PUBLIC PROSECUTOR\nfor\nAppellant(s) : 1, \nNone for Opponent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 09\/12\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>The<br \/>\n\tappellant-State of Gujarat, has preferred the present appeal under<br \/>\n\tSection 378 of the Code of Criminal Procedure, 1973 against the<br \/>\n\tjudgment and order of acquittal dated 27th March 2009<br \/>\n\tpassed by the learned Additional Principal Judge, Court No.2,<br \/>\n\tAhmedabad in Criminal Appeal No.75 of 2008, whereby the learned<br \/>\n\tJudge has quashed and set aside the judgment and order of conviction<br \/>\n\tdated 08th August 2008 passed by the learned Metropolitan<br \/>\n\tMagistrate, Court No.11, Ahmedabad in Criminal Case No.174 of 2005,<br \/>\n\tand acquitted the respondent-accused of the charges levelled against<br \/>\n\thim.\n<\/p>\n<p>The<br \/>\n\tshort facts of the prosecution case is that on 19th<br \/>\n\tDecember 2004 original complainant-M.D. Waghela, Police Sub<br \/>\n\tInspector, Immigration, Sardar Vallabhbhai Patel International Air<br \/>\n\tPort, Ahmedabad was on duty. It is the case of the complainant that<br \/>\n\ton checking, one passenger of Flight No.A.I. 121 found with British<br \/>\n\tPassport No.492668057, who was residing at Belgium. When it was<br \/>\n\tinquired as to how he had obtain British Passport, he explained that<br \/>\n\tby giving 2000 Euro he had obtained British Passport from one<br \/>\n\tPakistani citizen. It is the case of the complainant that said Shri<br \/>\n\tRameshbhai Patel had used the said Passport and came to India from<br \/>\n\tParis on 10th December 2004 and on 19th<br \/>\n\tDecember 2004 while he tried to go to Paris, said Shri Patel was<br \/>\n\tstopped at Mumbai. It is also the case of the complainant that on<br \/>\n\tinquiry it was found that the Passport was bogus. Thus, by using<br \/>\n\tbogus Passport, the respondent-accused had obtained Indian Visa and<br \/>\n\ttried to go to Paris from Ahmedabad. Therefore, FIR being C.R.<br \/>\n\tNo.I-318 of 2004 came to be registered with Sardarnagar Police<br \/>\n\tStation for the offences punishable under Sections 120(B), 201, 420,<br \/>\n\t465, 467, 468 and 471 of the Indian Penal Code and under Sections<br \/>\n\t10(3)(f) and 12 of the Indian Passport Act.\n<\/p>\n<p>On<br \/>\n\tthe basis of complaint, investigation was carried out. On completion<br \/>\n\tof the investigation, since the Investigating Officer found<br \/>\n\tprima-facie case against the respondent-accused, charge-sheet came<br \/>\n\tto be filed before competent court and was registered as Criminal<br \/>\n\tCase No.174 of 2005.\n<\/p>\n<p>Thereafter,<br \/>\n\tcharge was framed against the respondent-accused by the learned<br \/>\n\tMetropolitan Magistrate, Court No.11, Ahmedabad. Thereafter, charge<br \/>\n\twas read over and statement of respondent-accused came to be<br \/>\n\trecorded wherein the respondent-accused pleaded not guilty and<br \/>\n\tclaimed to be tried.\n<\/p>\n<p>The<br \/>\n\tprosecution has examined 63 witnesses and relied upon their oral<br \/>\n\tevidence. The prosecution has also produced 52 documents to prove<br \/>\n\tthe case against the respondent-accused. Thereafter, when the<br \/>\n\tprosecution has filed closing pursis, the learned Magistrate<br \/>\n\trecorded further statement of the respondent-accused under Section<br \/>\n\t313 of the Code of Criminal Procedure, 1973. The respondent-accused<br \/>\n\tdenied the case of the prosecution and submitted that he has been<br \/>\n\troped in a false case.