Sindhi for petitioner and Mr. Anand<br \/>\n\tSharma, learned AGP for respondent State.\n<\/p>\n<p>As<br \/>\n\tper para 8(B) of this petition, petitioner is praying to direct<br \/>\n\trespondent NO.2 to 4 to comply with order dated 13.4.2009 passed by<br \/>\n\tRespondent NO. 5 i.e. Controlling Authority under Payment of<br \/>\n\tGratuity Act, Himmatnagar in Gratuity Case NO. 31 of 2008 and to<br \/>\n\tdirect respondent no.2 to 4 to pay gratuity amount of Rs.2,00,340.00<br \/>\n\twith 10% simple interest from 26.4.2005 to petitioner. Order was<br \/>\n\tpassed by Controlling Authority, Himmatnagar in Gratuity Case NO.31<br \/>\n\tof 2008  dated 13.4.2009 in favour of present petitioner with a<br \/>\n\tdirection to Sathamba Gram Panchayat to pay amount of Gratuity to<br \/>\n\tpetitioner with 10 per cent simple interest with effect from<br \/>\n\t26.4.2005. As said amount has not been paid by Sathamba Gram<br \/>\n\tPanchayat, under section 8 of Payment of Gratuity Act, 1972,<br \/>\n\trecovery certificate has been issued by Controlling Authority in<br \/>\n\tfavour of District Development Officer, Sabarkantha District<br \/>\n\tPanchayat, Himatnagar  dated 21.12.2009.\n<\/p>\n<p>Learned<br \/>\n\tAdvocate Mr. Sindhi for petitioner has submitted that though  more<br \/>\n\tthan one year has passed, effective steps have not been taken by<br \/>\n\tDistrict Development Officer, Sabarkantha District Panchayat,<br \/>\n\tHimatnagar to recover amount of gratuity from Sathamba Gram<br \/>\n\tPanchayat. It is further submitted by learned advocate Mr. Sindhi<br \/>\n\tfor petitioner that order passed by Controlling Authority has not<br \/>\n\tbeen challenged by Sathamba Gram Panchayat before appellate<br \/>\n\tauthority and no stay is operating against order passed by<br \/>\n\tControlling Authority dated 13.4.2009. He also submitted that<br \/>\n\tinspite of serious and sincere efforts made by petitioner, no<br \/>\n\trecovery is effected by District Development Officer, Sabarkantha<br \/>\n\tDistrict Panchayat, Himatnagar to recover amount  of gratuity from<br \/>\n\tSathamba Gram Panchayat as per recovery certificate issued by<br \/>\n\tControlling Authority, Himmatngar dated 21.12.2009.\n<\/p>\n<p>In<br \/>\n\tlight of this back ground and considering fact that workman<br \/>\n\tpetitioner has retired from service and entitled for amount of<br \/>\n\tgratuity with effect from 25.4.2005, from that date, about more than<br \/>\n\tsix years have passed and yet workman has remained without amount of<br \/>\n\tgratuity though order has been passed by Controlling Authority.<br \/>\n\tTherefore, in light of this back ground, it is directed to District<br \/>\n\tDevelopment Officer, Sabarkantha District Panchayat, Himatnagar  to<br \/>\n\texecute recovery certificate issued by Controlling Authority,<br \/>\n\tHimmatnagar dated 21.12.2009  for recovering amount of gratuity  as<br \/>\n\tordered by Controlling Authority from Sathamba Gram Panchayat within<br \/>\n\tperiod of two months from date of receipt of copy of present order<br \/>\n\tand after recovering said amount of gratuity from Sathamba Gram<br \/>\n\tPanchayat, it is directed to District Development Officer,<br \/>\n\tSabarkantha District Panchayat, Himatnagar to deposit said amount<br \/>\n\tbefore Controlling Authority, Himmatnagar and thereafter to<br \/>\n\timmediately communicate about such recovery made from Sathamba Gram<br \/>\n\tPanchayat to petitioner.\n<\/p>\n<p>In<br \/>\n\tview of these observations and directions, this petition is disposed<br \/>\n\tof by this Court without expressing any opinion on merits.
