                       the judgment of conviction and order of sentence dated<\/p>\n
                       22.12.2003 passed in Sessions Trial No. 76 of 1999 by the<\/p>\n
                       learned Additional Sessions Judge, Fast Track Court No. III,<\/p>\n
                       Bettiah, West Champran whereby he was convicted under<\/p>\n
                       Sections 302 and 201 of the Indian Penal Code and he has<\/p>\n
                       been sentenced to undergo rigorous imprisonment for life under<\/p>\n
                       Section 302 of the Indian Penal Code and he has further been<\/p>\n
                       sentenced to undergo rigorous imprisonment for three years
\n                    2<\/span><\/p>\n
under Section 201 of the Indian Penal Code. It was ordered that<\/p>\n
both the sentences shall run concurrently.<\/p>\n
         2.       The prosecution case, as arises from the<\/p>\n
fardbeyan of the informant Rabindra Prasad is that he is making<\/p>\n
statement on 3.4.1998 at 11.45 P.M. at the Veranda of one<\/p>\n
Yamuna Prasad near the dead body of his son Shrawan Kumar<\/p>\n
before the Sub-Inspector of Police of Chanpatia Police Station<\/p>\n
that on 3.4.1998 his son was playing near his house at Durga<\/p>\n
Mandir but he did not saw his son since 3.00 P.M. and then he<\/p>\n
started making out a search for him but he could not find out and<\/p>\n
thereafter, he went to announce on mike about missing of his<\/p>\n
son in the nearby area but could not find him out. At about half<\/p>\n
past seven in the evening when he returned to his house then at<\/p>\n
8.30 P.M. one Neeraj Kumar (not examined) son of Vermajee<\/p>\n
came and informed that the son of the informant is sleeping in<\/p>\n
the Veranda of Yamuna Prasad. The informant rushed there and<\/p>\n
found his son dead and found froth coming out from the nose of<\/p>\n
his son and on head, face and nose he found the injury of some<\/p>\n
hard blunt substance. On information the police came and on<\/p>\n
the sound of weeping and cry several people collected and one<\/p>\n
Ramesh Prasad son of Yamuna Prasad disclosed that when he<\/p>\n
came after closing his shop then he found a boy sleeping at<\/p>\n
Veranda then he called the lantern from the wife of Vermajee<\/p>\n
and saw Shrawan Kumar lying there, whereas the fact is that ten<\/p>\n
minutes prior to that when Yamuna Prasad came on the
\n                    3<\/span><\/p>\n
Veranda but he did not find Shrawan there. On cry several<\/p>\n
persons collected there but the neighbour Rajendra Prasad<\/p>\n
Patwa and his family members did not come there. The further<\/p>\n
case of the prosecution is that the house of Rajendra Prasad<\/p>\n
Patwa remained close and the informant doubted the complicity<\/p>\n
of Rajendra Prasad Patwa due to old enmity and then Deepak<\/p>\n
Kumar (PW 7), Mahabeer Prasad (not examined) and Pradeep<\/p>\n
Kumar (PW 2) got the door of Rajendra Prasad Patwa opened<\/p>\n
on which they found his bed wet and smell of urine from the bed.<\/p>\n
They also found a blue jersey concealed in wet condition. Jersey<\/p>\n
was seized     and on inquiry about the jersey the appellant<\/p>\n
Rajednra Prasad Patwa and his daughter Dolly Kumari<\/p>\n
remained silent. It was doubted that Dolly Kumari and Rajendra<\/p>\n
Prasad Patwa the appellant might have killed the son of<\/p>\n
informant by hard blunt substance. It is further alleged that<\/p>\n
earlier due to some enmity Dolly Kumari had threatened to kill<\/p>\n
him. Further case is that Dolly Kumari had committed theft in the<\/p>\n
house of Saral Mali which was protested by the daughter-in-law<\/p>\n
of Yamuna Prasad. So it is doubted that the appellant Rajendra<\/p>\n
