RESPONDENTS.\n                              -----------\n<\/pre>\n<p> 02\/   07.07.2011             Petitioner is working as an Assistant teacher<\/p>\n<p>                    in Non-Govt. Middle School, Tulsiyahi, Block &#8211; Kahra<\/p>\n<p>                    in the district of Saharsa. Giving reference to the order<\/p>\n<p>                    passed in C.W.J.C. No. 5278 of 2004 counsel for the<\/p>\n<p>                    petitioner prays that the case of this petitioner stands on<\/p>\n<p>                    similar footing as Ravi Shankar, who was writ<\/p>\n<p>                    petitioner in C.W.J.C. No. 5278 of 2004. This writ<\/p>\n<p>                    application was disposed of analogous with several<\/p>\n<p>                    other cases and the High Court disposed of all these<\/p>\n<p>                    writ applications directing the State Govt. to constitute<\/p>\n<p>                    a Committee, which will examine the cases of teachers<\/p>\n<p>                    working in Non-Govt. Elementary Schools and thus<\/p>\n<p>                    entitled for cost of living allowance as per the<\/p>\n<p>                    government decision. The State of Bihar has decided to<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>       grant cost of living allowance to the teachers of such<\/p>\n<p>       Non-governmental           recognized    schools     in   which<\/p>\n<p>       students have been imparted education up to Class VII.<\/p>\n<p>       The order regarding giving of cost of living allowance<\/p>\n<p>       to any Assistant teacher working in such schools can be<\/p>\n<p>       allowed only after scrutinizing their claim in the light<\/p>\n<p>       of the relevant provisions, rules, regulations and<\/p>\n<p>       circulars of the Govt. as well as considering the factual<\/p>\n<p>       aspect of the matter of this case.\n<\/p>\n<p>                   Accordingly,        this   application   is      being<\/p>\n<p>       disposed of. The petitioner can also represent his case<\/p>\n<p>       before the same Committee, which has been constituted<\/p>\n<p>       by the State of Bihar in the light of the directions issued<\/p>\n<p>       by the High Court in C.W.J.C. No. 5278 of 2004 and<\/p>\n<p>       analogous     cases.