\n<\/p>\n<p>Thereafter<br \/>\n\tthe trial was conducted before the learned Magistrate. After hearing<br \/>\n\tboth the sides, the learned<br \/>\n\tMagistrate by his order dated 08th August<br \/>\n\t2008 convicted the respondent-accused for the offences punishable<br \/>\n\tunder Sections 465, 467, 468 and 471 of the Indian Penal Code and<br \/>\n\tsentenced him to undergo simple imprisonment for a period of one<br \/>\n\tyear and also imposed fine amount of Rs.05,000\/-, and in default of<br \/>\n\tpayment of fine, ordered to undergo simple imprisonment for a<br \/>\n\tfurther period of one month. The learned Magistrate also convicted<br \/>\n\tthe respondent-accused for the offences punishable under Section<br \/>\n\t10(3)(f) and 12 of the Indian Passport Act and sentenced him to<br \/>\n\tundergo simple imprisonment for a period of three months and also<br \/>\n\timposed fine of Rs.01,000\/-, and in default of payment of fine,<br \/>\n\tordered to undergo simple imprisonment for a period of 15 days.\n<\/p>\n<p>Being<br \/>\n\taggrieved by and dissatisfied with the said Judgment and Order of<br \/>\n\tconviction and sentence dated 08th August 2008 passed by<br \/>\n\tthe learned Metropolitan Magistrate, Court No.11, Ahmedabad in<br \/>\n\tCriminal Case No.174 of 2005, the present respondent-accused has<br \/>\n\tpreferred Criminal Appeal No.75 of 2008 before the learned City<br \/>\n\tSessions Court, Ahmedabad wherein the learned Additional Principal<br \/>\n\tJudge, Court No.2, Ahmedabad by his order dated 27th<br \/>\n\tMarch 2009 was pleased to set aside the judgment and order of<br \/>\n\tconviction and sentence dated 08th August 2008 passed by<br \/>\n\tthe learned Metropolitan Magistrate, Court No.11, Ahmedabad in<br \/>\n\tCriminal Case No.174 of 2005 and was pleased to acquit the present<br \/>\n\trespondent-accused.\n<\/p>\n<p>Being<br \/>\n\taggrieved and dissatisfied with the said Judgment and Order of<br \/>\n\tacquittal dated 27th March 2009 passed by the learned<br \/>\n\tAdditional Principal Judge, Court No.2, Ahmedabad in Criminal Appeal<br \/>\n\tNo.75 of 2008, the appellant-State of Gujarat, has preferred the<br \/>\n\tabove mentioned Criminal Appeal.\n<\/p>\n<p>Heard<br \/>\n\tMr.H.L. Jani, learned Additional Public Prosecutor, appearing on<br \/>\n\tbehalf of the appellant-State and Mr.R.C. Jani, learned counsel for<br \/>\n\tthe respondent-accused. I have also gone through the papers and the<br \/>\n\tJudgment and Orders passed by both the Courts below.\n<\/p>\n<p>Mr.H.L.\n<\/p>\n<p>\tJani, learned Additional Public Prosecutor for the appellant, has<br \/>\n\ttaken me through the evidence of prosecution witnesses and the<br \/>\n\tdocumentary evidence and submitted that from the above evidence it<br \/>\n\tis established that the prosecution has successfully proved its case<br \/>\n\tbeyond reasonable doubt. He has contended that the the learned<br \/>\n\tMagistrate has properly appreciated the facts of the case and has<br \/>\n\tpassed absolutely just and proper order of conviction and sentence.