Prasad Patwa and Dolly Kumari might have committed the<\/p>\n
murder and thrown the dead body in the house of Yamuna<\/p>\n
Prasad to falsely implicate him.\n<\/p>\n
         3.     On the basis of aforesaid fardbeyan of Rabindra<\/p>\n
Kumar the FIR was lodged and after investigation Chargesheet<\/p>\n
was submitted. Consequently cognizance was taken and the
\n                     4<\/span><\/p>\n
case was committed to the Court of Sessions. After commitment<\/p>\n
the charges were framed under Sections 302 and 201 of the<\/p>\n
Indian Penal Code and explained to the appellant to which he<\/p>\n
pleaded not guilty and claimed to be tried.\n<\/p>\n
         4.      During trial eight witnesses were examined on<\/p>\n
behalf of the prosecution; they are Ramesh Prasad (PW 1),<\/p>\n
Pradeep Kumar (PW 2), Mahabeer Prasad (PW 3), Prabhawati<\/p>\n
Devi the mother of the deceased (PW 4), Dr. Sunil Kumar (PW<\/p>\n
5), the informant Rabindra Kumar (PW 6), Deepak Kumar (PW<\/p>\n
7) and Md. Ali (PW 8).\n<\/p>\n
         5.       Documentary evidences adduced on behalf of<\/p>\n
the prosecution are: Signature of Pradeep Kumar on inquest<\/p>\n
report (Ext.1), signature of Mahabeer Prasad on seizure list (Ext.<\/p>\n
1\/1), signature of Pradeep Kumar on seizure list (Ext. 1\/2), post<\/p>\n
mortem examination report (Ext.2), fardbeyan (Ext.3), seizure<\/p>\n
list (Ext.4), inquest report (Ext.5) and formal FIR (Ext. 6).<\/p>\n
         6.    On consideration of oral & documentary evidence<\/p>\n
the learned trial Court convicted and sentenced the sole<\/p>\n
appellant as stated above at the outset.\n<\/p>\n
         7.   The Amicus Curie appearing for the appellant<\/p>\n
contended that except the doubt there is no legal evidence to<\/p>\n
infer that prosecution has proved the case beyond reasonable<\/p>\n
doubt.\n<\/p>\n
         8.     The learned counsel for the State however,<\/p>\n
contended that the prosecution has proved its case beyond
\n                     5<\/span><\/p>\n
reasonable doubt.\n<\/p>\n
         9.         Hence on the respective submissions of the<\/p>\n
parties the question for consideration is whether the prosecution<\/p>\n
has been able to prove the charges beyond all reasonable<\/p>\n
doubts or not.\n<\/p>\n
         10.     PW 1 in his evidence has stated that he saw the<\/p>\n
child sleeping then he called his neighbour Vermajee and his<\/p>\n
wife and disclosed that the child is of Rabindra Prasad. It was<\/p>\n
about 8.30 P.M. on 3.4.1998 and thereafter, Rabindra Prasad<\/p>\n
and his wife came and started weeping as the child was dead<\/p>\n
and froth was coming out from mouth. The police informed and<\/p>\n
search was made in the house of appellant Rajendra Prasad<\/p>\n
Patwa as he has not come at the site of the occurrence and<\/p>\n
from the house the blue jersey was recovered from his house<\/p>\n
which was identified by the wife of Rabindra Prasad. However,<\/p>\n
this witness in cross-examination has stated that he had not<\/p>\n
entered into the house of the appellant but he saw Office In-<\/p>\n
Charge coming out from the house of Rajendra Prasad Patwa<\/p>\n
with the said jersey. He has also stated that by the side of the<\/p>\n
house of the appellant Rajendra Prasad Patwa there is house of<\/p>\n
Saran Mali.\n<\/p>\n
         11.     PW 2 Pradeep Kumar however, supported the<\/p>\n
prosecution case regarding recovery of the dead body of the<\/p>\n
deceased but he has stated that the house of Rajendra Prasad<\/p>\n
Patwa is adjoining to the house of Yamuna Prasad and he saw
\n                    6<\/span><\/p>\n
that the pant of the deceased was wet. However, this witness<\/p>\n
has stated that there was search and seizure of the house of<\/p>\n
