The  petitioner  impugns the order dated  6\/4\/2010<\/p>\n<p>     (Annexure P-13) whereby an election petition filed by<\/p>\n<p>     the petitioner was dismissed summarily.\n<\/p>\n<p>2.   The brief facts in nutshell are that the<br \/>\npetitioner being aggrieved by the election on the post<br \/>\nof Janpad Member, Janpad Panchayat for Janpad Circle<br \/>\nNo.3, Magarlod, District Dhamtari, preferred an<br \/>\nelection petition on the grounds that several<br \/>\nirregularities were committed in counting of votes,<br \/>\nwherein the returned candidate respondent No.1 has<br \/>\nobtained 822 votes and the petitioner has obtained 819<br \/>\nvotes. Thus, the respondent No.1 was declared as<br \/>\nelected Janpad Member. Being aggrieved, the petitioner<br \/>\npreferred an election petition under provisions of<br \/>\nSection 122 of Panchayat Raj Adhiniyam,1993 before the<br \/>\nCollector i.e. respondent No.16. The said petition was<br \/>\ndismissed on 6\/4\/2010.\n<\/p>\n<p>3.   Rule 3 of the Chhattisgarh Panchayats (Election<br \/>\nPetitions, Corrupt Practices And Disqualification For<br \/>\nMembership) Rules, 1995 (in short Rule, 1995) provides<br \/>\nfor presentation of election petition. It provides that<br \/>\nan election petition shall be presented by the person<br \/>\nmaking the petition or by a person authorised in<br \/>\nwriting in this behalf by the person making the<br \/>\npetition. Further, the petition shall be accompanied by<br \/>\nas many copies thereof as there are respondents<br \/>\nmentioned in the petition and every such copy shall be<br \/>\nattested by the petitioner under his own signature to<br \/>\nbe a true copy of the petition.\n<\/p>\n<p>4.   Rule 5 of the Rules, 1995 makes a provision for<br \/>\ncontents of the petition wherein it is prescribed,<br \/>\ninter alia, that the election petition shall be signed<br \/>\nby the petitioner and verified in the manner laid down<br \/>\nin the Code of Civil Procedure, 1908 for the<br \/>\nverification of pleadings. Rule 8 of the Rules, 1995<br \/>\nprovides that if the provisions of Rule 3 or Rule 4 or<br \/>\nRule 7 has not been complied with, the petition shall<br \/>\nbe dismissed by the specified officer provided that the<br \/>\npetitioner shall not be dismissed under this rule<br \/>\nwithout giving the petitioner an opportunity of being<br \/>\nheard.\n<\/p>\n<p>5.   The petitioner has sought relief of recounting of<br \/>\nvotes in the election petition (Annexure P-10).  The<br \/>\nrespondent No.1 filed objection seeking dismissal of<br \/>\nthe petition summarily under the provisions of Rule 8<br \/>\nof the Rules, 1995 on the ground that there is no<br \/>\ncompliance of provisions of Rule 3, 4 or 7 of the<br \/>\nRules, 1995.\n<\/p>\n<p>6.   The Collector (respondent No.16) having afforded<br \/>\nopportunity of hearing on 4\/3\/2010, 9\/3\/2010 and<br \/>\nfurther on 25\/3\/2010, after having considered all the<br \/>\naspects of the matter, came to the conclusion that the<br \/>\nAdvocate of the petitioner was not authorised to file<br \/>\nelection petition and secondly, the election petition<br \/>\nand other annexed documents were not duly signed and<br \/>\nattested by the election petitioner. Having regard to<br \/>\nthe above stated facts, the election petition was<br \/>\ndismissed summarily under Rule 8 of the Rules, 1995 for<br \/>\nwant of compliance of the provisions of Rule 3 of the<br \/>\nRules, 1995.\n<\/p>\n<p>7.   It is indisputable that the election petition was<br \/>\nnot attested by the petitioner on each and every page<br \/>\nof the election petition, except it was duly signed by<br \/>\nthe election petitioner on the last page of the<br \/>\npetition. Thus, the petitioner failed to comply with<br \/>\nthe provisions of Rule 3 and 5 of the Rules, 1995.\n<\/p>\n<p>8.   Having considered the case from all angle, this<br \/>\nCourt is of the view that there is no irregularity or<br \/>\ninfirmity in dismissal of the election petition vide<br \/>\nimpugned order dated 6\/4\/2010 (Annexure P-13).\n<\/p>\n<p>9.   The contention of the petitioner that he should<br \/>\nhave been given one more opportunity to file fresh<br \/>\nelection petition under the scheme of election deserves<br \/>\nto be rejected as there is no provision for granting an<br \/>\nopportunity after dismissal of the petition to file a<br \/>\nfresh petition. Thus,    the election petition of the<br \/>\npetitioner was rightly dismissed under Rule 8 of Rule,<br \/>\n1995 summarily.\n<\/p>\n<p>10.
