This appeal by<br \/>\nspecial 1eave  arises from  the order of the single Judge of<br \/>\nthe Madhya  Pradesh  High  Court  at  Jabalpur\tBench  dated<br \/>\nJanuary 20, 1993 made in M.A. No.337\/91.\n<\/p>\n<p>       The  appellant  laid  the  suit\tfor  declaration  of<br \/>\nprescriptive title  to the  property from  1974 in  his\t own<br \/>\nright and perfected the title thereto by adverse possession.<br \/>\nHe also filed an application under Order 39 Rule 1 and 2 CPC<br \/>\nseeking temporary injunction restraining the respondent from<br \/>\ninterdicting his  possession pending  the  suit.  The  trial<br \/>\nCourt granted  the injunction  but on appeal it was reversed<br \/>\nby  the learned single Judge in the impugned order. The High<br \/>\nCourt has concluded that when there is no dispute as regards<br \/>\nthe incoporeal\tright in litigation, the declaratory suit is<br \/>\nonly a\tright to  the property\tbut not to the right itself;<br \/>\nOrder 39 Rules 1 and 2 CPC could be availed of only when the<br \/>\nproperty, the  subject matter thereof, is in danger of being<br \/>\nwasted, damaged\t or otherwise  being dealt with. In a simple<br \/>\nsuit for declaratory nature without any consequential relief<br \/>\nthere cannot  be any dispute as regards the property because<br \/>\nthe dispute is not about the property but to the entitlement<br \/>\nof the\tright sought in respect of the property which itself<br \/>\nis directly involved in the suit but not in an Interlocutory<br \/>\norder. Consequently,  it was  held that the grant of interim<br \/>\ninjunction is  beyond the  jurisdiction of  the Court  under<br \/>\nOrder 39  rule 1  and 2.  We are  of the  view that the view<br \/>\nexpressed by the High Court is not correct in law. In a suit<br \/>\nfor declaration\t of title  simpliciter, the  Court has power<br \/>\nunder Order  39, Rules\t1 and  2 or  even in  Section 151 to<br \/>\ngrant ad interim injunction pending suit.\n<\/p>\n<p>     Admittedly, the  appellant\t is  in\t possession  of\t the<br \/>\nproperty. In view of his apprehension that there is a threat<br \/>\nto his\tpossession, his only remedy wou1d be whether he will<br \/>\nbe entitled  to the declaration sought for. When he seeks to<br \/>\nprotect\t his   possession,  if\t he  is\t otherwise  entitled<br \/>\naccording to  law, necessarily\tthe Court  has\tto  consider<br \/>\nwhether protection  is to  be given to him pending the suit.<br \/>\nMerely because\tthere is no dispute as regards the corporeal<br \/>\nright to  the property,\t it does not necessarily follow that<br \/>\nhe is not entitled to avail the remedy under Order 39, Rules<br \/>\n1 and  2 CPC.  Even otherwise  also, it\t is settled law that<br \/>\nunder Section  151 CPC,\t the Court has got inherent power to<br \/>\nprotect the  rights of\tthe parties  pending the suit. Under<br \/>\nthese circumstances,  the view\texpressed by  the High Court<br \/>\nthat application  itself  is  not  maintainable\t is  clearly<br \/>\nillegal and erroneous. The application under Order 39, Rules<br \/>\n1 and 2 is maintainable.\n<\/p>\n<p>     The matter\t is remitted  to the  High Court to consider<br \/>\nthe case on merits and dispose it of according to law, since<br \/>\nthe High Court did not consider the case on merits.\n<\/p>\n<p>       Status  quo would  continue till\t the disposal of the<br \/>\nappeal in the High Court.\n<\/p>\n<p>\t The appeal is accordingly allowed.
