(J)\n\nCITATION:\n 1984 AIR  372\t\t  1984 SCR  (1) 839\n 1984 SCC  (1) 284\t  1983 SCALE  (2)818\n CITATOR INFO :\n D\t    1985 SC 969\t (12)\n\n\nACT:\n     Criminal Procedure-Bail-For  cancellation of  bail very\ncogent and overwhelming circumstances are necessary.\n     Practice-Bail granted  by\tSessions  Judge\t by  a\twell\nreasoned order-Set  aside by  High  Court-Supreme  Court  to\ninterfere  if\tapproach  adopted   by\tHigh  Court  is\t not\ncommending.\n\n\n\nHEADNOTE:\n     The appellant,  against whom  an offence under sec. 307\nI.P.C. had  been registered  for giving\t knife\tblows  to  a\nperson\twas   granted  bail   by  the\tSessions  Judge.  On\napplication by\tthe State,  a Single Judge of the High Court\ncancelled the bail. Hence this appeal by special leave.\n     Allowing the appeal,\n^\n     HELD: Very\t cogent and  overwhelming circumstances\t are\nnecessary for  an order seeking cancellation of the bail and\nthe trend  today is  towards granting bail because it is now\nwell-settled that  the power  to grant\tbail is\t not  to  be\nexercised  as  if  the\tpunishment  before  trail  is  being\nimposed.  The\tonly  material\t considerations\t in  such  a\nsituation are whether the accused would be readily available\nfor his\t trial\tand  whether  he  is  likely  to  abuse\t the\ndiscretion granted in his favour by tampering with evidence.\n[842 D-E]\n     In the instant case the order made by the High Court is\nconspicuous  by\t  its  silence\t on   these   two   relevant\nconsiderations. The  learned Judge  was impressed by some of\nthe most  irrelevant considerations and misdirected himself.\nThe circumstances  found by him that the victim attacked was\na social  and political\t worker could  not be  considered so\noverriding as  to permit interference by the High Court with\nthe discretionary order of the Sessions Judge granting bail.\nThe High  Court completely  overlooked the  fact that it was\nnot for\t it to decide whether the bail should be granted but\nthe application\t before it was for cancellation on the bail.\n[842 B-C]\n\n\n\nJUDGMENT:\n<\/pre>\n<p>     CRIMINAL APPELLATE\t JURISDICTION: Criminal\t Appeal\t No.<br \/>\n658 of 1983.\n<\/p>\n<p><span class=\"hidden_text\">840<\/span><\/p>\n<p>     Appeal by\tSpecial leave  from the\t Judgment and  Order<br \/>\ndated the  21st October,  1983 of  the Gujarat High Court in<br \/>\nCriminal Misc. V.<br \/>\nSubba Rao for the Respondent.\n<\/p>\n<p>     The Judgment of the Court was delivered by<br \/>\n     DESAI, J. Special Leave granted.\n<\/p>\n<p>     Ordinarily this Court is not inclined to interfere with<br \/>\nthe orders  either granting  or refusing to grant bail to an<br \/>\naccused person\teither facing a criminal trial or whose case<br \/>\nafter conviction  is pending in appeal. However, this is not<br \/>\na case\twhere bail  is granted\tor  refused  but  the  order<br \/>\ngranting the  bail by  the learned  Sessions Judge  was\t set<br \/>\naside by  the High Court adopting an approach which does not<br \/>\ncommend to us.\n<\/p>\n<p>     It is  alleged that  the appellant\t gave blows  with  a<br \/>\nknife to  one Popatlal\tSorathia, who  had come\t to visit an<br \/>\nindoor patient\tNavalsinh Bhatti  on August  17, 1983 around<br \/>\n9.45 A.M.  Appellant was  accosted by the policemen on duty.<br \/>\nAn offence  under Sec. 307 I.P.C. was registered against him<br \/>\nand  the   appellant  was   taken  into\t  custody  and\t was<br \/>\nsubsequently remanded  to judicial  custody. An\t application<br \/>\nfor releasing him on bail was made on August 22, 1983 to the<br \/>\nChief  Judicial\t  Magistrate,  Rajkot.