<br \/>\n\tHe has also contended that the learned Additional Principal Judge<br \/>\n\thas not properly appreciated the case of the prosecution and has<br \/>\n\tacquitted the respondent-accused. He has also contended that the<br \/>\n\tlearned Judge has not given sufficient opportunity to the<br \/>\n\tprosecution to examine material witnesses. He has further contended<br \/>\n\tthat the respondent-accused has failed to produce on record any<br \/>\n\tevidence. He has also contended that there is no reason to<br \/>\n\tdisbelieve the evidence and statements of witnesses produced on<br \/>\n\trecord by the prosecution. He, therefore, contended that the order<br \/>\n\tdated 27th March 2009 passed by the learned Additional<br \/>\n\tPrincipal Judge, Court No.2, Ahmedabad may kindly be quashed and set<br \/>\n\taside.\n<\/p>\n<p>Mr.R.C.\n<\/p>\n<p>\tJani, learned counsel for the respondent-accused has vehemently<br \/>\n\topposed the present appeal and argued that the order of acquittal<br \/>\n\tpassed by the learned Additional Principal Judge is absolutely just<br \/>\n\tand proper. The learned Judge has after appreciating all the<br \/>\n\tevidence and statements produced on record, acquitted the<br \/>\n\trespondent-accused.\n<\/p>\n<p>I<br \/>\n\thave gone through the judgment and order of the trial Court as well<br \/>\n\tas Sessions Court. I have also perused the reasons assigned by both<br \/>\n\tthe Courts below.\n<\/p>\n<p>At<br \/>\n\tthe outset it is required to be noted that the principles which<br \/>\n\twould govern and regulate the hearing of appeal by this Court<br \/>\n\tagainst an order of acquittal passed by the trial Court have been<br \/>\n\tvery succinctly explained by the Apex Court in a catena of<br \/>\n\tdecisions. In the case of<br \/>\n\tM.S. Narayana Menon @ Mani Vs. State of Kerala &amp; Anr, reported<br \/>\n\tin (2006)6 SCC, 39,<br \/>\n\tthe Apex Court has narrated about the powers of the High Court in<br \/>\n\tappeal against the order of acquittal.\n<\/p>\n<p>Thus,<br \/>\n\tit is a settled principle that while exercising appellate power,<br \/>\n\teven if two reasonable conclusions are possible on the basis of the<br \/>\n\tevidence on record, the appellate court should not disturb the<br \/>\n\tfinding of acquittal recorded by the Courts below.\n<\/p>\n<p>Even<br \/>\n\tin a recent decision of the Apex Court in the case of State<br \/>\n\tof Goa Vs. Sanjay Thakran &amp; Anr. Reported in (2007)3 SCC 75,<br \/>\n\tthe Court has reiterated the powers of the High Court in such cases.\n<\/p>\n<p>Similar<br \/>\n\tprinciple has been laid down by the Apex Court in the cases of State<br \/>\n\tof Uttar Pradesh Vs. Ram Veer Singh &amp; Ors, reported in 2007 AIR<br \/>\n\tSCW 5553 and<br \/>\n\tin Girja<br \/>\n\tPrasad (Dead) by LRs Vs. state of<br \/>\n\tMP, reported in 2007 AIR SCW 5589.\n<\/p>\n<p>\tThus, the powers which this Court may exercise against an order of<br \/>\n\tacquittal are well settled.\n<\/p>\n<p>It<br \/>\n\tis also a settled legal position that in acquittal appeal, the<br \/>\n\tappellate court is not required to re-write the judgment or to give<br \/>\n\tfresh reasoning, when the reasons assigned by the Court below are<br \/>\n\tfound to be just and proper. Such principle is laid down by the Apex<br \/>\n\tCourt in the case of State<br \/>\n\tof Karnataka Vs. Hemareddy, reported in AIR 1981 SC 1417.\n<\/p>\n<p>Thus,<br \/>\n\tin case the appellate court agrees with the reasons and the opinion<br \/>\n\tgiven by the lower court, then the discussion of evidence is not<br \/>\n\tnecessary.\n<\/p>\n<p>I<br \/>\n\thave gone through<br \/>\n\tthe judgment and order passed by the trial Court as well as of the<br \/>\n\tSessions Court. I have also perused the oral as well as documentary<br \/>\n\tevidence led before the Courts below and also considered the<br \/>\n\tsubmissions advanced by the learned counsel for the parties.