KRISHNAN, J.\n               = = = = = = = = = = = = = = =\n                    M.F.A.NO. 642 OF 2002\n               = = = = = = = = = = = = = = =\n           Dated this the 18th day of June, 2008.\n\n                        J U D G M E N T\n<\/pre>\n<p>     This appeal is preferred against the award of the Motor<\/p>\n<p>Accidents Claims Tribunal, Pala in OP(MV)1287\/95. It relates<\/p>\n<p>to the damages sustained by the vehicle in a road accident.<\/p>\n<p>The Tribunal after elaborately considering the materials<\/p>\n<p>available awarded a compensation of Rs.33,333\/- as damages<\/p>\n<p>with 9% interest. The point that arises for determination is<\/p>\n<p>whether a tortfeasor is liable to get the benefit out of the<\/p>\n<p>compensation paid under a comprehensive policy to the owner<\/p>\n<p>of the vehicle concerned. The Delhi High Court has taken a<\/p>\n<p>view that in such cases a tortfeasor shall not be a beneficiary<\/p>\n<p>and therefore that it is liable to pay the entire amount. The<\/p>\n<p>matter has been considered by this Court in the decision<\/p>\n<p>reported in <a href=\"\/doc\/101211\/\">National Insurance Co. Ltd. v. Mohan<\/a> (2008<\/p>\n<p>(2) KLT 683).      The learned judge of this Court held that<\/p>\n<p>insured is entitled to maintain an action against the tortfeasor<\/p>\n<p>MFA 642 of 2002<br \/>\n<span class=\"hidden_text\">                                -2-<\/span><\/p>\n<p>even if he has received compensation from his insurer. But he<\/p>\n<p>cannot appropriate that amount he had received from the<\/p>\n<p>Company and he will hold that amount as trustee of insurer.<\/p>\n<p>The Court held that,<\/p>\n<p>            &#8220;The insured is entitled to maintain an action<\/p>\n<p>      against the tortfeasor even if he had received<\/p>\n<p>      compensation from his insurer.        But he cannot<\/p>\n<p>      appropriate that amount which he had received<\/p>\n<p>      from the company and he will hold that amount as<\/p>\n<p>      trustee of the insurer and he is answerable and<\/p>\n<p>      accountable to the insurance company to that extent.<\/p>\n<p>      If the insurer after obtaining a letter of subrogation<\/p>\n<p>      from the first respondent had filed an Original<\/p>\n<p>      Petition or it had also joined in filing the original<\/p>\n<p>      petition it would have been entitled to that amount.<\/p>\n<p>      Even assuming that first respondent is entitled to<\/p>\n<p>      receive the amount he can only receive the same in<\/p>\n<p>      trust. But the insurer has not made any claim over<\/p>\n<p>      the amount though it is made a party to this<\/p>\n<p>      proceedings.    So the first respondent cannot be<\/p>\n<p>      allowed to make any double benefit. So he is not<\/p>\n<p>      entitled   to   get   any    compensation     in  this<\/p>\n<p>      proceedings.&#8221;\n<\/p>\n<p>MFA 642 of 2002<br \/>\n<span class=\"hidden_text\">                               -3-<\/span><\/p>\n<p>      2.   So the dictum laid down very clearly indicates that<\/p>\n<p>at the most one may be entitled to get the difference of the<\/p>\n<p>actual damages that is sustained but one will not be entitled to<\/p>\n<p>that amount also which had been paid by the insurer of one&#8217;s<\/p>\n<p>own vehicle. It is on the salutary principle that for the same<\/p>\n<p>act one cannot get compensation twice.<\/p>\n<p>      3.   So far as this case is concerned there is one<\/p>\n<p>difference to the effect that what is now claimed is only the<\/p>\n<p>balance amount other than what is paid by the other insurance<\/p>\n<p>company.    The Tribunal has fixed the total compensation<\/p>\n<p>amount at Rs.33,333\/- and it is submitted that the owner of<\/p>\n<p>the vehicle had received Rs.20,803\/- from the insurer of his<\/p>\n<p>vehicle.   When it is so the compensation which the owner is<\/p>\n<p>entitled to from the tortfeasor has to be limited to Rs.12,530<\/p>\n<p>for the reason that the other insurance company has not made<\/p>\n<p>any claim applying the principles of subrogation. Therefore<\/p>\n<p>recording the factum of payment of Rs.20,803\/- only the<\/p>\n<p>balance amount of Rs.12,530\/- is liable to be paid by the<\/p>\n<p>insurance company of the tortfeasor. To this extent the award<\/p>\n<p>requires modification.\n<\/p>\n<p>MFA 642 of 2002<br \/>\n<span class=\"hidden_text\">                                -4-<\/span><\/p>\n<p>      4.   Therefore the MACA is partly allowed and the<\/p>\n<p>claimant is awarded a compensation of Rs.12,530\/- with 9%<\/p>\n<p>interest on the said sum from the date of petition till<\/p>\n<p>realisation with the costs ordered by the Tribunal. In the<\/p>\n<p>appeal parties are directed to bear their respective costs.<\/p>\n<p>                                 M.N.
