No.10152 of 2011\n                           MURARI PANDEY\n                                 Versus\n                         THE STATE OF BIHAR\n                                -----------\n<\/pre>\n<p>02.   19.04.2011           Heard    learned   counsels     for   the   petitioner,<\/p>\n<p>                   informant and the State.\n<\/p>\n<p>                           Petitioner is apprehending his arrest in a case<\/p>\n<p>                   registered under Sections 364, 365\/34 of the I.P.C.<\/p>\n<p>                           The accusation is of taking away the grand son of<\/p>\n<p>                   the informant for extortion purposes.<\/p>\n<p>                           It is submitted by learned counsel for the<\/p>\n<p>                   petitioner that for the alleged occurrence of 11.08.2001<\/p>\n<p>                   the complaint was filed on 21.08.2001 which got<\/p>\n<p>                   registered as police case on 24.08.2001.<\/p>\n<p>                           It is submitted by learned counsel for the<\/p>\n<p>                   petitioner that during investigation the accusation was<\/p>\n<p>                   found false and final form was submitted but differing<\/p>\n<p>                   with the same, cognizance has been taken in the matter.<\/p>\n<p>                   It is further submitted that the informant subsequently<\/p>\n<p>                   retracted form his initial version and has filed a petition<\/p>\n<p>                   to that effect before learned Court below.<\/p>\n<p>                           It is submitted by learned counsel for the<\/p>\n<p>                   informant that in 164 Cr.P.C. statement the victim has<\/p>\n<p>                   supported the accusation and there are evidences in the<\/p>\n<p>                   case diary.\n<\/p>\n<p><span class=\"hidden_text\">                              2<\/span><\/p>\n<p>                   Considering the fact that considering the 164<\/p>\n<p>          Cr.P.C. statement of the victim and other evidence the<\/p>\n<p>          police submitted final form treating the accusation false,<\/p>\n<p>          let the petitioner namely Murari Pandey, in the event of<\/p>\n<p>          his arrest or surrender before the Court below within a<\/p>\n<p>          period   of   12   weeks   from    today,   be   released   on<\/p>\n<p>          anticipatory bail on furnishing bail bond of Rs. 10,000\/-<\/p>\n<p>          (ten thousand) with two sureties of the like amount each<\/p>\n<p>          to the satisfaction of Additional Chief Judicial Magistrate,<\/p>\n<p>          Naugachia in connection with Gopalpur P.S. Case No.<\/p>\n<p>          137 of 2001(G.R.