\n<\/p>\n<p>After<br \/>\n\tappreciating the oral as well as documentary evidence, the learned<br \/>\n\tAdditional Principal Judge has observed that the learned<br \/>\n\tMetropolitan Magistrate has improperly come to a conclusion that<br \/>\n\tthere was a contravention of the provisions by the<br \/>\n\trespondent-accused on the basis of an uncorroborated fax message and<br \/>\n\tthat too a xerox copy of such fax message without any supporting<br \/>\n\tevidence whatsoever being relied upon by the prosecution in that<br \/>\n\tregard. It is also observed by the learned Additional Principal<br \/>\n\tJudge that the learned Metropolitan Magistrate has wrongly come to a<br \/>\n\tconclusion that contravention as contemplated under Section 10(3)(f)<br \/>\n\tof the Indian Passports Act was committed by the respondent-accused<br \/>\n\twithout examining any expert or relevant witnesses from the British<br \/>\n\tHigh Commission in that regard. It is also observed that the<br \/>\n\tprosecution has failed to prove beyond reasonable doubt the case<br \/>\n\tagainst the respondent-accused. The learned Additional Principal<br \/>\n\tJudge has observed that there are serious lacuna in the oral as well<br \/>\n\tas documentary evidence of prosecution. Nothing is produced on<br \/>\n\trecord of this appeal to rebut the concrete findings of the Court<br \/>\n\tbelow.\n<\/p>\n<p>Thus,<br \/>\n\tthe appellant could not bring home the charges against the<br \/>\n\trespondent-accused in the present appeal. The prosecution has<br \/>\n\tmiserably failed to prove the case against the respondent-accused.<br \/>\n\tThus, from the evidence itself it is established that the<br \/>\n\tprosecution has not proved its case beyond reasonable doubt.\n<\/p>\n<p>Mr.H.L.\n<\/p>\n<p>\tJani, learned Additional Public Prosecutor, is not in a position to<br \/>\n\tshow any evidence to take a contrary view in the matter or that the<br \/>\n\tapproach of the Court below is vitiated by some manifest illegality<br \/>\n\tor that the decision is perverse or that Court below has ignored the<br \/>\n\tmaterial evidence on record.\n<\/p>\n<p>In<br \/>\n\tabove view of the matter, I am of the considered opinion that the<br \/>\n\tlearned Additional Principal Judge has completely justified in<br \/>\n\tacquitting the respondent-accused of the charges levelled against<br \/>\n\thim. I find that the findings recorded by the learned Judge are<br \/>\n\tabsolutely just and proper and in recording the said findings, no<br \/>\n\tillegality or infirmity has been committed by it.\n<\/p>\n<p>I<br \/>\n\tam, therefore, in complete agreement with the findings, ultimate<br \/>\n\tconclusion and the resultant order of acquittal recorded by the<br \/>\n\tlearned Additional Principal Judge, Court No.2, Ahmedabad in<br \/>\n\tCriminal Appeal No.75 of 2008 whereby the learned Judge has quashed<br \/>\n\tand set aside the judgment and order of conviction dated 08th<br \/>\n\tAugust 2008 passed by the learned Metropolitan Magistrate, Court<br \/>\n\tNo.11, Ahmedabad in Criminal Case No.174 of 2005, and acquitted the<br \/>\n\trespondent-accused of the charges levelled against him. Hence, the<br \/>\n\tpresent appeal is hereby dismissed. Bail bond, if any, shall stands<br \/>\n\tcancelled. Record and Proceedings, if any, be sent back to the<br \/>\n\tconcerned trial Court, forthwith.\n<\/p>\n<p>(Z.\n<\/p>\n<p>K.
