br \/>\nrestrictions of new tenure, the petitioner is required to pay the<br \/>\npremium and no illegality has been committed  by the respondents<br \/>\ninsisting for premium.\n<\/p>\n<p>6.\tNow<br \/>\nso far as the contention on behalf of the petitioners that the<br \/>\npetitioners are required to pay only that much amount\/charge, which<br \/>\nis required to be paid under Section 65 of the Bombay Land Revenue<br \/>\nCode  is concerned, the aforesaid cannot be accepted.  Only, in a<br \/>\ncase were a person is holding agricultural land as old tenure and\/or<br \/>\nwithout any restriction and he wants to use the land for non<br \/>\nagricultural purpose and he submits an application for non<br \/>\nagricultural use he is required to pay the amount\/charge under<br \/>\nSection 65.  So far as the restricted new tenure land is concerned,<br \/>\neven while getting the land converted from agricultural use to non<br \/>\nagricultural use, owner of the land is required to pay the premium to<br \/>\nremove the restriction of new tenure land.  The amount of premium,<br \/>\nwhich is charged, is for removing the restrictions as new tenure and<br \/>\nnecessary charges, which are required to be paid for converting the<br \/>\nland from agricultural use to non agricultural use is required to be<br \/>\npaid.  It is to be noted that in the present case the petitioners<br \/>\nhave submitted an application for determination of the premium and to<br \/>\ngrant permission to convert the land from agricultural use to non<br \/>\nagricultural use by removing the restriction as new tenure land.<br \/>\nUnder the circumstances, the contention on behalf of the petitioners<br \/>\nthat the petitioners are not required to pay the premium while<br \/>\nconverting the land from agricultural use to non agricultural use and<br \/>\nto remove the restriction as new tenure, cannot be accepted.\n<\/p>\n<p>7.\tHowever,<br \/>\nthe alternative prayer of the petitioners to direct the Collector to<br \/>\ndetermine the premium and to consider the application of the<br \/>\npetitioners to convert the land from agricultural use to non<br \/>\nagricultural use  and to remove the restriction as new tenure land<br \/>\nand to determine the amount of premium within the stipulated time can<br \/>\nbe considered.\n<\/p>\n<p>8.\tSo<br \/>\nfar as the prayer of the petitioners to quash and set aside the<br \/>\naction of the respondents to charge premium while considering the<br \/>\napplication of the petitioners for converting the land from<br \/>\nagricultural use to non agricultural use and to remove the<br \/>\nrestrictions as new tenure land is hereby dismissed.\n<\/p>\n<p>9.\tHowever,<br \/>\nin the facts and circumstances of the case, the Collector, Kutch is<br \/>\nhereby directed to decide and dispose of the application submitted by<br \/>\nthe petitioners for converting the land from agricultural use to non<br \/>\nagricultural use and to remove the restriction as new tenure and to<br \/>\ndetermine the premium after following the due procedure at the<br \/>\nearliest and preferably within a period of four months from the date<br \/>\nof receipt of the present order.\n<\/p>\n<p>10.\tWith<br \/>\nthis, the present petition is dismissed.  Notice is discharged.