Rajendra Prasad Patwa but he did not enter into the house and<\/p>\n
a blue jersey was recovered from the house of Rajendra Prasad<\/p>\n
Patwa. He has proved his signature on the seizure list which has<\/p>\n
been marked as Ext. 3. This witness though is the witness of the<\/p>\n
seizure list and has proved his signature on the seizure list but<\/p>\n
he has stated that he had not been to the house of Rajendra<\/p>\n
Prasad Patwa during search and hence not reliable on this<\/p>\n
point. This witness in his cross-examination has stated that the<\/p>\n
paper which was being written by Daroga was printed one and<\/p>\n
he signed on the said paper at the instance of Daroga and on<\/p>\n
the said paper Deepak has also signed.\n<\/p>\n
         12.     PW 3 in his evidence has stated that a jersey<\/p>\n
and a half paint were recovered from the house of Saral Bhagat<\/p>\n
and Daroga has prepared the seizure list and after reading the<\/p>\n
same he signed on the same. His signature on the seizure list<\/p>\n
has been marked as Ext.1\/1 and the signature of Pradeep<\/p>\n
Kumar has been marked as Ext.1\/2. He has also stated that the<\/p>\n
inquest report of the deceased Shrawan Kumar was prepared<\/p>\n
before him which was prepared in carbon copy and he has<\/p>\n
proved the signature on the carbon copy of the same. In cross-<\/p>\n
examination he stated that Saral Bhagat is not the accused in<\/p>\n
this case and there is a wall in between the house of Saral<\/p>\n
Bhagat and Rajendra Prasad Patwa.\n<\/p>\n
                      7<\/span><\/p>\n
         13.   PW4 is the mother of the deceased and she has<\/p>\n
stated that Shrawan aged about four years was playing by the<\/p>\n
side of the Mandir but he became traceless and an<\/p>\n
announcement was made on mic and then Neeraj Kumar came<\/p>\n
and disclosed that her son was lying on the Veranda of Yamuna<\/p>\n
Prasad. When she went there then found froth was coming out<\/p>\n
from the mouth and nose and found him dead. There is injury<\/p>\n
on his head and face. Thereafter, the police came and arrested<\/p>\n
Dolly Kumari and Rajendra Prasad Patwa. She has stated that<\/p>\n
Dolly Kumari was of suspicious character and has threatened to<\/p>\n
kill her son and she has also committed theft. This witness has<\/p>\n
stated that she doubts that Dolly Kumari had murdered his son<\/p>\n
and further on question she has stated that she doubts that<\/p>\n
Rajendra Prasad Patwa and Dolly Kumari have murdered her<\/p>\n
son.\n<\/p>\n
         14.   Now from the evidence of this witness only fact<\/p>\n
comes out that her son was missing while he was playing by the<\/p>\n
side of Mandir and later on his body was found in the Veranda of<\/p>\n
Yamuna Prasad and when she came there then she found him<\/p>\n
dead. She has further stated about the enmity with Dolly and<\/p>\n
Rajendra Prasad Patwa      and she doubts their hands in the<\/p>\n
murder of her son.\n<\/p>\n
         15.   PW 5 Dr. Sunil Kumar has conducted autopsy on<\/p>\n
the person of the deceased and found external injuries. He<\/p>\n
found rigor mortis was present, two abrasion of size 1 1\/2″ and
\n                    8<\/span><\/p>\n
1\/2″ x 1\/2″ at the base of the neck, two bruises of size 1\/2″, 1<\/p>\n
1\/2″ x 1\/2″ at the right side of skull and one abrasion on nose<\/p>\n
1\/2″ x 1\/2″. On dissection of the dead body blood and blood<\/p>\n
clots were found present beneath the injury no. 2. There was<\/p>\n
lenial fracture of skull and there was subdural haematoma and<\/p>\n
time elapsed since death and post mortem was within 24 hours.<\/p>\n
However, it is pertinent to mention here that the post mortem<\/p>\n
was conducted on 4.4.1998 at 11.00 AM and death ceased to<\/p>\n
