By consent, Rule is fixed forthwith.\n<\/p>\n<p>The<br \/>\n\tapplication is filed for appropriate orders as the trial Court did<br \/>\n\tnot release the applicant on bail despite order of this Court made<br \/>\n\tin Criminal Misc. Application No. 6955 of 2008 on 17.6.2008 ordering<br \/>\n\tapplicant&#8217;s release on bail on his executing a bond of Rs.5000=00<br \/>\n\t(Rs. Five Thousand only) with one surety of the like amount to the<br \/>\n\tsatisfaction of the lower Court and subject to the conditions<br \/>\n\tmentioned in the said order.\n<\/p>\n<p>Shri<br \/>\n\tKariel, learned counsel appearing for the applicant submitted that<br \/>\n\tthe trial Court did not release the applicant when the applicant was<br \/>\n\trequired to be enlarged on bail pursuant to the order dated<br \/>\n\t17.6.2008 passed by this Court in Criminal Misc. Application No.<br \/>\n\t6955 of 2008 on the ground that there is no order of the High Court<br \/>\n\tfor enlarging the applicant on bail so far as Section 467 of IPC is<br \/>\n\tconcerned, as applicant accused is also charged with committing<br \/>\n\toffence punishable under Section 467 of IPC. Shri Kariel submitted<br \/>\n\tthat learned trial Court ought to have appreciated the fact that<br \/>\n\tthis Court clearly ordered applicant&#8217;s release and granted him bail<br \/>\n\tin connection with I.CR. No. 81 of 2006 registered with Vallabhipur<br \/>\n\tPolice Station on his executing a bond of Rs.5000=00 (Rs. Five<br \/>\n\tThousand only) with one surety of the like amount to the<br \/>\n\tsatisfaction of the lower Court and therefore, the applicant ought<br \/>\n\tto have been released by learned Magistrate in due compliance with<br \/>\n\tthe order of this Court  as the applicant was required to be<br \/>\n\treleased in connection with I.CR. No. 81 of 2006 registered with<br \/>\n\tVallabhipur Police Station. Shri Kariel further submitted that the<br \/>\n\ttypographical error of mentioning Section 466 instead of Section 467<br \/>\n\tcannot be said to be a ground for not releasing the applicant when<br \/>\n\tin the operative part of the order, this Court has observed that the<br \/>\n\tapplicant is required to be released on bail in connection with<br \/>\n\tI.CR. No. 81 of 2006 registered with Vallabhipur Police Station.<br \/>\n\tShri Kariel has also submitted that the Hon&#8217;ble Court while<br \/>\n\treleasing the applicant on bail has taken into consideration all the<br \/>\n\tmaterial placed on record and applicant has placed on record the<br \/>\n\tchargesheet papers and FIR also and therefore, the operative part of<br \/>\n\tthe order dated 17.6.2008 is clear and trial Court ought not to have<br \/>\n\tdeclined the release of applicant.\n<\/p>\n<p>Ms.\n<\/p>\n<p>\tPanchal, learned APP fairly submitted that the trial Court ought to<br \/>\n\thave appreciated the operative portion and release the applicant on<br \/>\n\tbail.\n<\/p>\n<p>This<br \/>\n\tCourt is of the considered view that the trial Court ought to have<br \/>\n\treleased the applicant-accused  pursuant to the order dated<br \/>\n\t17.6.2008 passed by this Court in Criminal Misc. Application No.<br \/>\n\t6955 of 2008. The operative portion made in Criminal Misc.<br \/>\n\tApplication No. 6955 of 2008 is absolutely clear, which was passed<br \/>\n\tafter taking into consideration the documents produced on record<br \/>\n\tincluding the chargesheet papers, FIR, wherein Section 467 of IPC<br \/>\n\tfigures and earlier orders.\n<\/p>\n<p>The<br \/>\n\tpresent application is disposed of with following direction :\n<\/p>\n<p>The<br \/>\n\t\ttrial Court i.e. Learned JMFC, Vallabhipur is hereby specifically<br \/>\n\t\tdirected to carryout the order dated 17.6.2008 made in Criminal<br \/>\n\t\tMisc. Application No. 6955 of 2008 and release the applicant<br \/>\n\t\tforthwith in connection with I.CR. No. 81 of 2006 registered with<br \/>\n\t\tVallabhipur Police Station for the offences punishable under<br \/>\n\t\tSections 465, 467, 468, 471 read with Section 471 of the IPC on<br \/>\n\t\tsame terms and conditions mentioned in order dated 17.6.2008 on his<br \/>\n\t\texecuting a bond of Rs.5000=00 (Rs. Five Thousand only) with one<br \/>\n\t\tsurety of the like amount to the satisfaction of the lower Court as<br \/>\n\t\tper order dated 17.6.2008.\n<\/p>\n<p>The<br \/>\n\tapplication stands disposed of accordingly.
