Justice P.R.RAMACHANDRA MENON\n\n Dated :30\/06\/2010\n\n O R D E R\n                    P.R.RAMACHANDRA MENON, J\n                   ---------------------------\n                     W.P(C) No.16304 of 2010-K\n                  ----------------------------\n                Dated this the 30th day of June, 2010.\n\n                            J U D G M E N T\n<\/pre>\n<p>       The petitioners availed housing loan of Rs.45 lakhs from the<\/p>\n<p>first respondent Bank in the year 2006, creating security interest<\/p>\n<p>over the property in question. But the petitioners could not honour<\/p>\n<p>the commitment in repaying the due amount.              In the said<\/p>\n<p>circumstances, there was no other alternative for the Bank, but to<\/p>\n<p>declare the account as &#8216;NPA&#8217; and proceed with further steps invoking<\/p>\n<p>the provisions under the SARFAESI Act; which in turn is subjected to<\/p>\n<p>challenge in this Writ Petition.\n<\/p>\n<p>       2.    When the matter came up for consideration before this<\/p>\n<p>Court on 27.5.2010, coercive steps were intercepted, on condition<\/p>\n<p>that the petitioners deposited a sum of Rs.1 lakh within two weeks.<\/p>\n<p>It is stated as complied with.\n<\/p>\n<p>       3.    The learned counsel for the petitioners submits that the<\/p>\n<p>default was never wilful but because of some unforeseen<\/p>\n<p>circumstances and that earnest efforts are being made by the<\/p>\n<p>petitioners to clear the overdue amount at the earliest.<\/p>\n<p><span class=\"hidden_text\"> W.P(C) No.16304 of 2010-K        2<\/span><\/p>\n<p>       4.    The learned counsel for the Bank submits on the<\/p>\n<p>instructions that, the action pursued by the Bank being strictly in<\/p>\n<p>conformity with the statutory requirements, is not assailable under<\/p>\n<p>any circumstances. The learned counsel further submits that the<\/p>\n<p>total &#8216;overdue&#8217; amount will come to Rs.5.92 lakhs and after<\/p>\n<p>deducting the amount of Rs.1 lakhs already satisfied by the<\/p>\n<p>petitioner pursuant to the interim order, an amount of Rs.4.92 lakhs<\/p>\n<p>plus further interest is liable to be cleared by the petitioner in<\/p>\n<p>respect of the defaulted instalments. Unless and until the said<\/p>\n<p>amount is paid, the question of regularisation is not liable to be<\/p>\n<p>entertained; submits the learned counsel.\n<\/p>\n<p>       5.    Considering the facts and circumstances, the petitioner<\/p>\n<p>is permitted to clear the &#8216;overdue&#8217; amount by way of &#8216;four&#8217; equal<\/p>\n<p>monthly instalments; the first of which shall be effected on or<\/p>\n<p>before the 30th of July, 2010; to be followed by similar instalments<\/p>\n<p>to be effected on or before the 30th of the succeeding months; on<\/p>\n<p>which event, the loan account shall stand regularised. This is in<\/p>\n<p>addition to the liability of the petitioner to clear the regular EMIs.<\/p>\n<p>Subject to the above, all further coercive proceedings pursuant to<\/p>\n<p><span class=\"hidden_text\"> W.P(C) No.16304 of 2010-K         3<\/span><\/p>\n<p>Ext.P4 shall be kept in abeyance.
