This writ petition challenges the order of the Central<br \/>\nAdministrative Tribunal, Principal Bench, New Delhi dated<br \/>\n27th November, 2001. The applicants before the Central<br \/>\nAdministrative Tribunal and the respondents herein, had<br \/>\nclaimed parity with the applicants in O.A. 133\/1991 before<br \/>\nthe Lucknow Bench of the Central Administrative Tribunal<br \/>\nwhich directed the respondents to upgrade the posts of<br \/>\nMaterial Checkers held up the applicants before it to the<br \/>\nhigher grade of Material Checking Clerks. The said order<br \/>\nof the Lucknow Bench had been appealed against before the<br \/>\nHon&#8217;ble Supreme Court and the Supreme Court had dismissed<br \/>\nthe Special Leave Petition and thus the order of the<br \/>\nLucknow Bench of the Central Administrative Tribunal became<br \/>\nfinal.\n<\/p>\n<p> 2. The foundation of the pleas of the respondents was<br \/>\nthat the respondents i.e. the applicants before the<br \/>\nCentral Administrative Tribunal, New Delhi and the<br \/>\napplicants in O.A. 133\/91 before the Lucknow Bench were<br \/>\nplaced in the same seniority list of Material Checkers. It<br \/>\nis also contended that while the judgment of the Lucknow<br \/>\nBench has been complied with, but it has been restricted<br \/>\nonly to the applicants before the Lucknow Bench of the CAT<br \/>\nand the benefit thereof has been denied to the applicants<br \/>\nbefore the CAT, New Delhi, who were similarly situated to<br \/>\nthe applicants before the Lucknow Bench. It is thus<br \/>\ncontended that since the judgment of the Lucknow Bench of<br \/>\nthe Central Administrative Tribunal was upheld by the<br \/>\nSupreme Court, consequently the issue involved in that case<br \/>\ncannot be re-opened. The petitioner took a stand that the<br \/>\norder of the Lucknow Bench was not binding as certain<br \/>\norders of the Railway Board has been ignored and the<br \/>\ndismissal of the S.L.P. by the Supreme Court did not make<br \/>\nit law under Article 141 of the Constitution of India.<br \/>\nConsequently the order affirmed by the Supreme Court was<br \/>\ndecided to be implemented only for those persons who had<br \/>\nfiled the O.A. before the Lucknow Bench and none else.\n<\/p>\n<p> 3. The Tribunal by its impugned judgment found that it<br \/>\nwas not even the case of the respondent that the applicants<br \/>\nwere not placed in the same seniority list as those before<br \/>\nthe Lucknow Bench. In fact some of the respondents herein<br \/>\nwere shown as senior to the appellants before the Lucknow<br \/>\nBench. The Tribunal relied upon the judgment of the<br \/>\nLucknow Bench and held as under:-\n<\/p>\n<p>  &#8220;Applying the said principles&#8230;\n<\/p>\n<p>the applicants are entitled to count their<br \/>\nseniority from the date they were so<br \/>\nupgraded and placed in the same pay scale<br \/>\nand their seniority will be countered from<br \/>\nthat date. Those who are Material Clerks<br \/>\nbefore that, obviously will rank senior to<br \/>\nthem but those who become Material<br \/>\nCheckers subsequent to their gradation and<br \/>\nplacement in the same scale, will rand<br \/>\njunior to them and accordingly this<br \/>\napplication is allowed to the extent that<br \/>\nthe order dated 19.4.1991 is quashed and<br \/>\nthe respondents are directed to prepare a<br \/>\nfresh seniority list in accordance with<br \/>\nlaw and in the light of the observations<br \/>\nmade above, within a period of three<br \/>\nmonths from the date of receipt of a copy<br \/>\nof this judgment and give promotions to<br \/>\nthe applicants in accordance with their<br \/>\nseniority and placement without requiring<br \/>\nthem to undergo written test or viva-voce<br \/>\nfor the post of Material Clerks.&#8221;\n<\/p>\n<p> 4. The Tribunal further found that even before the<br \/>\nLucknow Bench, the letter dated 6th July, 1978 was relied<br \/>\nupon by the applicant and had been relied upon before the<br \/>\nCentral Administrative Tribunal, New Delhi too. The<br \/>\nTribunal further held that the judgment of Lucknow Bench<br \/>\nhad attained finality and had been admittedly implemented<br \/>\nby the Union of India and therefore following the law laid<br \/>\ndown in <a href=\"\/doc\/1586768\/\">Amrit Lal Berry v. Collector of Central Excise, New<br \/>\nDelhi (SLR<\/a> 1975 (1) 153 at 169) and Girdhari Lal v. Union<br \/>\nof India and Ors. the Appellant\/Union of India ought to have<br \/>\ntreated alike all persons similarly situated. The Tribunal<br \/>\nhad noticed that the Railway Board&#8217;s letter relied upon by<br \/>\nthe applicant\/respondent itself, clearly states that for<br \/>\nthe upgraded posts of Material Clerks, no arrears will be<br \/>\npaid prior to 1st August, 1978. Consequently the full<br \/>\nBench of the Central Administrative Tribunal directed that<br \/>\nthe applicants were entitled to have their pay re-fixed<br \/>\nfrom the relevant date in the grade of Material Checkers<br \/>\nand Clerks and the consequential benefits will be subject<br \/>\nto law of limitation.