Code and sentenced<br \/>\n\thim to suffer Imprisonment for 7 (seven) years and to pay a fine of<br \/>\n\tRs.1,000\/-  i\/d to undergo SI for 4 (four) month and (ii) for the<br \/>\n\toffence punishable under Section  498-A of I.P. Code and sentenced<br \/>\n\thim to suffer Imprisonment for 2 (two) years and to pay a fine of<br \/>\n\tRs.500\/-  i\/d to undergo SI for two months. The learned Judge<br \/>\n\tordered that all the sentences to run concurrently. On 6.3.1996 the<br \/>\n\tappellant has submitted an application that he is poor and unable to<br \/>\n\tengage lawyer and that he may be provided Advocate from the Legal<br \/>\n\tAid. The said application of the appellant was treated as Appeal and<br \/>\n\taccordingly treated as Criminal Appeal No.213 of 1996 and the<br \/>\n\tappellant was provided Advocate from the Legal Aid.\n<\/p>\n<p>The<br \/>\n\tbrief facts of the case of prosecution are that the appellant<br \/>\n\tmarried with Manjuben (deceased) before five years from the date of<br \/>\n\tincident, and out of their wedlock, two daughters were born. It is<br \/>\n\talleged that the appellant was in the habit of consuming liquor and,<br \/>\n\ttherefore, frequently the quarrels were taking place between the<br \/>\n\tappellant and the deceased. It is alleged that on the date of<br \/>\n\tincident, due to mental harassment, the deceased poured kerosene on<br \/>\n\ther and set her on fire. On seeing that his wife is burning, the<br \/>\n\tdeceased shouted for help. Therefore, the neighbourers rushed there<br \/>\n\tand  tried to save her. Thereafter, the father of the deceased came<br \/>\n\tand the deceased was shifted to the hospital where she died. It is<br \/>\n\talleged that when the deceased was shifted to the hospital and when<br \/>\n\tthe Police came, at that time she was fully conscious. The police<br \/>\n\tlodged the complaint. In the said complaint the victim has stated<br \/>\n\tthat her husband (appellant) was in the habit of consuming liquor<br \/>\n\tand was beating and taunting her and, therefore, due to mental<br \/>\n\tharassment of her husband, she has committed suicide. The police<br \/>\n\tregistered the offence under Sections 306 &amp; 498-A of I.P. Code<br \/>\n\tagainst the accused.\n<\/p>\n<p>The<br \/>\n\taccused was arrested. Necessary investigation was carried out by the<br \/>\n\tPolice. The statements of the complainant and other witnesses were<br \/>\n\trecorded.  Thereafter, after completion of investigation, the<br \/>\n\tcharge-sheet against the accused came to be submitted before the<br \/>\n\tCourt. As the offences were triable by the Court of Sessions, the<br \/>\n\tlearned Magistrate committed the case to the Court of Sessions. The<br \/>\n\tlearned Additional Sessions Judge framed the charge against the<br \/>\n\taccused. The accused pleaded not guilty to the charge and claimed to<br \/>\n\tbe tried.\n<\/p>\n<p>To<br \/>\n\tprove the case against the accused, the prosecution has examined the<br \/>\n\twitnesses and also relied upon documentary evidence and at the end<br \/>\n\tof trial, after recording the statement of the accused under Section<br \/>\n\t313 Cr. P.C., and after hearing the arguments on behalf of the<br \/>\n\tprosecution and the defence, the learned Additional Sessions Judge<br \/>\n\theld the appellant  (original accused)  guilty of the offences under<br \/>\n\tSections 306 and 498-A  of I.P. Code and awarded sentence as<br \/>\n\tnaratted herein above.\n<\/p>\n<p>Being<br \/>\n\taggrieved by and dissatisfied with the aforesaid Judgment and order<br \/>\n\tof conviction and sentence, the appellant &#8211; accused has<br \/>\n\tpreferred this Appeal.\n<\/p>\n<p>Heard<br \/>\n\tlearned advocate, appearing on behalf of the appellant and learned<br \/>\n\tAPP Mr. Jani on behalf of the respondent &#8211; State. I have gone<br \/>\n\tthrough the Judgment and order passed by the trial Court. I have<br \/>\n\talso considered the documents produced on the record of the case.