\tThe  Chief  Judicial<br \/>\nMagistrate, Rajkot  was pleased\t to dismiss  the same by his<br \/>\norder dated August 29, 1983.\n<\/p>\n<p>     On the  same day,\tan  application\t for  releasing\t the<br \/>\nappellant on  bail was\tmoved before  the  learned  Sessions<br \/>\nJudge. A notice was issued to the learned Public Prosecutor.<br \/>\nAfter hearing  both the sides, the learned Sessions Judge by<br \/>\na  well-reasoned   order  directed  that  the  appellant  be<br \/>\nreleased on bail on his furnishing security in the amount of<br \/>\nRs. 5000 and personal bond of the like amount.\n<\/p>\n<p>     It\t appears   that\t  the\tState\tof   Gujarat   filed<br \/>\nMiscellaneous Criminal\tApplication No.\t 1724 of 1983 in the<br \/>\nHigh Court  of Gujarat\tseeking cancellation  of  the  order<br \/>\ngranting bail  to the  appellant. A  learned Single Judge of<br \/>\nthe High Court held that once a prima facie case is<br \/>\n<span class=\"hidden_text\">841<\/span><br \/>\nestablished, the  learned Sessions Judge ought to have taken<br \/>\ninto  consideration   the  nature   and\t  gravity   of\t the<br \/>\ncircumstances in which the  offence is committed. The charge<br \/>\nagainst the  appellant is  that he  has committed an offence<br \/>\npunishable under  Sec. 307 I.P.C. and Sec. 135 of the Bombay<br \/>\nPolice Act  and even  on the  date of hearing of this appeal<br \/>\nbefore us  on November 18, 1983, the Court-was informed that<br \/>\nthe victim is alive and at present there is no danger to his<br \/>\nlife. Nearly  3 months\thave rolled  by from the date of the<br \/>\noffence. We fail to understand what the learned Judge of the<br \/>\nHigh Court  desires to convey when he says that once a prima<br \/>\nfacie case  is established, it is necessary for the court to<br \/>\nexamine the nature and gravity of the circumstances in which<br \/>\nthe offence  was committed.  If there is no prima facie case<br \/>\nthere is  no question of considering other circumstances But<br \/>\neven where  a prima  facie case is established, the approach<br \/>\nof the\tcourt in  the matter of bail is not that the accused<br \/>\nshould be  detained by\tway of\tpunishment but\t whether the<br \/>\npresence of  the accused   would  be readily  available\t for<br \/>\ntrial or that he is likely   to abuse the discretion grained<br \/>\nin his\tfavour by  tampering with  evidence. We\t would\thave<br \/>\ncertainly overlooked  this  aspect  of\tthe  matter  if\t the<br \/>\napproach of  the learned judge was otherwise one which would<br \/>\ncommend\t  to us.  It however  appears that the learned judge<br \/>\nwas impressed  by some of the most irrelevant considerations<br \/>\nwhich prima  facie emerge from the following observations of<br \/>\nthe learned judge which permits his whole order running into<br \/>\nabout 13 pages.\n<\/p>\n<p>     Says the learned judge:\n<\/p>\n<p>\t  &#8220;The learned\tJudge ought  to have  seen the\tfact<br \/>\n     that the  helpless victim\thad gone to the hospital for<br \/>\n     pre-operation check-up.  He was  a leading\t social\t and<br \/>\n     political\t   worker.  He\twas  an\t active\t worker\t and<br \/>\n     Secretary\tof  &#8220;Gundagiri\tNivaran\t Samiti&#8221;  which\t had<br \/>\n     raised a  campaign\t against  the  atrocities  allegedly<br \/>\n     having  been  committed  by  the  Rajputs\tof  Girasiya<br \/>\n     community. Admittedly  the respondent  is Girasiya\t and<br \/>\n     the complainant  who was an active worker and Secretary<br \/>\n     of Gundagiri  Nivaran Samiti had become a victim at the<br \/>\n     hands of  the respondent.