Shukla, Counsel for appellant.\n          Shri Swapnil Ganguly, Counsel for respondents No.1 &amp; 2.<\/pre>\n<p>          Shri Pushpendra Yadav, Counsel appears for intervener<br \/>\nR.K.Jain by filing caveat whose name has already been deleted<br \/>\nfrom the array of respondents in the cause title of this appeal.\n<\/p>\n<p>          The appellant has challenged an order dated 26.9.2011<br \/>\npassed by the learned Single Judge by which Writ Petition<br \/>\nNo.15238\/11(s) filed by the appellant\/petitioner against the<br \/>\ntransfer order Annexure P\/1 dated 2.9.2011 was dismissed on<br \/>\nthe ground that aforesaid transfer order has been cancelled by<br \/>\nthe State and the petitioner was accommodated at Khandwa<br \/>\nitself.\n<\/p>\n<p>          This order has been assailed by the appellant on the<br \/>\nfollowing grounds:-\n<\/p>\n<p>(i)       That, the appellant was Incharge Executive Engineer at<br \/>\nKhandwa, Building and Road, in the office of the Executive<br \/>\nEngineer, Division Khandwa from where he was transferred as<br \/>\nAssistant Engineer in the office of the Chief Engineer, Western<br \/>\nZone, Public Works Department, Indore on the DO letter of the<br \/>\nCollector, Khandwa. That, within a period of 1\u00bd months,<br \/>\nappellant was transferred from Khandwa to Indore.\n<\/p>\n<p>(ii)      Though respondent No.1 has cancelled the transfer order<br \/>\n(Annexure P\/1) by order dated 9.9.2011 (Annexure R\/1), but in<br \/>\nplace of sending back the petitioner to the same post as<br \/>\nIncharge, Executive Engineer, Public Works Department,<br \/>\nBuilding and Road, Division Khandwa, appellant has been<br \/>\nposted as Assistant Engineer in the office of Superintending<br \/>\nEngineer, Khandwa.\n<\/p>\n<p>          It is submitted that both the orders Annexure P\/1 and R\/1<br \/>\nmay be quashed.<\/p>\n<pre>\n<span class=\"hidden_text\">                                                                        2<\/span>\n\n\n\n\n                        W.A.No.1013\/11\n\n     G.D.Bhandari                             State of M.P. &amp; others\n\n\n\n\n     12.10.2011\n<\/pre>\n<p>           We have perused the order passed by the learned Single<br \/>\n     Judge. The learned Single Judge found that the order dated<br \/>\n     2.9.2011 Annexure P\/1 was modified and vide order dated<br \/>\n     9.9.2011 Annexure R\/1, appellant&#8217;s transfer order was cancelled<br \/>\n     and he was posted at Khandwa on the substantive post of<br \/>\n     Assistant Engineer and in his place, intervener R.KJain was<br \/>\n     posted as Incharge Executive Engineer, Khandwa. Though it<br \/>\n     appears that as per DO letter, appellant was transferred but now<br \/>\n     transfer order has been cancelled and appellant has been<br \/>\n     posted at Khandwa itself on his substantive post of Assistant<br \/>\n     Engineer in the office of Superintending Engineer, PWD, B&amp;R,<br \/>\n     Khandwa.\n<\/p>\n<p>            So far as contention of the appellant that some junior has<br \/>\n     been assigned the charge of Executive Engineer at Khandwa<br \/>\n     and he has been posted as Assistant Engineer, Khandwa is<br \/>\n     concerned, learned Single Judge in the order has reserved the<br \/>\n     right to the appellant to make a representation in this regard to<br \/>\n     the appropriate authority who has been directed to consider the<br \/>\n     grievance of the appellant in accordance with law. In the<br \/>\n     aforesaid order, we do not find any error warranting our<br \/>\n     interference in the appellate jurisdiction. The learned Single<br \/>\n     Judge has rightly dismissed the writ petition because appellant&#8217;s<br \/>\n     transfer order has been cancelled and he has been retained at<br \/>\n     Khandwa itself. So far as second grievance of the appellant is<br \/>\n     concerned, appellant may make a representation to the<br \/>\n     competent authority who shall consider the grievance of the<br \/>\n     appellant in accordance with law.\n<\/p>\n<p>            With the aforesaid observations, this appeal is dismissed<br \/>\n     with no order as to costs.\n<\/p>\n<pre>      (Krishn Kumar Lahoti)                         (Smt.Vimla Jain)\nC.