\n<\/p>\n<p>Learned<br \/>\n\tAdvocate, appearing on behalf of the appellant &#8211; accused, has<br \/>\n\tcontended that the appellant &#8211; accused has not committed any offence<br \/>\n\tas alleged against him in the charge. He has contended that without<br \/>\n\tproperly appreciating the evidence in its true perspective and<br \/>\n\twithout considering the defence raised by the accused, the trial<br \/>\n\tCourt has booked the accused  just for the sake of conviction. He<br \/>\n\thas contended that he is not arguing the matter on merit and he is<br \/>\n\targuing the matter only for the quantum of sentence. He has<br \/>\n\tcontended that looking to the facts of the case and the fact that<br \/>\n\tthe appellant is having two daughters and there is nobody in his<br \/>\n\tfamily to look after them, the sentence awarded by the learned Judge<br \/>\n\tmay be suitably reduced.\n<\/p>\n<p>Learned<br \/>\n\tAPP has supported the Judgment and order passed by the learned Judge<br \/>\n\tand contended that looking to the seriousness of offence, no<br \/>\n\tinterference of this Court is called for. He has contended that<br \/>\n\tlooking to the facts and evidence on records the learned Judge has<br \/>\n\trightly held the accused guilty for the offences alleged against him<br \/>\n\tand, therefore, no interference is required to be called for.\n<\/p>\n<p>I<br \/>\n\thave gone through the Judgment and order passed by the learned<br \/>\n\tAdditional Sessions Judge and also gone through the documents<br \/>\n\tproduced before me. I have also considered the submissions made by<br \/>\n\tthe learned Advocates for the parties. I have gone through the<br \/>\n\trecord and proceedings of the case. I have also gone through the<br \/>\n\tevidence of the prosecution witnesses and other material evidence. I<br \/>\n\thave also considered the Judgment of the trial Court. From the<br \/>\n\tevidence on record, it clearly appears that the learned Judge has<br \/>\n\tnot committed any error in holding the appellant &#8211; accused<br \/>\n\tguilty of the offences alleged against him.  However, looking to the<br \/>\n\tfacts of the case, in my opinion, the sentence awarded by the<br \/>\n\tlearned Judge is required to be reduced. The learned Advocate<br \/>\n\tappearing on behalf of the appellant has also contended that the<br \/>\n\tappellant &#8211; accused is poor person and is a bread-winner of<br \/>\n\tthe family and, therefore, some leniency may be shown towards the<br \/>\n\tappellant. It is stated at the bar that the appellant &#8211;<br \/>\n\taccused  had already undergone the sentence of about 2 years.<br \/>\n\tHowever, at present, he is on bail. Looking to the facts of the case<br \/>\n\tand considering the facts that the appellant is having two daughters<br \/>\n\tand there is no body to look after them, I am, therefore,  of the<br \/>\n\topinion that if the sentence awarded by the learned Judge for the<br \/>\n\toffence under Section 306 of I.P. Code is reduced to an extent of<br \/>\n\t4-12 years, the same would serve the ends of justice.\n<\/p>\n<p>In<br \/>\n\tview of above, the Appeal is partly allowed. The Judgment and order<br \/>\n\tof conviction and sentence dated 20.02.1996 passed by learned<br \/>\n\tAdditional Sessions Judge, Junagadh, in Sessions Case No. 119 of<br \/>\n\t1994 is hereby confirmed. However, the sentence awarded by the<br \/>\n\tlearned Sessions Judge, vide impugned judgment, holding the<br \/>\n\tappellant &#8211; accused guilty for the offences under Section 306<br \/>\n\tof I.P. Code is modified and reduced to an extent of 4-1\/2 years<br \/>\n\t(four years and six months) imprisonment, instead of 7 (seven) years<br \/>\n\timprisonment.  Rest of the Judgment and order passed by the learned<br \/>\n\tSessions Judge is confirmed. Sentence of fine imposed for the<br \/>\n\toffence under Section 306 of I.P. Code is also hereby confirmed. The<br \/>\n\tappellant &#8211; accused is on bail and, therefore, his Bail Bond<br \/>\n\tstands cancelled and he is directed to surrender before the Jail<br \/>\n\tAuthority to under-go his sentence within a period of 4 (four)<br \/>\n\tweeks, failing which Non-Bailable Warrant shall be issued against<br \/>\n\tthe appellant &#8211; accused to effect his arrest.
