Justice K.M.JOSEPH\n\n Dated :16\/07\/2007\n\n O R D E R\n                           K.M.JOSEPH, J.\n\n                 - - - - - - - - - - - - - - - - - - - - -\n\n              W.P.(C).No. 16727 OF 2007\n\n            - - - - - - - - - - - - - - - - - - - - - - - - - -\n\n                   Dated this the 16th day of July, 2007\n\n\n                                JUDGMENT\n<\/pre>\n<p>      The prayer in the writ petition is for a direction to the first<\/p>\n<p>respondent   to   disburse   the   sanctioned   amount   of   Rs.   85,000\/-\n<\/p>\n<p>towards   the   financial   assistance   to   the   houseless   persons   from<\/p>\n<p>the   Block   Panchayath   to   the   petitioner     for   the   purpose   of<\/p>\n<p>constructing a residential building.\n<\/p>\n<p>      2.    According   to   the   petitioner,   petitioner   along   with   his<\/p>\n<p>family consisting of young daughters are permanently residing in<\/p>\n<p>a purambok hut in Konnathadi Grama Panchayat under the first<\/p>\n<p>respondent.     First   respondent   after   having   due   verification,<\/p>\n<p>sanctioned   an   amount   of   Rs.   85,000\/-   to   the   petitioner   as<\/p>\n<p>financial  assistance for the purpose of  constructing a residential<\/p>\n<p>building, but it is being withheld.\n<\/p>\n<p>      3.    A counter is filed by the first respondent, wherein it is<\/p>\n<p>stated interalia as follows:\n<\/p>\n<blockquote><p>                   &#8221;  The petitioner is the third person in  the<\/p>\n<p><span class=\"hidden_text\">WPC No.16727\/07                          2<\/span><\/p>\n<p>             India   Awas   Yogana   Scheme   list,   in   the<\/p>\n<p>             Konnathudy Grama Panchayath.   The petitioner<\/p>\n<p>             executed   an   agreement   dated   07\/03\/2007,<\/p>\n<p>             before   Adimaly   Block   Panchayat   to   get<\/p>\n<p>             sanctioned   the   loan   under   the   INdira   Awas<\/p>\n<p>             Yogana Scheme.\n<\/p><\/blockquote>\n<blockquote><p>                    The Indira Awas Yogana( IAY) is a flagship<\/p>\n<p>             scheme of the Ministry of Rural Development to<\/p>\n<p>             provide   houses   to   the   poor   in   the   rural   areas.<\/p>\n<p>             The IAY is a centrally sponsored scheme funded<\/p>\n<p>             on cost-sharing basis  between  the Government<\/p>\n<p>             of India and the State Governments in the ratio<\/p>\n<p>             of 75:25.   The objective of the IAY is primarily<\/p>\n<p>             to   help   construction\/upgradation   of   dwelling<\/p>\n<p>             units of members of scheduled castes\/scheduled<\/p>\n<p>             tribes   freed   bonded   labourers   and   other   below<\/p>\n<p>             the   poverty   line   non   SC\/ST   households   by<\/p>\n<p>             providing them a lump sum amount an financial<\/p>\n<p>             assistance.&#8221;<\/p><\/blockquote>\n<p>      It   is   further  stated  that   petitioner  is   eligible  to   get   a  total<\/p>\n<p>amount   of   Rs.   70,000\/-   including   central   assistance   and   state<\/p>\n<p>assistance.     In   which   share   from   the   central   assistance   is<\/p>\n<p>Rs. 27,500\/ and the Block share ( state Government&#8217;s share) is<\/p>\n<p>Rs. 42,500\/-.   There is reference to the procedure in para 7 and<\/p>\n<p><span class=\"hidden_text\">WPC No.16727\/07                            3<\/span><\/p>\n<p>8.     It   is   stated   that   petitioner   has   not   complied   with   such<\/p>\n<p>procedure.\n<\/p>\n<p>       3.    Learned   Counsel   for   the   petitioner   submits   that   it   is<\/p>\n<p>true   that   petitioner   is   entitled   only   to   Rs.   70,000\/-.