\tThe learned  Judge ought  to<br \/>\n     have taken\t into consideration  the material  fact that<br \/>\n     the incident  had taken  place in\tthe premises  of the<br \/>\n     Hospital which  may terrorize  a number of sick persons<br \/>\n     who might be getting treatment in the hospital.&#8221;\n<\/p>\n<p><span class=\"hidden_text\">842<\/span><\/p>\n<p>     At another\t place, the  learned Judge has observed that<br \/>\nthe learned  Sessions Judge  has ignored,  the fact  that  a<br \/>\nsocial and  political worker  was attacked  in the  hospital<br \/>\npremises with  a knife\thaving 9&#8243;  blade and  as many as 1 l<br \/>\ninjuries were caused to a helpless victim.\n<\/p>\n<p>     In our  opinion, the  learned  Judge  appears  to\thave<br \/>\nmisdirected  himself   while  examining\t  the  question\t  of<br \/>\ndirecting  cancellation\t  of  bail  by\tinterfering  with  a<br \/>\ndiscretionary order  made by the learned Sessions Judge. One<br \/>\ncould have  appreciated the  anxiety of the learned Judge of<br \/>\nthe High  Court that  in the circumstances found by him that<br \/>\nthe victim  attacked was  a social  and political worker and<br \/>\ntherefore the  accused should  not be,\tgranted bail  but we<br \/>\nfail  to   appreciate  how   that  circumstance\t  should  be<br \/>\nconsidered so  overriding as  to permit\t interference with a<br \/>\ndiscretionary order  of the  learned Sessions Judge granting<br \/>\nbail. The  High Court completely overlooked the fact that it<br \/>\nwas not\t for it to decide whether the bail should be granted<br \/>\nbut the\t application before  it was  for cancellation of the<br \/>\nbail.  Very   cogent  and   overwhelming  circumstances\t all<br \/>\nnecessary for an order seeking cancellation of the bail. And<br \/>\nthe trend  today is  towards granting bail because it is now<br \/>\nwell-settled by a catena of decisions of this Court that the<br \/>\npower to  grant bail  is not  to  be  exercised\t as  if\t the<br \/>\npunishment before  trial is being imposed. The only material<br \/>\nconsiderations in  such a  situation are whether the accused<br \/>\nwould be  readily available  for his trial and whether he is<br \/>\nlikely to  abuse the  discretion granted  ill his  favour by<br \/>\ntampering with evidence. The order made by the High Court is<br \/>\nconspicuous  by\t  its  silence\t on   these   two   relevant<br \/>\nconsiderations. It  is for these reasons that we consider in<br \/>\nthe interest  of justice a compelling necessity to interfere<br \/>\nwith the order made by the High Court.\n<\/p>\n<p>     We accordingly  allow this\t appeal and  set  aside\t the<br \/>\norder made  by the  learned High Court Judge and restore the<br \/>\none made  by  the  learned  Sessions  Judge  with  following<br \/>\nmodifications:\n<\/p>\n<blockquote><p>     (i)   The appellant  shall be  released or\t if he is on<br \/>\n\t  bail continue &#8216;to be on bail on his furnishing two<br \/>\n\t  fresh bail-bonds  each in  the amount\t of  Rs.5000<br \/>\n\t  supported by a solvent security.\n<\/p><\/blockquote>\n<blockquote><p>     (ii) The  &#8216;appellant shall report on first Monday every<br \/>\n\t  month before the Chief Judicial Magistrate, Rajkot<br \/>\n\t  at 11.00 A.M. till his trial commences.
