Advocate General for\n            respondents No.1 to 7.<\/pre>\n<p>                   Shri Anshuman Singh, learned counsel for the respondent No.8.<br \/>\n                   Heard on I.A.No.4047\/2010. This application is moved on behalf<br \/>\n            of respondents No.1 to 7 for modification of this Court&#8217;s order dated<br \/>\n            12.3.2007.\n<\/p>\n<p>                   The writ petition is filed as a Public Interest Litigation highlighting<br \/>\n            the inaction on the part of the respondents in not removing the<br \/>\n            encroachment and illegal constructions over the land belonging to Neta<br \/>\n            Subhash Chandra Bose Government Medical College &amp; Hospital,<br \/>\n            Jabalpur (hereinafter referred to as NSCB Medical College &amp; Hospital,<br \/>\n            Jabalpur for short).     It has been inter alia alleged that several<br \/>\n            Government employees including private persons have encroached<br \/>\n            upon the land belonging to the Medical College and made constructions<br \/>\n            over the same without any permission and sanction of the plan from<br \/>\n            concerned authorities which is causing inconvenience to the doctors,<br \/>\n            students, medical staff and the patients of the Medical College. It has<br \/>\n            also been alleged that the encroachments have been made by several<br \/>\n            government employees and private persons and, therefore, direction is<br \/>\n            sought to conduct a survey in the area of the NSCB Medical College &amp;<br \/>\n            Hospital, Jabalpur, and a further direction has been sought to authorities<br \/>\n            to remove the encroachments and to ensure that no further<br \/>\n            encroachment takes place in future.\n<\/p>\n<p>                   This Court vide order dated 12.3.2007 after hearing learned<br \/>\n            counsel for parties, directed that since land belongs to NSCB Medical<br \/>\n            College &amp; Hospital, Jabalpur, the same cannot be encroached by any<br \/>\n            person.   It was further observed that all the encroachments will be<br \/>\n            removed forthwith in accordance with law. Accordingly, the Collector-<br \/>\n            respondent No.4 was directed to initiate action for removal of<br \/>\n            encroachments from the land belonging to NSCB Medical College and<br \/>\n            Hospital, Jabalpur, in accordance with law.\n<\/p>\n<p>        Shri Pathak, learned Dy. Advocate General submitted that<br \/>\npursuant to the orders passed by this Court, respondent No.4 had<br \/>\ninitiated an action for removal of the encroachment but looking to the<br \/>\nlarge number of encroachers i.e. about approximately one thousand in<br \/>\nnumber, it has become difficult to remove the encroachment as they are<br \/>\ncreating law and order problem in the area. It was further submitted by<br \/>\nthe learned Dy. Advocate General that 96.40 hectares of land belong to<br \/>\nNSCB Medical College &amp; Hospital, Jabalpur, out of which 17.71<br \/>\nhectares of land is under encroachment.        District Administration has<br \/>\ndecided to get five hectares of land released from Medical College for<br \/>\nthe purposes of construction of house under JNNURM Scheme. It has<br \/>\nbeen further submitted that if five hectares of land is released, it would<br \/>\nnot adversely affect the expansion plan of Medical College, Jabalpur.<br \/>\nAccordingly, prayer has been made by learned Dy. Advocate General<br \/>\nthat order dated 12.3.2007 be suitably modified.\n<\/p>\n<p>       Having heard the petitioner who is present in person as well as<br \/>\nlearned Dy. Advocate General, we are not inclined to modify the order<br \/>\ndated 12.3.2007.     Admittedly, the land belongs to NSCB Medical<br \/>\nCollege &amp; Hospital, Jabalpur. The aforesaid land cannot be allowed to<br \/>\nbe used by private persons for their residential purposes. From perusal<br \/>\nof application for modification, filed on behalf of respondents, we find<br \/>\nthat a bald statement has been made that if encroachments are<br \/>\nremoved, it will create law and order problem in the area. No particulars<br \/>\nhave been furnished as to when attempts were made to remove the<br \/>\nencroachment and how it resulted in law and order problem.              No<br \/>\nmaterial has been brought on record to show that State Govt. which has<br \/>\nallotted the land to Medical College has taken any decision to get back<br \/>\nthe land from Medical College.      In the application it is averred that<br \/>\ndistrict administration has prepared a proposal. Thus, it is apparent that<br \/>\ncompetent authority i.e. the State Government has not taken any<br \/>\ndecision in this regard. If five acres of land is released and is settled in<br \/>\nfavour of encroachers under JNNURM Scheme, the same would<br \/>\ntantamount to putting premium on the conduct of persons who are<br \/>\ntrespassers and have illegally occupied the land of the NSCB Medical<br \/>\nCollege &amp; Hospital, Jabalpur, and which would make a bad precedence.\n<\/p>\n<p>           The encroachers have no authority in law to remain in occupation of the<br \/>\n          government land and, therefore, if any leniency or discretion is<br \/>\n          exercised in favour of the encroachers, that would be against the<br \/>\n          established principle of equity, justice and fair play. The direction to<br \/>\n          remove the encroachment by this Court was given and, therefore, it is<br \/>\n          amazing rather shocking that though more than three years have<br \/>\n          passed, but no effective steps have been taken so far to remove the<br \/>\n          encroachments. This reflects the lackadaisical and cavalier approach of<br \/>\n          the respondents. We do not appreciate this lackadaisical and cavalier<br \/>\n          approach of the respondents.       Therefore, all the encroachments are<br \/>\n          required to be removed forthwith as has been directed by this Court vide<br \/>\n          order dated 12.3.2007. For the aforementioned reasons, application for<br \/>\n          modification of the order dated 12.3.2007 is rejected.\n<\/p>\n<p>                 Shri Pathak, learned Dy. Advocate General fairly submitted that<br \/>\n          steps were initiated by the Collector for compliance of the order of the<br \/>\n          Court. However, on account of unavoidable circumstances, the order<br \/>\n          passed by the Court could not be implemented.            However, learned<br \/>\n          Dy.Advocate General assures this Court that Collector shall initiate<br \/>\n          action for removal of encroachment on the land belonging to NSCB<br \/>\n          Medical College &amp; Hospital, Jabalpur, and the same would be<br \/>\n          completed expeditiously, preferably, within a period of six months.<br \/>\n          Learned Dy. Advocate General further stated that Collector shall file a<br \/>\n          compliance report with regard to the action taken by him for removal of<br \/>\n          the encroachments.\n<\/p>\n<p>                 In view of the statement made by learned Dy.
