       Pursuant to a notification issued by the<\/p>\n
first respondent inviting competitive tenders<\/p>\n
for providing vehicles to the officials of the<\/p>\n
Electricity   Board     on    a    contract    basis,  the<\/p>\n
petitioner  submitted        a   tender.       Apparently,<\/p>\n
though the petitioner was the lowest tenderer<\/p>\n
then, the Board was not in a position to award<\/p>\n
the tender in his favour, because the amount<\/p>\n
quoted by the petitioner was even higher than<\/p>\n
the rate, which had been fixed by the Public<\/p>\n
Works Department in the Government.               It seems<\/p>\n
that the circular issued by the Government and<\/p>\n
adopted  by    the     Electricity       Board,    Ext.P7,<\/p>\n
provided that the Board shall not accept the<\/p>\n
rates higher than the rate, which was stipulated<\/p>\n
by the Government.           There were two further<\/p>\n
tenders like this.        On both the occasions, the<\/p>\n
petitioner was the lowest tenderer or the only<\/p>\n
tenderer.\n<\/p>\n
       2. The matter being so, a tender notice<\/p>\n
was issued for the 4th time on 16.7.2007. The<\/p>\n
petitioner did not participate in the tender and<\/p>\n
W.P.(C).NO.12592\/07<\/p>\n
                      :: 2 ::\n<\/p>\n
\ntwo other persons participated and rates quoted<\/p>\n
by both of them were lower than the rates<\/p>\n
stipulated  by  the  Government.      The  Board,<\/p>\n
therefore,  was   desirous    of  proceeding  to<\/p>\n
finalise the said tenders and accordingly an<\/p>\n
application has been filed as I.A.No.11900\/08<\/p>\n
seeking permission of this court to do so.<\/p>\n
       3.   The  writ  petitioner   has  filed a<\/p>\n
counter  affidavit   to   the   said  application<\/p>\n
pointing out that both the persons, who had<\/p>\n
participated  on  the   latest   occasions,  have<\/p>\n
withdrawn their offers. One of them filed a case<\/p>\n
before the Consumer Disputes Redressal Forum<\/p>\n
also.  If that be so, the only remedy available<\/p>\n
to the Board will be to either accept the<\/p>\n
quotation given by the petitioner or go for a<\/p>\n
fresh tender, as the case may be.<\/p>\n
       In my view, if the two persons, who have<\/p>\n
quoted  rates  below  the    rates fixed  by  the<\/p>\n
Electricity Board still affirm their offers,<\/p>\n
then it is open to the Board to finalise the<\/p>\n
said tender. But then, the Board is bound to<\/p>\n
award the work to the lowest tenderer therein.<\/p>\n
If,  as  the   writ  petitioner    contends,  the<\/p>\n
W.P.(C).NO.12592\/07<\/p>\n
                      :: 3 ::\n<\/p>\n
\naforementioned two persons have withdrawn, then<\/p>\n
fresh tenders may be invited, in which case, the<\/p>\n
petitioner shall be entitled to participate in<\/p>\n
the same. In the facts and circumstances, the<\/p>\n
petitioner may be permitted to participate on<\/p>\n
the strength of the Earnest Money Deposit, which<\/p>\n
has not been refunded to him, so far. The entire<\/p>\n
process, as outlined above, shall be completed<\/p>\n
within one month from the date of receipt of a<\/p>\n
copy of this judgment.\n<\/p>\n<\/p>\n