be within 24 hours i.e. in between 11 AM on 4.4.19098 to !! AM<\/p>\n
3.4.1998.\n<\/p>\n
         16.      PW 6 is the informant. This witness in his<\/p>\n
evidence has also stated that his son was found missing while<\/p>\n
he was playing nearby Durga Mandir and he announced on<\/p>\n
loudspeaker regarding his missing and the dead body was found<\/p>\n
at the Veranda of Yamuna Prasad. This witness has stated that<\/p>\n
he found the smell of urine and blue jersey was recovered from<\/p>\n
the house of the appellant Rajendra Prasad Patwa which<\/p>\n
belongs to his son. This witness has further stated about the<\/p>\n
enmity with Dolly Kumari and Rajendra Prasad Patwa as stated<\/p>\n
by PW 4 the mother of the deceased.\n<\/p>\n
         17.    PW 7 is Deepak Kumar. He has also stated the<\/p>\n
same fact about the finding the body of the deceased at the<\/p>\n
Veranda of     Yamuna Prasad, however, he is the seizure list<\/p>\n
witness. He has stated that one jersey of blue colour was<\/p>\n
recovered from the house of Saral Bhagat which was identified
\n                   9<\/span><\/p>\n
by Rabindra Prasad.\n<\/p>\n
        18. PW 8 is the formal witness. Hence from the entire<\/p>\n
evidence it is apparent that there is no eye-witness to the<\/p>\n
occurrence. None of the witnesses has seen either the assault<\/p>\n
on the person of the deceased or the manner in which the<\/p>\n
occurrence took place. However, only fact emerged that the<\/p>\n
dead body of deceased Shrawan Kumar was found at 8.30 P.M.<\/p>\n
at the Veranda of Yamuna Prasad and thereafter it was<\/p>\n
informed to PW 4, the mother of the deceased, and then<\/p>\n
Rabindra Prasad, the informant, and PW 6 and his wife PW 4<\/p>\n
came and found the deceased dead. Thereafter, they doubted<\/p>\n
about the hands of Rajendra Prasad Patwa and his daughter<\/p>\n
Dolly Kumari and the second circumstance is that the whole of<\/p>\n
the neighbours came to the place of occurrence but Rajendra<\/p>\n
Prasad Patwa and his daughter Dolly Kumari did not come. It<\/p>\n
has come that the informant doubted and then the door of<\/p>\n
Rajendra Prasad Patwa was got opened by the witnesses and it<\/p>\n
is alleged that the bed of Rajendra Prasad Patwa was found wet<\/p>\n
and smell of urine was coming from the same. However, it has<\/p>\n
further come that a blue jersey of the boy was recovered from<\/p>\n
the courtyard in between the house of Rajendra Prasad Patwa<\/p>\n
and Saral Bhagat. However, some of the witnesses have stated<\/p>\n
that seizure was from the house of Rajendra Prasad Patwa and<\/p>\n
some of the witnesses have stated that the seizure was from the<\/p>\n
house of Saral Bhagat and hence, though there is no witness to
\n                    10<\/span><\/p>\n
the occurrence, none has seen that how he was taken over,<\/p>\n
none has seen that how Shrawan Kumar was lying at the<\/p>\n
Veranda of Yamuna Prasad and nor anyone has seen that how<\/p>\n
he came there and only evidence is that he was found lying<\/p>\n
dead at the Veranda of Yamuna Prasad. However, the evidence<\/p>\n
is that when the dead body was recovered and information was<\/p>\n
given to the people then there was a hue and cry but Rajendra<\/p>\n
Prasad Patwa did not come out of his house. However, it has<\/p>\n
come in evidence of the prosecution witnesses itself that there<\/p>\n
was enmity between the informant and Rajendra Prasad Patwa<\/p>\n
as the daughter of Rajendra Prasad Patwa is alleged to have<\/p>\n
committed theft and further that Dolly Kumari was exposed for<\/p>\n
the theft and hence that is the reason Rajendra Prasad Patwa<\/p>\n
may not have come at the place of occurrence and from that fact<\/p>\n
inference cannot be drawn that it is a chain of circumstance to<\/p>\n
