SHAH\n\t\t\n\t\n\n \n\nDate\n: 13\/08\/2010 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 226 of the Constitution of India,<br \/>\npetitioner Laxmi Co-operative Bank Employees Union has prayed for an<br \/>\nappropriate writ, direction or order directing the respondents to<br \/>\nmake payment of legal dues to the employees of the Laxmi Co-operative<br \/>\nBank as shown in the chart at Annexure Q to the petition.\n<\/p>\n<p>2.\tShri<br \/>\nPrabhakar Upadhyay, learned advocate appearing on behalf of the<br \/>\npetitioner has submitted that as such the controversy raised in the<br \/>\npetition with respect to priority is at large before the Division<br \/>\nBench of this Court in Letters Patent Appeal No.906\/2010 and other<br \/>\ncognate Letter Patent Appeals.  Therefore, it is submitted to dispose<br \/>\nof the present Special Civil Application reserving the liberty in<br \/>\nfavour of the petitioner to approach the appropriate authority<br \/>\nsubsequently after the decision of the Division Bench of this Court<br \/>\nin Letters Patent Appeal No.906\/2010 and other allied Letter Patent<br \/>\nAppeals, with a request to grant similar benefit to the petitioner on<br \/>\nthe basis of the judgment of the Division Bench that may be delivered<br \/>\nin the aforesaid Letters Patent Appeal No.906\/2010 and other allied<br \/>\nLetter Patent Appeals.\n<\/p>\n<p>\tShri<br \/>\nDilip Rana, learned advocate appearing on behalf of the Liquidator of<br \/>\nthe Bank has submitted that as such all the employees of the Laxmi<br \/>\nCo-operative Bank are already paid their entire dues and petitioner<br \/>\nUnion and the respective employees are asking for the amount more<br \/>\nthan which was required to be paid.  With respect to the above, this<br \/>\nCourt has not expressed any opinion on merits and as and when<br \/>\nsubsequently the petitioner Union approaches the appropriate<br \/>\nAuthority, the same may be considered and taken care of.\n<\/p>\n<p>3.\tIn<br \/>\nview of the above, present Special Civil Application is disposed of<br \/>\nwith a liberty in favour of the petitioner to approach the<br \/>\nappropriate authority subsequently on the basis of the decision that<br \/>\nmay be rendered by the Division Bench in Letters Patent Appeal<br \/>\nNo.906\/2010 and other allied matters and as &amp; when such<br \/>\nrepresentation \/ application is made, subsequently, the same may be<br \/>\nconsidered in accordance with law and on merits and in light of the<br \/>\ndecision that may be rendered by the Division Bench in aforesaid<br \/>\nLetters Patent Appeal No.906\/2010 and other allied matters.
