DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 21\/07\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\t\tThis<br \/>\npetition is directed against the order of detention dated 3.4.2011<br \/>\npassed by respondent no.2, in exercise of powers conferred under<br \/>\nSection 3(2) of the Gujarat Prevention of Anti Social Activities Act,<br \/>\n1985 (in short &#8220;the Act&#8221;) by detaining the detenue as a<br \/>\n&#8220;bootlegger&#8221; as defined under Section 2(b) of the Act.\n<\/p>\n<p>2.\tLearned<br \/>\nadvocate for the detenue submits that registration of FIR\/s itself<br \/>\ncannot lead to disturbance of even tempo of public life and therefore<br \/>\nthe public order. The order of detention is assailed by the detenue<br \/>\non various grounds mentioned in the memo of the petition. However,<br \/>\nlearned counsel for the detenue submits that, except FIR\/s registered<br \/>\nunder the Bombay Prohibition Act, there was no other material before<br \/>\nthe detaining authority whereby it could be inferred reasonably that<br \/>\nthe detenue is a `bootlegger&#8217; within the meaning of Section 2(b) of<br \/>\nthe Act and required to be detained as the detenue&#8217;s activities are<br \/>\nprejudicial to the maintenance of public health and public order. In<br \/>\nsupport of the above submission, learned counsel for the detenue has<br \/>\nplaced reliance on judgment of the Apex Court in the case of Piyush<br \/>\nKantilal Mehta Vs. Commissioner of Police, AIR 1989 Supreme Court 491<br \/>\nand the recent judgment dated 28.3.2011 passed by the Division Bench<br \/>\nof this Court (Coram: S.J.Mukhopadhaya, C.J. &amp; J.B.Pardiwala, J)<br \/>\nin Letters Patent Appeal No.2732 of 2010 in Special Civil Application<br \/>\nNo.9492 of 2010 (Aartiben Vs. Commissioner of Police) which would<br \/>\nsquarely help the detenue.\n<\/p>\n<p>3.\t\tLearned<br \/>\nAssistant Government Pleader submitted that registration of FIR\/s<br \/>\nwould go to show that the detenue had, in fact, indulged into such<br \/>\nactivities, which can be said to be disturbing the public health and<br \/>\npublic order and in view of sufficient material before the detaining<br \/>\nauthority to pass the order of detention, no interference is called<br \/>\nfor by this Court in exercise of its power under Article 226 of the<br \/>\nConstitution of India.\n<\/p>\n<p>4.\t\tHaving<br \/>\nheard the rival submissions of the parties and perused the record of<br \/>\nthe case, I am of the view that FIR\/s registered under the Bombay<br \/>\nProhibition Act alone cannot be said to be sufficient enough to<br \/>\narrive at subjective satisfaction to the effect that the activities,<br \/>\nas alleged, are prejudicial to the public order or lead to<br \/>\ndisturbance of public order. There has to be nexus and link for such<br \/>\nactivities with disturbance of the public order. On careful perusal<br \/>\nof the material available on record and the ratio laid down by the<br \/>\nApex Court in the case of Piyush Kantilal Mehta (supra) and the<br \/>\nrecent judgment dated 28.3.2011 passed by the Division Bench of this<br \/>\nCourt (Coram: S.J.Mukhopadhaya C.J. &amp; J.B.Pardiwala, J) in<br \/>\nLetters Patent Appeal No.2732 of 2010 in Special Civil Application<br \/>\nNo.9492 of 2010 (Artiben Vs.Commissioner of Police), I am of the view<br \/>\nthat the activities of the detenue cannot be said to be in any manner<br \/>\nprejudicial to the public order and therefore, the order of detention<br \/>\npassed by the detaining authority cannot be sustained and is required<br \/>\nto be quashed and set aside.\n<\/p>\n<p>5.\t\tIn<br \/>\nthe result, the petition is allowed. The order of detention dated<br \/>\n3.4.2011 passed by the respondent no.2 is quashed and set aside. The<br \/>\ndetenue, is ordered to be set at liberty forthwith if he is not<br \/>\nrequired in connection with any other case. Rule is made absolute<br \/>\naccordingly.
