Respondents.\n                                           ----\n              CORAM :            HON'BLE THE CHIEF JUSTICE\n                              HON'BLE MR.JUSTICE D.K.SINHA\n                                           ---\n              For the Appellant:                 Mr.S.K.Laik.\n              For the Respondents:               J.C. to G.P.I.\n                                             -----\n07\/15.07.2009<\/pre>\n<p>               This appeal has been preferred against the judgment and<br \/>\n                   order of the learned Single Judge who had been pleased to allow<br \/>\n                   the writ petition partly by setting aside the award passed by the<br \/>\n                   Industrial Tribunal in favour of the appellants-workmen to the<br \/>\n                   extent that they would be entitled for payment of compensation<br \/>\n                   for the period during which the respondent-factory was under<br \/>\n                   closure.\n<\/p>\n<p>                              It is relevant to recollect that the specific term of<br \/>\n                   reference which was referred to the Tribunal for adjudication is as<br \/>\n                   follows:-\n<\/p>\n<blockquote><p>                               &#8220;Whether the workmen employed by M\/s. Bajrang Mica<br \/>\n                               Company Private Ltd., Jamdharia, P.O.Chas, District-<br \/>\n                               Bokaro are entitled to get the pay and other benefits for<br \/>\n                               the period of closure from 19.11.1990? If not, what relief<br \/>\n                               they are entitled to?&#8221;<\/p><\/blockquote>\n<p>                                After adjudication of the aforesaid reference, the<br \/>\n                   Tribunal was pleased to hold that the appellants-workmen would<br \/>\n                   be entitled to wages for the period during which factory was<br \/>\n                   under closure but simultaneously was also pleased to hold that<br \/>\n                   the closure was bad in the eye of law. However, there was no<br \/>\n                   positive direction to re-start the factory.\n<\/p>\n<p>                                 The   respondent-management      assailed   the   award<br \/>\n                   passed by the Industrial Tribunal before the learned Single Judge<br \/>\n                   by filing a writ petition and it was contended before the learned<br \/>\n                   Single Judge that although compensation for the period of closure<br \/>\n                   could be held payable by the respondent-management to the<br \/>\n                   appellants-workmen, yet the finding of the Tribunal was perverse,<br \/>\n<span class=\"hidden_text\">                                               2.<\/span><br \/>\n in so far as the finding of fact recorded in regard to the closure<br \/>\nwas bad in the eye of law. The learned Single Judge, therefore,<br \/>\nallowed the writ petition partly and set aside the finding in regard<br \/>\nto the closure meaning thereby that the finding of fact recorded<br \/>\nby the Tribunal holding therein that the closure was bad in the<br \/>\neye of law, was quashed and set aside. However, the learned<br \/>\nSingle Judge was further pleased to hold that the appellants-<br \/>\nworkmen would be entitled to compensation for the period during<br \/>\nwhich they had discharged duty. Thus, the writ petition was<br \/>\npartly allowed in favour of the respondent-management against<br \/>\nwhich this appeal had been preferred by the appellants-workmen.\n<\/p>\n<p>             Learned      counsel   for   the   appellants-workmen<br \/>\nstrenuously emphasized that the award passed by the Industrial<br \/>\nTribunal was fit to be upheld and the learned Single Judge was in<br \/>\nerror in setting aside the same by holding that the closure of he<br \/>\nindustry was justified.\n<\/p>\n<p>             We, however, do not feel persuaded to accept this<br \/>\ncontention for the specific term of reference quoted hereinbefore<br \/>\nclearly indicates that the reference was framed and referred to<br \/>\nthe Tribunal for adjudication of the question only to the extent<br \/>\nwhether compensation would be paid to the appellants-workmen<br \/>\nfor the period during which they had discharged duty although<br \/>\nthe factory was under closure. The reference, however, was also<br \/>\nto the effect as to what other relief or reliefs the workmen could<br \/>\nclaim. But under this Clause, the specific question as to whether<br \/>\nclosure of the factory was justified or not was never the term of<br \/>\nreference before the Tribunal and the Tribunal thus, while holding<br \/>\nthat the appellants-workmen were entitled to compensation for<br \/>\nthe period during which they had discharged duty, exceeded its<br \/>\njurisdiction by holding that the closure was bad in the eye of law.<br \/>\nBesides this, the Tribunal itself has not granted any relief to the<br \/>\nappellants-workmen to the extent that it would be entitled to<br \/>\nassert for re-opening of the industry. Thus, we fully concur with<br \/>\nthe view of the learned Single Judge in so far as the finding of<br \/>\nfact in regard to the closure of the industry is concerned, as<br \/>\ndetermination of the same was clearly beyond the term of<br \/>\nreference.\n<\/p>\n<p>              The learned Single Judge has already allowed the<br \/>\nclaim of compensation\/wages to the appellants-workmen for the<br \/>\n<span class=\"hidden_text\">                             3.<\/span><br \/>\n         period during which they had discharged their duty under closure<br \/>\n         period. Thus, we find no reason for the appellants to assail the<br \/>\n         judgment and order of the learned Single Judge.\n<\/p>\n<p>                     The appeal thus, has no substance.
