No.2059 of 2009\n                   ------------------------------------------\n              Dated this the 30th day of September, 2009\n\n                              JUDGMENT\n<\/pre>\n<p>A.K.Basheer, J.\n<\/p>\n<p>           We have heard Sri.T.Krishnan Unni, learned senior counsel<\/p>\n<p>for the appellant and Sri.C.K.Karunakaran, learned Standing Counsel<\/p>\n<p>appearing for respondents 4 and 5 and we have perused the entire<\/p>\n<p>materials available on record.\n<\/p>\n<p>           2.   Learned senior counsel appearing for the appellant<\/p>\n<p>submits that the appellant will be satisfied if the entire matter is<\/p>\n<p>considered by respondent No.3 untrammelled or uninfluenced by any<\/p>\n<p>of the observations made by the learned Single Judge. In other words,<\/p>\n<p>the prayer is that the authority concerned, namely the District<\/p>\n<p>Magistrate, should apply his mind afresh in respect of all the issues<\/p>\n<p>involved in the matter and take an independent decision in accordance<\/p>\n<p>with law and with reference to the materials available on record. We<\/p>\n<p>W.A.No.2059 of 2009.\n<\/p>\n<p>                                 &#8211; 2 &#8211;\n<\/p>\n<p>do not find any reason why that prayer cannot be allowed. In our<\/p>\n<p>view, the prayer is only just and proper in the peculiar facts and<\/p>\n<p>circumstances of the case.     Respondent No.3 shall dispose of the<\/p>\n<p>matter afresh in accordance with law untrammelled or uninfluenced<\/p>\n<p>by any of the observations made by the learned Single Judge and after<\/p>\n<p>affording sufficient opportunity to be heard to all the parties<\/p>\n<p>concerned as expeditiously as possible, at any rate, within one month<\/p>\n<p>from the date of receipt of a copy of this judgment.<\/p>\n<p>            Writ appeal is disposed of in the above terms.<\/p>\n<p>                                      S.R.Bannurmath,<br \/>\n                                       Chief Justice<\/p>\n<p>                                       A.K.
