BASANT, J.\n            -------------------------------------------------\n                     B.A. No. 2025 of 2008\n            -------------------------------------------------\n            Dated this the 7th day of April, 2008\n\n                               ORDER\n<\/pre>\n<p>     Application for anticipatory bail. The petitioner is the 1st<\/p>\n<p>accused. Altogether, there are 2 accused persons.             The 2nd<\/p>\n<p>accused has already been arrested. Both the accused persons<\/p>\n<p>have been named in the F.I.R. The alleged incident took place<\/p>\n<p>on 21\/3\/08. The crux of the allegations against the petitioner<\/p>\n<p>is that they allegedly tormented and assaulted the sister of the<\/p>\n<p>de facto complainant who attends a tutorial college.             On<\/p>\n<p>receipt of information from the tutorial college, the petitioner<\/p>\n<p>in desperation was proceeding towards the tutorial college at<\/p>\n<p>which time the accused persons came in a vehicle and stopped<\/p>\n<p>near the de facto complainant.           The de facto complainant<\/p>\n<p>questioned them as to what they had done to his sister. At this<\/p>\n<p>point of time, the accused persons allegedly attacked the de<\/p>\n<p><span class=\"hidden_text\"> B.A. No. 2025 of 2008         -: 2 :-<\/span><\/p>\n<p>facto complainant with dangerous weapons. One was carrying a<\/p>\n<p>sword and the other was carrying an iron rod. The de facto<\/p>\n<p>complainant ran for shelter towards his house.       The accused<\/p>\n<p>persons are alleged to have followed him.       The sword was<\/p>\n<p>thrown at the de facto complainant. He was allegedly attacked<\/p>\n<p>by the miscreants after he    entered the house. The miscreants<\/p>\n<p>allegedly followed him into his house.    Allegations are raised,<\/p>\n<p>inter alia, under Secs.452 of the IPC and Sec.27 of the Arms Act.<\/p>\n<p>Investigation is in progress.         The petitioner apprehends<\/p>\n<p>imminent arrest.    No wound certificate is available in the file<\/p>\n<p>though there are indications to show that the victim has suffered<\/p>\n<p>some injuries from the body note which forms part of the First<\/p>\n<p>Information Statement.\n<\/p>\n<p>      2. The learned counsel for the petitioner submits that the<\/p>\n<p>petitioner is absolutely innocent. The allegations are inherently<\/p>\n<p>improbable. If the de facto complainant had received information<\/p>\n<p>about what transpired at the tutorial college, how is it that he is<\/p>\n<p>able to see the miscreants when he went out of his house<\/p>\n<p>towards the road. Significantly, the Case Diary does not reveal<\/p>\n<p>and the petitioner does not advance a definite version about the<\/p>\n<p>distance between the tutorial college and the house of the de<\/p>\n<p>facto complainant. In these circumstances, that alleged<\/p>\n<p><span class=\"hidden_text\"> B.A. No. 2025 of 2008          -: 3 :-<\/span><\/p>\n<p>circumstance cannot be reckoned as one indicating such<\/p>\n<p>improbability as to justify the invocation of the extraordinary<\/p>\n<p>equitable discretion under Sec.438 of the Cr.P.C.        This, I agree<\/p>\n<p>with the learned Public Prosecutor, is a fit case where the<\/p>\n<p>petitioner must resort to the ordinary and normal course of<\/p>\n<p>appearing before the Investigating Officer or the learned<\/p>\n<p>Magistrate having jurisdiction and then seek regular bail in the<\/p>\n<p>ordinary course.\n<\/p>\n<p>      3. In the result, this bail application is dismissed; but with<\/p>\n<p>the observation that if the petitioner surrenders before the<\/p>\n<p>Investigating Officer or the learned Magistrate and seeks bail,<\/p>\n<p>after giving sufficient prior notice to the Prosecutor in charge of<\/p>\n<p>the case, the learned Magistrate must proceed to pass<\/p>\n<p>appropriate orders on merits and expeditiously.<\/p>\n<p>                                                     Sd\/-\n<\/p>\n<p>\n                                            (R.