\n<\/p>\n<p> 5. It is this order of the Full Bench dated 23rd October,<br \/>\n2001 along with the consequent order of the Division Bench<br \/>\ndated 27th November, 2001 which is challenged in this Writ<br \/>\nPetition before us and the learned counsel for the<br \/>\npetitioner has primarily contended that since the order of<br \/>\nthe Tribunal, Lucknow did not state that the similarly<br \/>\nsituated persons shall be given benefit, it could not be<br \/>\ngiven to the applicants before the Central Administrative<br \/>\nTribunal, New Delhi as it was not a precedent and the<br \/>\ntreating the order of the Tribunal, Lucknow as a precedent<br \/>\nwill open the flood gates. Besides making this sweeping<br \/>\nstatement no detail or particular of any kind whatsoever<br \/>\nwas averred in the writ petition or even urged in arguments<br \/>\nbefore us. Infact, it turned out that the phrase &#8216;Flood<br \/>\ngates&#8217; had been used rather liberally and inappropriately<br \/>\nparticularly when enquiries revealed that there were only 8<br \/>\nrespondents. Learned counsel has further relied upon the<br \/>\nplea that the Material Checker&#8217;s post were project based<br \/>\nand they cannot claim the effect of any upgradation policy.\n<\/p>\n<p> 6. We have considered the pleas of the petitioner and are<br \/>\nsatisfied that the writ petition is without merit. While<br \/>\nthere is no dispute that the judgment of Lucknow Bench of<br \/>\nthe Central Administrative Tribunal had not made it<br \/>\nuniversally applicable, yet it is not in dispute that most<br \/>\nof the respondents figure in the same seniority list as the<br \/>\napplicants before the Lucknow Bench. The respondents&#8217; plea<br \/>\nwas based on the fact that the similarly situated persons<br \/>\nwho figured in the same seniority list and were even senior<br \/>\nto the applicants before the Lucknow Bench cannot be<br \/>\ntreated differently by the respondent, particularly when<br \/>\nthe Supreme Court had affirmed the decision of the Lucknow<br \/>\nBench and the principles laid down therein. We are<br \/>\nsatisfied that there is no merit in the plea of the<br \/>\nrespondent and the Central Administrative Tribunal was<br \/>\nentirely justified in granting the benefit entitling them<br \/>\nto have their pay refixed in the grade of Material Checkers<br \/>\nand Clerk as was done in the case of the applicants before<br \/>\nthe Lucknow Bench. Irrespective of the fact that whether<br \/>\nthe Lucknow Bench order was universally applicable, those<br \/>\nfiguring in the same seniority list as the applicants and<br \/>\nthose other similarly situated as the applicants before<br \/>\nthe Lucknow Bench are entitled to similar benefits<br \/>\nparticularly when the Hon&#8217;ble Supreme Court had upheld the<br \/>\norder of the Lucknow Bench. We are satisfied that the<br \/>\nrespondents&#8217; plea deserved to be accepted and the<br \/>\npetitioner had unduly delayed the implementation of the<br \/>\nbenefits granted by the Lucknow Bench Central<br \/>\nAdministrative Tribunal for no valid reason. Accordingly<br \/>\nthere is no merit in the writ petition.\n<\/p>\n<p> 7. We must also note that even though the Full Bench of<br \/>\nthe Central Administrative Tribunal laid down the<br \/>\nprinciples governing dispute by its judgment dated 23rd<br \/>\nOctober, 2001 and the Division Bench consequently granted<br \/>\nbenefits in accordance with the Full Bench judgment by its<br \/>\norder dated 27th November, 2001. The writ petition in this<br \/>\nCourt was filed only in August, 2002. The petition<br \/>\nconsequently suffers from inordinate and unexplained laches<br \/>\nalso and the petitioners have ignored the time bound<br \/>\ndirection of the Tribunal dated 24th November, 2001<br \/>\ndirecting implementation of the judgment within three<br \/>\nmonths from the date of the receipt of the order. The<br \/>\nperiod of more than 9 months have passed before the writ<br \/>\npetition was filed and taken up for hearing on 14th August,<br \/>\n2002.
