RAMACHANDRA MENON, J.\n             ........................................................................\n                   W.P.(C) No.21182 OF 2009\n             .........................................................................\n                       Dated this the 28            th July, 2009\n\n\n                                 J U D G M E N T\n<\/pre>\n<p>      The petitioners have approached this Court by filing the<\/p>\n<p>present Writ Petition challenging the coercive steps taken by<\/p>\n<p>the respondent           Bank invoking the provisions under the<\/p>\n<p>SARFAESI Act; simultaneously pointing out that the petitioners<\/p>\n<p>are ready and willing to clear the entire liability to the Bank<\/p>\n<p>provided some breathing time is given in this regard.<\/p>\n<p>      2. The learned Counsel for the petitioners submits                                 that<\/p>\n<p>when the petitioners were confronted with the actual facts and<\/p>\n<p>figures on an earlier occasion, they had approached this Court by<\/p>\n<p>filing W.P.(C)No.8552 of 2009 wherein an interim order was<\/p>\n<p>passed by this Court on 18.03.2009 directing to pay a sum of<\/p>\n<p>Rs.Three lakhs, subject to which, the coercive steps                                     were<\/p>\n<p>intercepted. However, on finding that the condition imposed by<\/p>\n<p>this Court was not satisfied, interference was declined and the<\/p>\n<p>Writ Petition was dismissed                     as per Ext.P1 judgment.                  The<\/p>\n<p>learned Counsel for the petitioners submits that the condition<\/p>\n<p>W.P.(C) No.21182 OF 2009<\/p>\n<p><span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>imposed by this Court was however satisfied though belatedly<\/p>\n<p>and that the only relief claimed for in the present Writ Petition is<\/p>\n<p>to permit the petitioners to satisfy the entire liability by way<\/p>\n<p>of reasonable installments.\n<\/p>\n<p>       3. Prima facie no interference is called for, since the matter<\/p>\n<p>has already      become final in view of Ext. P1 judgment.<\/p>\n<p>However, in view of the persuasive submissions made by the<\/p>\n<p>learned Counsel for the petitioners that the challenge raised by<\/p>\n<p>the petitioners against the steps taken by the respondent Bank<\/p>\n<p>under the SARFAESI Act, is no more intended to be pursued and<\/p>\n<p>further since the learned Counsel appearing for the respondent<\/p>\n<p>Bank fully concedes that the petitioners had already satisfied the<\/p>\n<p>condition imposed by this Court while granting the interim order<\/p>\n<p>on 18.03.2009, though belatedly, the Bank is ready and willing<\/p>\n<p>to give an opportunity to the petitioners to wipe out the entire<\/p>\n<p>liability.\n<\/p>\n<p>       4.  The learned Counsel for the Bank submits that the<\/p>\n<p>petitioners will have to prove their bonafides by remitting a<\/p>\n<p>substantial portion of the liability    immediately and that the<\/p>\n<p>W.P.(C) No.21182 OF 2009<\/p>\n<p><span class=\"hidden_text\">                                  3<\/span><\/p>\n<p>balance amount      shall be cleared     within a reasonable time<\/p>\n<p>thereafter.\n<\/p>\n<p>      5. In the above facts and circumstances, the petitioner is<\/p>\n<p>directed to deposit a sum of Rs. One lakh on or before the 15th<\/p>\n<p>September 2009 and the balance amount shall be paid on or<\/p>\n<p>before the 31st December, 2009.         Subject to the above all<\/p>\n<p>coercive   proceedings stated as      being pursued    against the<\/p>\n<p>petitioners shall be kept in abeyance       and if any default is<\/p>\n<p>committed by the petitioners in satisfying the liability as above,<\/p>\n<p>the respondent Bank will be at liberty to proceed with further<\/p>\n<p>steps from the stage where it stands now for realisation of the<\/p>\n<p>entire amount in a lump sum.\n<\/p>\n<p>      The Writ Petition is disposed of as above.\n<\/p>\n<\/p>\n<p>                                 P.R.
