WADHWA\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Though hotices  have been\tserved, respondents  are not<br \/>\nappearing either in person of through counsel.\n<\/p>\n<p>     Leave granted.\n<\/p>\n<p>     Notification under Section 4(1) of the Land Acquisition<br \/>\nAct, 1894  (for short, the `Act&#8217;) was published on September<br \/>\n26, 1981  for public  purpose, namely,\testablishment of Bus<br \/>\nDepot\/Stand in\tGadwal Town  of\t Mehaboobnagar\tDistrict  in<br \/>\nState of Andhra Pradesh. The Land Acquisition Officer in his<br \/>\naward dated  December 27,  1983 awarded\t compensation at the<br \/>\nrate of Rs.8.000\/- per. On reference, the Civil Court by its<br \/>\naward and  decree dated\t November  15,\t1985,  enhanced\t the<br \/>\ncompensation to\t Rs.20\/- per sq. yd. On appeal, the Division<br \/>\nBench of  the  A.P.  High  Court  in  Appeal  No.2391\/86  by<br \/>\njudgment and  decree dated  August 8, 1996 has confirmed the<br \/>\nsame. Thus, this appeal, by special leave.\n<\/p>\n<p>     The High  Court has relied upon Ex.A-4 the sale wherein<br \/>\nrelated to  a small piece of land, and accordingly confirmed<br \/>\nthe market  value @  Rs.20\/- per  sq. yd.  It  is  now\twell<br \/>\nsettled legal  position that  small pieces  of\tland  cannot<br \/>\noffer the  same market\tvalue when  a large track of land is<br \/>\npurchased in  an  open\tmarket\tby  a  willing\tand  prudent<br \/>\npurchased in  an  open\tmarket\tby  a  willing\tand  prudent<br \/>\npurchaser. It  is settled  legal position that the Court has<br \/>\nto put itself in the armchair of a prudent purchaser and put<br \/>\nthe question  to itself\t whether  the  land,  in  the  given<br \/>\ncircumstances, would  fetch the\t same  market  value  as  is<br \/>\nlikely to  be determined  by the  court when  small piece of<br \/>\nland would  be offered\tfor sale.  Unfortunately,  the\tHigh<br \/>\nCourt  has   not  adopted  that\t principle;  it\t has  merely<br \/>\nproceeded to  rely upon\t sale deed relating to a small piece<br \/>\nof land.  We have  gone through\t the award of the Collector.<br \/>\nThe Collector  referred to various sale deeds and ultimately<br \/>\nhe relied upon a sale transaction and held that the lands in<br \/>\nthe sale  deed at Sl. No. 120, pertaining to survey Nos.854,<br \/>\nwhich fetched  the rate of Rs.4,519-77 as on the date of the<br \/>\nsale, namely, December 27, 1978 was comparable one. The Land<br \/>\nAcquisition  Officer  noted  that  the\tlands  therein\twere<br \/>\nconverted into\tnon-agricultural  lands\t and  the  lands  in<br \/>\nquestion still\tremained to  be agricultural  lands and were<br \/>\nadjacent to  Gadwal  Town.  Under  these  circumstances,  he<br \/>\nawarded the  market value  at the rate of Rs.800\/- per acre.<br \/>\nIt is  settled legal  position that  the burden\t is  on\t the<br \/>\nclaimant to prove by adducing acceptable evidence for higher<br \/>\ncompensation. Having  rejected\tEx.A-4\trelied\ton  by\tHigh<br \/>\nCourt, though  the award  of Land Acquisition Officer is not<br \/>\nevidence  stricto  sensu  with\ta  view\t to  do\t substantial<br \/>\nJustice. We  looked into  it  and  considered  the  material<br \/>\ncollected therein.  Having regard  to the  state of evidence<br \/>\nand large  extent of  the land\tin question  as also and the<br \/>\nfacts, we  think that  the appropriate market value would be<br \/>\nRs.20,000\/- per\t acre  and  would  be  just  and  reasonable<br \/>\ncompensation.\n<\/p>\n<p>     The appeal\t is accordingly\t allowed. The  order of\t the<br \/>\nreference Court as confirmed by the High Court is set aside.<br \/>\nInstead, the  award shall  be substituted by Rs.20,000\/- per<br \/>\nacre with  usual solatium at the rate of 30% and interest on<br \/>\nenhanced compensation  at the  rate of 9% per annum from the<br \/>\ndate of\t taking possession  to the  date of  payment of such<br \/>\nenhanced compensation and at the rate of 15% thereafter till<br \/>\ndeposit of  enhanced compensation  into the court.