prove that the guilt is proved. The third circumstance is that the<\/p>\n
blue jersey was alleged to be recovered       from the house of<\/p>\n
Rajendra Prasad Patwa, but the said jersey was recovered from<\/p>\n
the wall in between the house of Saral Mali and Rajendra<\/p>\n
Prasad Patwa. However, there were three circumstances which<\/p>\n
are not sufficient to form a chain of circumstances to draw an<\/p>\n
irresistible conclusion for the guilt of accused. Since this is a<\/p>\n
case in which there is no eye witness to the occurrence or to<\/p>\n
any part of the occurrence, hence, this case comes in the<\/p>\n
category of circumstantial evidence. The three circumstances
\n                    11<\/span><\/p>\n
are only that the dead body was found on the Veranda, the<\/p>\n
appellant Rajendra Prasad Patwa did not come after recovery of<\/p>\n
the dead body at the place of dead body found on hue and cry<\/p>\n
and the third is a blue jersey having been alleged to be<\/p>\n
recovered from the wall in between the house of Rajendra<\/p>\n
Prasad Patwa and Saral Mali.\n<\/p>\n
         19.   Now the question is whether these three facts<\/p>\n
complete the chain of circumstance which proves the guilt of<\/p>\n
accused in all probabilities to come to an irresistible conclusion<\/p>\n
that the appellant has done the death and that Rajendra Prasad<\/p>\n
Patwa can be held guilty of the murder.\n<\/p>\n
         20.   It is true that it is a matter of great regret that a<\/p>\n
cold blooded murder go unpunished, but, however strong a<\/p>\n
doubt may be, it cannot take the place of proof and there is a<\/p>\n
great distance between may be proof and must be proof and this<\/p>\n
distance of may be proof and must be proof, has to be traveled<\/p>\n
by reliable, cogent and unimpeachable evidence and a doubt<\/p>\n
may not be treated as proof, but proof must be beyond all<\/p>\n
reasonable doubts. The evidences on record show that there is<\/p>\n
no eye witness to any part of the occurrence, none has seen<\/p>\n
deceased Shrawan Kumar in the house of Rajendra Prasad<\/p>\n
Patwa or that his daughter took him away or taking him back<\/p>\n
and the three circumstances which emerge from the prosecution<\/p>\n
evidences are not sufficient to conclude that the chain of<\/p>\n
circumstances is established pointing out the guilt of the
\n                                                12<\/span><\/p>\n
                          appellant Rajendra Prasad Patwa to hold him guilty of the said<\/p>\n
                          murder.\n<\/p>\n
                                    21. Hence, taking into consideration the entire<\/p>\n
                          circumstances of the case, we find and hold that the prosecution<\/p>\n
                          has not been able to establish the charges levelled against the<\/p>\n
                          appellant beyond all reasonable doubts and the learned trial<\/p>\n
                          Court erred in holding him guilty merely on the basis of<\/p>\n
                          conjectures and surmises that the accused has been guilty.<\/p>\n
                          Hence, the judgment of conviction and sentence is set side and<\/p>\n
                          the appellant is ordered to be released forthwith, if not wanted in<\/p>\n
                          any other case.\n<\/p>\n
                                    22.     In the result, this appeal is allowed.\n<\/p>\n
                                    23.     Let a copy of this judgment be served to Mrs.<\/p>\n
                          Veena Kumari Jaiswal, Advocate, Amicus Curiae who will get<\/p>\n
                          her remuneration as per the provision from the Patna High Court<\/p>\n
