JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 24\/08\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>Mr.H.J.Nanavati,<br \/>\n\tlearned counsel for the petitioner submits that due to inadvertence,<br \/>\n\trespondent No.2-Vice Chancellor, Hemchandracharya North Gujarat<br \/>\n\tUniversity is to be served through the Secretary to Her Excellency,<br \/>\n\tthe Governer. He therefore, prays that he may be permitted to amend<br \/>\n\tthe cause-title, as regards respondent No.2.\n<\/p>\n<p>Permission<br \/>\n\tto do so, is granted. The necessary amendment be carried out,<br \/>\n\tforthwith.\n<\/p>\n<p>Mr.H.J.Nanavati,<br \/>\n\tlearned advocate for the petitioner has submitted that as per<br \/>\n\tSection 19(1)(X) of the Hemchandracharya North Gujarat University<br \/>\n\tAct, 1986, Readers are to be nominated to the Executive Council by<br \/>\n\trotation, in the manner prescribed by the Statutes. It is submitted<br \/>\n\tthat Statute 65 is applicable to nomination of Professors and<br \/>\n\tStatute 65 would apply mutatis mutandis, for appointment of Readers<br \/>\n\tand the procedure prescribed in Statute 65 is to be followed.<br \/>\n\tLearned advocate for the petitioner has further submitted that by<br \/>\n\tapplying the provisions of Statute 65, the University would have to<br \/>\n\tfollow the process of rotation and the order of Professors in the<br \/>\n\tlist would also have to be followed. The petitioner is next on the<br \/>\n\tlist, after Dr.C.P.Bhasin, whose term has ended in March, 2011, and<br \/>\n\tin order of rotation on the list, his name should be considered for<br \/>\n\tnomination to the Executive Council. Instead, respondent No.4, whose<br \/>\n\tname is at Serial No.5 of the list has been considered and<br \/>\n\tappointed.\n<\/p>\n<p>Mr.Amit<br \/>\n\tM. Panchal, learned advocate for respondents No.2 and 3 has<br \/>\n\tsubmitted that respondent No.4 was appointed as Reader during the<br \/>\n\ttenure of Dr.C.P.Bhasin, whose name was at Serial No.1 of the list.<br \/>\n\tAs respondent No.4 had not got a chance to be nominated as Member of<br \/>\n\tthe Executive Council, and the petitioner had already served as<br \/>\n\tMember of the Council once, the name of respondent No.4 has rightly<br \/>\n\tbeen considered, in accordance with the provisions of the Act and<br \/>\n\tStatute.\n<\/p>\n<p>Mr.Nachiket<br \/>\n\tA. Dave, learned advocate for respondent No.4 has submitted that the<br \/>\n\tname of respondent No.4 was considered and he was appointed, as he<br \/>\n\tis the only candidate who had not got a chance of being nominated to<br \/>\n\tthe Executive Council, therefore, his appointment is justified.\n<\/p>\n<p>Having<br \/>\n\theard learned advocates for the respective parties and upon perusal<br \/>\n\tof the relevant provisions of the Act and Statutes, it appears that<br \/>\n\tthe matter requires deeper consideration.\n<\/p>\n<p>Hence,<br \/>\n\tRule, returnable on 30.09.2011.
