Kumar, J.  <\/p>\n<p>1.<br \/>\nThis petition filed under Articles 226\/227 of<br \/>\nthe Constitution of India challenges the orders Annexures<br \/>\nP-4, P-6, P-10, P-15, P-20, P-24, P-27 and P-29 inflicting<br \/>\nvarious punishments on the petitioner, which in service<br \/>\njurisprudence are known as &#8220;minor punishments&#8221;.\n<\/p>\n<p>2.<br \/>\nAfter hearing the learned counsel for the<br \/>\nparties, I am of the considered opinion that the order<br \/>\nAnnexure P-4, P-6, P-10 and P-20 cannot be sustained<br \/>\nbecause these orders have been passed after issuance of<br \/>\ncharge-sheets under Regulation 7 of the Haryana State<br \/>\nElectricity Board Employees (Punishment and Appeal)<br \/>\nRegulation, 1990 (hereinafter referred to as<br \/>\n&#8220;regulation&#8221;).\n<\/p>\n<p>3.<br \/>\nA Full Bench of this Court has considered the<br \/>\nquestion as to whether after issuance of charge-sheet<br \/>\nunder Rule 7 of the Haryana Civil Service (Punishment and Appeal) Rules 1987 for inflicting of major penalty, the employer<br \/>\nis entitled to accept the explanation furnished by way of<br \/>\nreply by the delinquent officer and impose a minor penalty<br \/>\nwithout holding any inquiry. It has been held by the Full<br \/>\nBench that after a charge-sheet has been issued to<br \/>\ndelinquent officer for holding departmental inquiry<br \/>\ncontemplating imposition of major penalty, then no<br \/>\nshort-cut method is permissible even for imposing of minor<br \/>\npenalty. It is not disputed that the respondent-Board has<br \/>\nissued charge-sheet to the petitioner for imposition of<br \/>\nmajor penalty and without holding an inquiry accepted his<br \/>\nexplanation for imposing minor penalty. The orders<br \/>\nAnnexure P-4, P-6, P-10 and P-20 have been passed<br \/>\ninflicting minor penalty. Therefore, it is obvious that<br \/>\nsuch a course is not permissible in law as ruled by the<br \/>\nFull Bench of this Court in C.W.P. No. 3661 of 1999<br \/>\n(Dr. K.G. Tiwari, SDO, Animal Husbandry (Retd.) v. State of<br \/>\nHaryana and Ors.) decided on 20th December, 2001.<br \/>\nTherefore, these impugned orders are liable to be quashed.\n<\/p>\n<p>4.<br \/>\nSimilarly, the orders Annexures P-15 and P-24<br \/>\nhave been challenged on the ground that the orders do not<br \/>\nreflect any application of mind and also lack reasons. It<br \/>\nis well settled that under Regulation 4, even minor<br \/>\npunishment cannot be imposed unless there are good and<br \/>\nsufficient reasons. Reasons are sine qua non for every<br \/>\nquasi judicial order as they provide link between the<br \/>\nguilt of the delinquent officer as well as the conclusion<br \/>\nreached by the punishing authority. This aspect is also<br \/>\ncovered by the judgment rendered by this Court in x x x x x<br \/>\nC.W.P. No. 3710 of 1994 titled Digambar Singh v. Haryana<br \/>\nState Electricity Board and Anr. decided on 3.8.1994.<br \/>\nTherefore, these two orders are also liable to be quashed<br \/>\non that ground.\n<\/p>\n<p>5. For the reasons recorded above, orders<br \/>\nAnnexure P-4, P-6, P-10, P-20, P-15 and P-24 are quashed.<br \/>\nHowever, it shall be open to the respondent-Board to take<br \/>\na decision afresh by holding inquiry in respect of the<br \/>\ncases where charge-sheets under Regulation 7 have been<br \/>\nissued or by passing fresh order in case where show-cause<br \/>\nnotices under Regulation 8 for imposing minor penalties<br \/>\nhave been served on the delinquent officer. Therefore,<br \/>\nthe question of consequential relief may also be<br \/>\nconsidered by the Board in case no punishment is imposed<br \/>\non the petitioner. Needless to say that if the<br \/>\nallegations levelled in the charge-sheets are found to be<br \/>\nbaseless, then the Annual Confidential Reports or<br \/>\nconsequences flowing therefrom shall be reviewed and<br \/>\nre-considered.\n<\/p>\n<p>6.
