 ‘V e ‘}’he ‘ieej\ufb01e\u00e9  ‘~Cl0:u11se1 for the apiaeilantdzlsurance<\/p>\n
  Company eonte\ufb01ci that the Commissioner was not<\/p>\n
 the loss ef earning capacity at 8(}”\/:3. it is<\/p>\n
  c0\ufb01t\u20ac\ufb02\u00e9e\u00e9_.~theit’ the doctor had. seated the clisabiiity only wi\ufb01<\/p>\n
 tei  limisa. when the disability and the percentage of<\/p>\n
   ;}fr\u00a3:arnjng capacity has not bee\ufb02 assessed by the dector,<\/p>\n
  .:\u00a3he__5Commissiener eught not to have considered the same at<\/p>\n

4. The iearned Counsel for the :espon{i’et1ts:Alto1%\u00e9e\u00a7e\u00a7f <\/p>\n
sought to justify the award. The learfted”Cot1i1&se1V.tjo;ti:tt.e <\/p>\n
evidence of the doctor and raise   vto  ._<\/p>\n
that the Commissioner has tile evidet1ee”.bjf~–;e\u00a7tt1’eietingt”<\/p>\n
the same during the course of  -Dtfdefv-.whicii’ woul{i indicate
\nthat the doctor has spoketi’ .’V”‘f_I;e:\u00a7*efQre, noticing the
\nnature of \u00e9isab\ufb02ity  stated\ufb02”    ‘Eu1vocatio11 of the<\/p>\n
ciaimant, t_he…};1a–s i\u00e9gppzoft\ufb02ately granted the<\/p>\n
eompens2\ufb01:io\ufb01”ai\u00a7;d the Saii1eVV’does”_i:6tVca11 for interference.<\/p>\n
‘:i._ ‘H3…  iv\ufb02at has been contended, though in<\/p>\n
 ‘tlte  the’  issue raised cannot be considered as<\/p>\n
 ;.:oe1irf:_  question of law, but the nature of<\/p>\n
eotzgeicieratiolitejefetthe evidence by the Commissioner would have<\/p>\n

    in that context, whether any modi\ufb01cation of the<\/p>\n
  require\u00e9. in this szegaxd, a perusal of the award passed<\/p>\n
” the Commissioner would itz\u00e9icate that the aspect with<\/p>\n
u & regard to the disability and the loss of earning capacity has<\/p>\n

consideration on Issue No.5, which had been  * V. <\/p>\n

6. A perusal of    by the doctor
\nwouid indicate ;ha::;._t;i;e cggcggeihag’::’\u00a7tate\u00a71:fix\u00e9ith regard to the
\nxxature of the   claimant, the treatment
\nmndemd:mem\u00a3\u00a7’;ae\u00a7: that would be face\u00e9. In
\nthis rega1 \ufb02,  faced, the doctor has stated<\/p>\n
ihat the c1airn’:_:eit.weul(i..V1\ufb01ef’~’\u00bb}Vbe abie to stand for a longtime,<\/p>\n
~ walk  hzl.u;\u00a3i.__hevwas aiso not be abie to squat anci sit<\/p>\n
“1egge_d’.a :’\u00ab.JF””:}.I_’\ufb021tEI’, the docter has opined that he wouid<\/p>\n
moi: ‘:,\u00a7\u00a7’ee:i\u00a7:1:%;s%geight and do xaborious job. The doctor has<\/p>\n
also peiate\u20ac1&Vei1rV: to the X-ray and has also stated with regard to<\/p>\n
H u   diegb\ufb02ify amounting to 40\u00b0\/6 to the Iefi: upper iimb and 45%<\/p>\n
‘.’_t;:) \ufb01xebleft lower limb. A3 against the said evidence tendere\u00e9 by<\/p>\n
 ‘eioetor, there is nothing much to discredit the same in the<\/p>\n
 {:r0ss–examix1a’a5o1:1. Therefore, this aspect of the matter would<\/p>\n

Therefore, noticing the nature of the    ._<\/p>\n

\nview, the same requ1re’ s   regard, it would<\/p>\n
