Justice M.N.KRISHNAN\n\n Dated :28\/09\/2007\n\n O R D E R\n\n\n                              M.N.Krishnan, J.\n\n               ========================\n\n                          C.R.P.No.861 of 2007\n\n               ========================\n\n\n          Dated this the  29th  day of September, 2007.\n\n\n                                    ORDER\n<\/pre>\n<p>      This   revision   petition   is   preferred   against   the   order   of   the<\/p>\n<p>Subordinate   Judge,   Kattappana   whereby,   the   court   directed<\/p>\n<p>delivery   of   possession   of   the   property   to   the   petitioner   therein.<\/p>\n<p>Aggrieved by that decision, the revision petitioners have come up<\/p>\n<p>before this Court.\n<\/p>\n<\/p>\n<p>      2. Brief facts necessary for the disposal of the revision are<\/p>\n<p>that   there   was   a   money   decree   against   the   defendant     and   in<\/p>\n<p>execution   of   the   money   decree,   the   property   belonging   to   the<\/p>\n<p>second   revision   petitioner   was   sold   in   auction,   confirmed,   sale<\/p>\n<p>certificate   issued   and   on   the   strength   of   the   sale   certificate<\/p>\n<p>application for delivery had been filed and it is pending before the<\/p>\n<p>concerned   court.     Learned   counsel   for   the   revision   petitioners<\/p>\n<p>very   strongly   contends   before   me   that   the   petition   is   not<\/p>\n<p>maintainable   as   E.P.   because   delivery   of   the   property   is   to   be<\/p>\n<p><span class=\"hidden_text\">CRP 861\/07                            -: 2 :-<\/span><\/p>\n<p>applied under Order 21 Rule 95 of C.P.C. and since it is not done,<\/p>\n<p>the Execution Petition filed is not maintainable in law and further,<\/p>\n<p>if it is an execution application, it has to be filed only in the E.P.<\/p>\n<p>which   was   pending   before   the   Subordinate   Judge,   Thodupuzha<\/p>\n<p>and therefore the court at Kattappana has no jurisdiction at all to<\/p>\n<p>entertain the matter.\n<\/p>\n<\/p>\n<p>      3. Learned counsel had already relied on  the decision of the<\/p>\n<p>Apex   Court   reported   in    <a href=\"\/doc\/1632704\/\">Ganpat   Singh  v.  Kailash   Shankar<\/a>  &#8211;<\/p>\n<p>A.I.R.   1987   S.C.   1443   where   the   Apex   Court   was   considering<\/p>\n<p>regarding the question of limitation and the applicability of Order<\/p>\n<p>21 Rule 95 of C.P.C.  The Apex Court held that Order 21 Rule 95<\/p>\n<p>of C.P.C. is in the form of an application and not in the form of<\/p>\n<p>original Execution Petition.   The learned counsel also referred to<\/p>\n<p>the   decision   reported   in         <a href=\"\/doc\/1035524\/\">Haneefa       v.     United   Finance<\/p>\n<p>Corporation<\/a>  &#8211; 2006(1) K.L.T. 416. It has to be stated that the<\/p>\n<p>whole   matter   here   had   arisen   on   account   of   the   factum   of   the<\/p>\n<p>establishment   of   Subordinate   Court   at   Kattappana.     There   was<\/p>\n<p>only a court at Thodupuzha and later a court was established at<\/p>\n<p>Kattappana.  The question whether the matter has to go back to<\/p>\n<p>the court at Thodupuzha or Kattappana was a subject matter of<\/p>\n<p><span class=\"hidden_text\">CRP 861\/07                             -: 3 :-<\/span><\/p>\n<p>discussion   and   the   finding   in   R.P.No.342   of   2006   in<\/p>\n<p>C.R.P.No.1099   of  2000.   On consideration  of the  materials,  this<\/p>\n<p>Court has held thus:\n<\/p>\n<\/p>\n<blockquote><p>              &#8220;It   is   held   that   the   Subordinate   Judge&#8217;s   Court,<\/p>\n<p>      Kattappana is having jurisdiction to proceed with the<\/p>\n<p>      matter and that the petition is not to be sent to the<\/p>\n<p>      Sub Court, Thodupuzha which passed the decree.&#8221;<\/p><\/blockquote>\n<p>      4.   It   is   also   clearly   settled   that   when   a   new   court   is<\/p>\n<p>established,   the   transferor   court   or   the   transferee   court   can<\/p>\n<p>exercise   the   jurisdiction   depending   upon   the   facts   and<\/p>\n<p>circumstances   of   each   case.     Here   it   is   on   account   of   the<\/p>\n<p>formation   of   a   new   court   at   Kattappana   that   a   petition   for<\/p>\n<p>delivery had been moved in that court.  One need not have to be<\/p>\n<p>hypertechnical   on   this   point   because   what   is   sought   to   be<\/p>\n<p>achieved is only to  get  the decree of  the court  implemented  by<\/p>\n<p>methods   known   to   law.     The   decision   relied   on   by   the   learned<\/p>\n<p>counsel for the revision petitioner only held about the nature of<\/p>\n<p>the   petition   when   a   question   of   limitation   was   raised     for<\/p>\n<p>consideration.     Here,  no  such  question   arises   and  not  only   that<\/p>\n<p>this   Court   sitting   in   revision,   has   held   that   the   court   at<\/p>\n<p><span class=\"hidden_text\">CRP 861\/07                           -: 4 :-<\/span><\/p>\n<p>Kattappana   can   proceed   with   the   matter.     There   is   no   further<\/p>\n<p>revision   or   Special   Leave   Petition   before   the   Apex   Court   and<\/p>\n<p>therefore, the jurisdictional aspect of the Court at Kattappana has<\/p>\n<p>become   final.     The   court   need   not   defeat   justice   by   simply<\/p>\n<p>permitting the party to have technical arguments of this nature.<\/p>\n<p>      5.
